Incomplete judgement (Rev. Order 7 of 98) [1998] LSCA 103 (10 November 1998)

IN THE HIGH COURT OF LESOTHO ORDER OF REVIEW REVIEW ORDER 7/98 IN LERIBE DISTRICT It is ordered that all the part-heard cases by the late Miss 'Marosa Moahloli - Resident Magistrate - must start de novo before another magistrate. The previous proceedings before the late Resident Magistrate are set aside on the ground of her death. All the files of the criminal cases in question must be returned to the Senior Resident Magistrate for the district of Leribe. The evidence recorded by the late Resident Magistrate might be of vital important in some cases if it turns out to be inconsistent with the n ew evidence a witness is n ow giving.
