IN THE MATTER OF THE ESTATE OF ELIZABETH NJERI MWANGI (DECEASED)

RULING

The application dated 15th December 2012 is for confirmation of grant. The provision under which the application is brought is not indicated but it presumed that it is brought under section 71 of the Law of Succession Act which provides for confirmation of grants.

I have carefully gone through the proposed mode of distribution and I am satisfied that it conforms to Section 38of the Law of Succession Act. I will allow the application and confirm the grant made on 2nd October 2009 to Agnes Kiraithe and Joseph Kuria Mwangi. The estate shall devolve as proposed in paragraph 5 of the joint affidavit of the administrators sworn on 15th December 2012.
