The operation}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 was directed by the police control room at the Central Police Station (CPS),Kampala. The appellant had a gun plus 30 rounds of ammunition. So had}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 Topaco and the deceased. The group met the person who complained about}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the suspected stolen vehicle which was parked at the bar. We shall}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 hereinafter refer to the car as the stolen vehicle. The complainant joined the}{\cs40\fs26\cf1\insrsid15805454\charrsid15805454 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 group. After introduction, and as the group watched the stolen vehicle, some}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 people (two men, a woman and a child) entered it. The group trailed the vehicle in a car bearing civilian}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 numbers. The accused drove this car. As the two vehicles moved on, the}{ \cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 stolen vehicle took Katwe Police Station direction while the }{\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 999 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 vehicle }{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 took Makindye road direction. The group's vehicle slowed down due to}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 traffic jam. The deceased who was the commander of the group, directed}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the appellant driver to overtake other vehicles in the jam in order to catch up}{ \cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 with the stolen vehicle. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb77\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 At Najjanankumbi, the stolen vehicle turned into a side murrain road. The}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 group's vehicle followed it and at some point the groups' vehicle overtook}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the stolen car. Cpl. Okulu Obwangamoi who was now armed with Topaco's}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 gun jumped out of the car and sped towards the stolen car, stopped it and}{ \cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 demanded for the vehicle's ignition keys. Then Obwangamoi heard rapid}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 gun shots from his left side and when he looked there, he saw the appellant}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 and asked him about what happened. The appellant who was still armed}{ \cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 with his gun did not reply. Meanwhile Cpl. Okulu Obwangamoi heard}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 someone cry out from the stolen vehicle that he had been shot. The driver inthe stolen vehicle appealed for mercy. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb96\sl-470\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Obwangamoi and the appellant returned to Katwe Police Station. The}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 deceased who had been left behind was at 8.30 p.m. taken to Katwe Police}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Station by a minibus. According to D. C Betungura (PW6), the deceased \par }\pard\plain \s28\qj \li0\ri0\sb67\sl-480\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 \fs24\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\cs46\i\fs26\cf1\insrsid12926289\charrsid15805454 "was talking in a confused way saying he had been shot by a fellow Police}{\cs46\i\fs26\cf1\insrsid2313983 }{\cs39\i\fs26\cf1\insrsid12926289\charrsid15805454 Officer}{\cs39\i\fs26\expnd2\expndtw10\cf1\insrsid12926289\charrsid15805454 }{ \cs46\i\fs26\cf1\insrsid12926289\charrsid15805454 with whom he was on duty. " \par }\pard\plain \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 \fs24\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb82\sl-480\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 The deceased later died from gun wounds. The appellant was charged with}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 the murder of the deceased. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb82\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 DIP }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Henry Mbabazi (PW4) gave evidence to the effect that he had given to}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 each of the three policemen a gun with 30 rounds of ammunition. When he}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 received back the three guns after the incident and verified on the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 ammunition, it wa s the gun of the appellant which had 5 rounds of}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 ammunition fewer. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb86\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 In his sworn evidence, the appellant admitted being in the group which}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 trailed the stolen car in the company of Topaco, the deceased and}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Obwangamoi. He claimed that they were instructed to look for car }{\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 No. UDD244, }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 which had been highjacked by gunmen. According to him, the group}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 chased the suspected vehicle and found it abandoned at Najjanankumbi}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 where the deceased, Topaco and Obwangamoi followed the stolen vehicle}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 on foot. The appellant claimed he was ordered by patrol commander to}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 remain in the groups' vehicle and he did so. According to him, he had been}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 given orders by the patrol command vehicle to shoot if he heard bullet shots.}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Later he heard gun shots from the direction taken by Topaco, the deceased}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 and Obwangamoi. Upon hearing the gun shots, he got out of his vehicle andreplied by shooting in the air. Thereafter a }{\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 999 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 vehicle appeared at the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 scene. He and the }{\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 999 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 vehicle drove in direction taken by his group and}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 found the stolen vehicle 250 metres away. He was ordered to drive his}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 civilian vehicle back to base. He gave a lift to Topaco to CPS parking yard. \par \sect }\sectd \marglsxn1620\margrsxn1606\sbknone\linex0\colsx60\sectdefaultcl\sftnbj \pard\plain \s22\qj \li0\ri0\sb67\sl-480\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 \fs24\lang1033\langfe1033\cgrid\langnp1033\langfenp1033 { \cs40\fs26\cf1\insrsid15805454\charrsid15805454 \par }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Thereafter he was taken to the office of the controller of anti robbery squad}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 where he and Topaco each made a st atement about what happened before he}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 was driven to Kiira Road Police Station and subsequently back to CPS. He}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 appeared in Court on 11.4.1997. He admitted that he, Topaco and the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 deceased each had a gun and that he had shot in the air to provide cover. In}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 effect the appellant did not admit killing the deceased. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb96\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Upon the above evidence, the two assessors believed the prosecution caset}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 hat it was the appellant who shot and killed the deceased and advised}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Katutsi, J, to convict the appellant. The learned judg e also believed the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 prosecution evidence that it was the appellant who shot and killed the}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 deceased. He disbelieved the appellant whom he convicted of the murder of}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the deceased and sentenced him to death. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb86\sl-470\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 His appeal to the Court of Appeal which was based on three grounds was}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 dismissed. The appellant has now come to this court on the basis of four}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 grounds of appeal. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb86\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Mr. Jogo Tabu, Counsel for the appellant, argued grounds one and two}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 separately. He then argued grounds three and four together. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb82\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 The complaint in the first ground is that the Court of Appeal erred in law in}{\cs40\fs26\cf1\insrsid12543820 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 holding that the dying declaration of the deceased was complete. This}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 complaint had been raised as the first ground of appeal in the Court of}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Appeal where the ground failed. \par }\pard \s22\qj \li0\ri0\sb10\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid15805454\charrsid15805454 \par }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 In arguing this ground, Mr. Jogo Tabu contended that the Court of Appeal}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 erred when it held that the utterance by the deceased to PW6 (D. C. Betungura), was a complete dying declaration since the deceased must have}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 been in a confused state of mind and did not name his assailant. Counsel}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 relied on a number of decisions including }{\cs36\b\fs22\ul\cf1\insrsid12926289\charrsid15805454 C. WAUGH vs R}{\cs36\b\fs22\cf1\insrsid12926289\charrsid15805454 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 (1950) AC 203and }{\cs36\b\fs22\ul\cf1\insrsid12926289\charrsid15805454 C DAK1 S/O DAKI vs R}{ \cs36\b\fs22\cf1\insrsid12926289\charrsid15805454 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 (1959) EA 931. Mr. Elem-Ogwal, Principal}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 State Attorney, for the respondent, supported the decisions of the courts}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 below contending that the dying declaration was complete. He surmised that}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 it appeared that both the deceased and the appellant did not know each}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 other's names but argued that the dying declaration was complete. He}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 distinguished }{\cs40\fs26\ul\cf1\insrsid12926289\charrsid15805454 Waugh's}{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 case from the present one because in the former}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 case, the deceased went into a coma before he completed his declaration and }{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 that in the present case the evidence of Obwangamoi (PW2) to the effect that}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the appellant kept quiet when he was asked about what happened after the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 shooting, corroborates the dying declaration of the deceased. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb72\sl-475\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 In the proceedings before us, it is common ground that Obwangamoi (PW2),the deceased and the appellant were at or near the scene of crime at the}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 material time. The appellant admits tiring his gun albeit in the air. Neither}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Obwangamoi nor Topaco who were armed and were with the deceased fired}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 their guns. It was only the appellant who fired his gun. The appellant was}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the only fellow police officer of the deceased on duty at the time who had}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 shot his gun. There was no evidence of shooting by any other officer. On}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the facts of this case, we think that the trial judge and the Court of Appeal}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 acted properly when they treated the utterance of the deceased to D/C}{\cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 Betungura as a complete dying declaration. We agree with Elem-Ogwal that}{ \cs40\fs26\cf1\insrsid12543820 }{\cs40\fs26\ul\cf1\insrsid12926289\charrsid15805454 Waugh's}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 case is distinguishable from the case before us. \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb72\sl-480\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 In }{\cs36\b\fs22\ul\cf1\insrsid12926289\charrsid15805454 CHARLES DAKI S/O DAKI}{ \cs36\b\fs22\cf1\insrsid12926289\charrsid15805454 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 (supra) the Court of Appeal rejected the }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 dying declaration}{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 because the statements of the deceased }{\cs41\b\fs26\cf1\insrsid12926289\charrsid15805454 were }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 ambiguous, possibly}{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 colored}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 by the fact that because the deceased had earlier seen the}{\cs40\fs26\cf1\insrsid2313983 }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 appellant with a gun, the deceased must have concluded that it was the same}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 appellant who shot him. Moreover, there was evidence of an alleged }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 grudge between}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 the deceased and the appellant and that might have affected }{ \cs40\fs26\cf1\insrsid2313983\charrsid15805454 the deceased}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 in thinking that he was shot by the }{\cs46\i\fs26\cf1\insrsid12926289\charrsid15805454 "enemy" }{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 appellant. The trial judge }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 found corroboration}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 in the evidence of Corporal Obwangamoi (PW2). The }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 spent cartridges}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 and a live bullet collected by DIP }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 Bernard}{\cs42\b\i\fs26\cf1\insrsid2313983 }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 Muhumuza}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 (PW3) from the scene could have reinforced }{ \cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 the prosecution}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 case. The }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 crucial issue}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 to be determined was whether to believe the }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 appellant\rquote s or}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 Cpl. Bwongamoi's version. Appellant told court that }{ \cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 he fired}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 his gun in the air a distance from the suspected }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 stolen vehicle}{ \cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 in response to the gunshot he heard in that direction.}{\cs42\b\i\fs26\cf1\insrsid2313983 }{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 D/Cpl. Bwongamoi on the other hand stated that when }{ \cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 he heard}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 the rapid gunshots at the scene coming from his left-hand side, he turned and saw the appellant. The trial judge believed D/Cpl.}{\cs42\b\i\fs26\cf1\insrsid2313983 }{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 Bwongamoi's version. \par }\pard \s24\qj \li1402\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin1402\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s24\qj \li1402\ri0\sb82\sl-317\slmult0\widctlpar\faauto\rin0\lin1402\itap0\pararsid2313983 {\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 As was stated in }{\cs42\b\i\fs26\ul\cf1\insrsid12926289\charrsid15805454 PANDYA vs R}{ \cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 (1957) EA 336 - 338 on }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 such question}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 , which turns on manner and demeanour, the }{ \cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 Court of}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 Appeal always is and must be guided by the impression}{\cs42\b\i\fs26\cf1\insrsid2313983 }{ \cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 made on the judge who saw the witnesses. We agree with }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 that}{\cs42\b\i\fs26\cf1\insrsid2313983 }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 principle}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 and therefore cannot interfere with the trial }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 judge's}{\cs42\b\i\fs26\cf1\insrsid2313983 }{ \cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 finding}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 as there is no circumstance to justify our }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 differing}{\cs42\b\i\fs26\cf1\insrsid2313983 }{\cs42\b\i\fs26\cf1\insrsid2313983\charrsid15805454 from}{\cs42\b\i\fs26\cf1\insrsid12926289\charrsid15805454 him. In our }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 opinion,}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 the}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 pieces of evidence listed as item 1 and 4 provide corroboration to }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 the}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 dying}{ \cs40\fs26\cf1\insrsid12926289\charrsid15805454 declaration. Obwangamoi who had accompanied the appellant}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 from Katwe Police Station, rode in the same car driven by the appellant}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 could have been mistaken about the appellant before the shooting as the}{ \cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 person who fired the shots at the deceased and the people in the stolen car.}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 There is no evidence to prove that any other person than the appellant shot at}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 the deceased, fatally wounding him.}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sl-240\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\fs20\insrsid12926289\charrsid15805454 \par }\pard \s22\qj \li0\ri0\sb86\sl-480\slmult0\widctlpar\faauto\rin0\lin0\itap0\pararsid2313983 {\cs40\fs26\cf1\insrsid12926289\charrsid15805454 On the first question of doubts in the prosecution evidence }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 favoring}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 the}{\cs40\fs26\cf1\insrsid2313983 }{\cs40\fs26\cf1\insrsid2313983\charrsid15805454 appellant}{\cs40\fs26\cf1\insrsid12926289\charrsid15805454 , we are unable to see any.
