RULING

The Applicant, Alex Ole Magelo, seeks leave to apply for Judicial Review with a view to secure orders of certiorari, and prohibition in terms of the prayers in the amended Chamber Summons application dated 10. 1.2012.

I have carefully perused the application and duly considered the submissions made by Mr. Wamwayi, the learned counsel for the Applicant. The circumstances of this application show that justice shall be better served if the Respondents and the interested party participate in the application for leave seeing as I do that no prejudice will be suffered by the Applicant as a result.

Accordingly, I order that the application for leave shall be served on the Respondents and the interested party immediately and party shall appear before the Honorable Judge in the Judicial Review Division on 16. 1.2012 for further directions on the hearing.
