Ruling

1. This file was opened for purposes of considering whether the convict Abdi Anyanga Ali alias Abdi Ali is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted for the offence of possession of narcotic drugs contrary to section 3(1) as read with section 3(3) of the Narcotic and Psychotropic Substances (Control) Act, No 4 of 1994. He was sentenced to pay a fine of Ksh 50,000 and to serve 6 months imprisonment in default of the payment.

3. Having been held in custody for 2 years, his sentence is deemed to be complete.

4. For the forgoing reasons, the applicant is released forthwith unless otherwise lawfully held.Orders accordingly.
