M. }{\b\ul\insrsid3147445\charrsid464516 OKEL}{\b\ul\insrsid4934612\charrsid464516 LO }{ \b\ul\insrsid3147445\charrsid464516 \par }{\b\ul\insrsid4934612\charrsid464516 RULING:}{\b\ul\insrsid3147445\charrsid464516 \par }{\insrsid4934612\charrsid464516 When this case was called for hearing, Mr. Serwanga, Counsel for the }{\insrsid6701468\charrsid464516 defendant}{\insrsid4934612\charrsid464516 raised two preliminary objections on po}{\insrsid150006 in ts of law pointing out that:-}{\insrsid4934612\charrsid464516 \line }{\insrsid150006 \par }\pard \s15\qj \fi720\li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid150006 {\insrsid4934612\charrsid464516 (1) this suit }{\insrsid6701468\charrsid464516 is Resjudicata \par (2) the suit is time barred. \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4934612 {\insrsid4934612\charrsid464516 Arguing his poi nt, Mr. Serwanga contended that in so far as the Plaintiff was trying to bring a suit }{\insrsid6701468\charrsid464516 on a matter which was direct,}{\insrsid4934612\charrsid464516 \line substantially in issue in the High Court C}{ \insrsid6701468\charrsid464516 ivil Suit No. 811 of 1992 between the same parties and was }{\insrsid150006\charrsid464516 adjudicated}{\insrsid4934612\charrsid464516 upon, the suit was resjudi}{\insrsid14710548\charrsid464516 c ata. He cited Ponsiano Semakula vs. Susan Ma}{\insrsid4934612\charrsid464516 gala and 2 others (1979) UCB 90 for authority. He pointed out that the parties in H. C. C. S. No. 811 of 1992 are the same a}{\insrsid14710548\charrsid464516 s the parties in the instant case,}{\insrsid4934612\charrsid464516 that the matter}{\insrsid14710548\charrsid464516 s that were in issue in H. C. C. S }{\insrsid4934612\charrsid464516 No. 811 of}{\insrsid14710548\charrsid464516 1992 are substantially the same as the issues in }{\insrsid4934612\charrsid464516 the instant case. According to the learned counsel, in suit No. }{\insrsid14710548\charrsid464516 811 of 1992, the court was called\rquote upon to determine:-\line }{ \insrsid150006 \par }\pard \s15\qj \fi720\li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid150006 {\insrsid14710548\charrsid464516 (1}{\insrsid4934612\charrsid464516 ) whe}{\insrsid14710548\charrsid464516 ther the suit was time barred. \par }\pard \s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid150006 {\insrsid4934612\charrsid464516 (2) If it was time barred whether the Plaintiff was entitled to invoke the provision of section 4 }{\insrsid14710548\charrsid464516 of Ac}{\insrsid4934612\charrsid464516 t 20 of 1969. }{\insrsid14710548\charrsid464516 Was she acting under disability. \line }{\insrsid150006 \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid150006 {\insrsid14710548\charrsid464516 M}{\insrsid4934612\charrsid464516 r. Serwanga pointed out that in the instant cases court was being asked to determine the}{\insrsid14710548\charrsid464516 question of limitation in paragrap}{\insrsid150006 hs 7-}{\insrsid4934612\charrsid464516 15 of the Plaint. In counsel\rquote s view the Judge in civil suit No. 811 of 1992}{\insrsid14710548\charrsid464516 decided on both issues. He subm}{\insrsid4934612\charrsid464516 itted therefore that this case is }{\insrsid14710548\charrsid464516 Resjudicata}{ \insrsid4934612\charrsid464516 .}{\insrsid15292712\charrsid464516 \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4934612 {\insrsid15292712\charrsid464516 Mr. James M}{\insrsid4934612\charrsid464516 uk}{\insrsid15292712\charrsid464516 a}{ \insrsid4934612\charrsid464516 sa who appeared for the Plaintiff contended on }{\insrsid15292712\charrsid464516 his }{\insrsid4934612\charrsid464516 part that this suit }{\insrsid15292712\charrsid464516 is not resjudicata. He}{ \insrsid4934612\charrsid464516 conceded however, that the main issue in suit }{\insrsid15292712\charrsid464516 No. 811 of 1992 like}{\insrsid4934612\charrsid464516 in the instant suit was Negligence}{\b\insrsid4934612\charrsid464516 }{ \insrsid4934612\charrsid464516 but he submitted th}{\insrsid15292712\charrsid464516 at this issue was not adjudicate}{\insrsid4934612\charrsid464516 d upon on the merits }{\insrsid15292712\charrsid464516 in that court. According to Mukasa, Civil}{ \insrsid4934612\charrsid464516 suit No. 811 of 1992 was filed after the e}{\insrsid15292712\charrsid464516 xpiration of the limitation period on ground of exem}{\insrsid4934612\charrsid464516 ption but that the plaint did }{ \insrsid15292712\charrsid464516 not contain grounds upon which e}{\insrsid4934612\charrsid464516 xe}{\insrsid15292712\charrsid464516 mption of the operation of t}{\insrsid4934612\charrsid464516 he limitation law was claimed. For that failure t}{ \insrsid15292712\charrsid464516 he Plaint was rejected without }{\insrsid4934612\charrsid464516 the ease being board }{\insrsid15292712\charrsid464516 on the merits. In view this suit is therefore not resjudicata. \par }{\insrsid4934612\charrsid464516 It is important }{\insrsid15292712\charrsid464516 to be}{\insrsid4934612\charrsid464516 ar in mind at this stage the la}{\insrsid15292712\charrsid464516 w governing the doctrine of Resjudicata. This is to be found}{ \insrsid4934612\charrsid464516 in section}{\insrsid15292712\charrsid464516 7}{\b\i\insrsid4934612\charrsid464516 }{\insrsid15292712\charrsid464516 of the civil Procedure}{\insrsid4934612\charrsid464516 Act (Cap}{\insrsid9852550\charrsid464516 65) }{ \insrsid4934612\charrsid464516 of Laws of Ug}{\insrsid9852550\charrsid464516 anda. The }{\insrsid10709200\charrsid464516 High Court non }{ \insrsid4934612\charrsid464516 suited him \line holding that the mortgage was not time barred. Appeal from that \line decision }{\insrsid10709200\charrsid464516 was dismissed.}{\insrsid4934612\charrsid464516 Then}{\i\insrsid4934612\charrsid464516 }{ \insrsid4934612\charrsid464516 the Appellant filed a }{\insrsid10709200\charrsid464516 further suit claiming substantially the same relie}{\insrsid4934612\charrsid464516 f and}{\insrsid10709200\charrsid464516 the Respondent pleaded Resjudi}{ \insrsid4934612\charrsid464516 cata. The appellant replied that the former s}{\insrsid10709200\charrsid464516 uit concerned only lands occupied by non A}{\insrsid4934612\charrsid464516 fricans. High court dismissed the suit. On appeal it was held that the suit }{\insrsid10709200\charrsid464516 was re}{\insrsid4934612\charrsid464516 sjudicata because the defences raised }{\insrsid10709200\charrsid464516 were}{ \insrsid4934612\charrsid464516 substantially the }{\insrsid10709200\charrsid464516 same}{\insrsid4934612\charrsid464516 as in the earlier suit. \par }{\insrsid15098930\charrsid464516 It is also relevant to note that it was held in }{\b\insrsid15098930\charrsid464516 Koharehad .v. Jan Mogamod (1919-21) 8 EALR 64 }{\insrsid15098930\charrsid464516 that dismissal of a suit on a preliminary point not based on merits is no bar to a subsequent suit on the same facts and issues and between the same parties.}{\insrsid5927320\charrsid464516 In other words that a dismissal of a suit on preliminary point not based on merits does not give rise to application of the doctrine of resjudicata.}{\insrsid15098930\charrsid464516 \par }{\insrsid5927320\charrsid464516 In the case before me, the facts and issues are substantially the same with those tha t were directly in the previous suit No. 811 of 1992. they were negligence, disability and limitation. The parties in the earlier suits were the same with the parties in the instant suit. Most importantly, the earlier suit was dismissed on a preliminary p oint not based on merits. On the principle in Koharehad above, this suit is therefore not resjudicata because the earlier suit was not finally decided on the merits. \par As to whether this suit is time barred, it is important to note that the earlier suit was filed after the expiration of the limitation period prescribed by law. It was so filed on the allegation of exemption from the limitation but the grounds upon which that exemption was claimed were not pleaded in the plaint. Despite that failure however, c o unsel for the plaintiff verbally stated that the ground from the bar. The gist of the ground was the same as the summary of those now contained in paragraphs 13-15 of the plaint in the instant case. Paragraph 15 of the plaint summarized the grounds as fol lows:- \par }\pard \s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid5927320 {\i\insrsid5927320\charrsid464516 \'93}{\i\insrsid7812882\charrsid464516 Owing}{\i\insrsid5927320\charrsid464516 to the intended and calculated delays on the defendant\rquote s part purporting to propose a settlement, the plaintiff lost time within which to ably file the suit and was under disability.\'94 \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16281588 {\insrsid10709200\charrsid464516 The g}{\insrsid4934612\charrsid464516 round for the disability was therefore protracted negotiation of a settlement out of court. The learned jud}{\insrsid5993351\charrsid464516 ge in that case considered the gr}{\insrsid4934612\charrsid464516 ound and ruled that it did not amount to disability. Accordingly be found that the suit was time barred. \line }{\insrsid150006 \par I}{\insrsid5993351\charrsid464516 n my considere}{\insrsid4934612\charrsid464516 d view, the instant case is not merely a case o f}{\insrsid5993351\charrsid464516 ailure}{\insrsid4934612\charrsid464516 to plead the}{\insrsid5993351\charrsid464516 grounds}{\i\insrsid4934612\charrsid464516 }{\insrsid5993351\charrsid464516 upon whi}{\insrsid4934612\charrsid464516 ch exemption from limitation wa}{\insrsid5993351\charrsid464516 s claimed as Mr. Muka}{\insrsid4934612\charrsid464516 s}{ \insrsid5993351\charrsid464516 a would like this court to belie}{\insrsid4934612\charrsid464516 ve. It is e}{\insrsid5993351\charrsid464516 ase of whether the Plaintiff has}{\insrsid4934612\charrsid464516 ad}{\insrsid5993351\charrsid464516 vanced sufficient grounds to establish disability}{\insrsid4934612\charrsid464516 to constitute exemption from limitation. The learned ju}{\insrsid5993351\charrsid464516 dge}{\insrsid4934612\charrsid464516 found that pr}{\insrsid5993351\charrsid464516 otracted negotiation of a settlement out of court did not }{\insrsid4934612\charrsid464516 amount to disability}{\insrsid5993351\charrsid464516 . It could not prevent the plaintiff from filing and }{\insrsid4934612\charrsid464516 claim while such negotiation protracte}{\insrsid5993351\charrsid464516 d. I share that view. Now that same g}{\insrsid4934612\charrsid464516 round is co}{\insrsid5993351\charrsid464516 ntaine}{\insrsid4934612\charrsid464516 d in paragraphs 13 }{ \insrsid5993351\charrsid464516 - }{\insrsid4934612\charrsid464516 15 of the instant plaint and court is}{\b\insrsid4934612\charrsid464516 }{\insrsid4934612\charrsid464516 being asked to a}{\insrsid5993351\charrsid464516 djudicate upon. No other ground}{ \insrsid4934612\charrsid464516 is included. Follo}{\insrsid5993351\charrsid464516 wing the reasoning in H. C. C. S N}{\insrsid4934612\charrsid464516 o. 811 of 1992,}{\b\i\insrsid4934612\charrsid464516 }{\insrsid4934612\charrsid464516 I }{\insrsid150006 am inclined to agree with Mr.}{\insrsid5993351\charrsid464516 Serwanga that this s}{\insrsid4934612\charrsid464516 uit is time barred because protracted negotiation of a settlement }{\insrsid5993351\charrsid464516 out of court does not constitute}{ \insrsid4934612\charrsid464516 a disability to justify exemption from limita}{\insrsid5993351\charrsid464516 tion. For that reason the objec}{\insrsid4934612\charrsid464516 tion is}{\b\insrsid4934612\charrsid464516 }{\insrsid4934612\charrsid464516 upheld and the plaint is rejected as being time barred.
