Ruling

1. The Applicant was convicted on his own plea of guilty for the offence of compounding felonies contrary to section 118 as read with section 36 of the Penal Code. The trial court sentenced him to serve 1 – year imprisonment or pay a fine of Kshs 100,000/=. The Report by Jackline C Mwei the Probation Officer dated June 13, 2023 and filed on June 14, 2023 recommends a non-custodial sentence. I hereby direct that the Applicant serves a Community Service Order at Kijauri Level 4 Hospital under the supervision of the area chief for a period of 6 months.

Orders accordingly.
