Full Case Text

IN THE HIGH COURT OF KENYA AT MERU

HCC 81 OF 2008 (OS)

ANNAH WANJA NDERI................................................................................PLAINTIFF

VERSUS

STEPHEN RUCHA CHABARI...................................................................DEFENDANT

R U L I N G

The plaintiff was to show cause why the suit should not be dismissed.  Miss Kiome has explained the circumstances leading to the delay in the hearing of the suit including the plaintiffs long illness.  It has also been claimed that the defendant is her husband and that the suit is meant to benefit their children.

The plaintiff has undertaken to diligently prosecute this case.

In the circumstances, I find that the plaintiff has shown sufficient cause why the suit should not be dismissed.  Therefore, the suit is not dismissed.  It is so ordered.

Delivered in Open Court at Meru this 25th day of July, 2014 in the presence of:

Cc. Lilian/Daniel

Miss Kiome for the plaintiff
