1. This file was opened for purposes of considering whether the convict Vincent Walezi Argiza is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted for the offence of driving a public service motor vehicle while under influence of alcohol contrary to section 45(1) of the Traffic Act. He was sentenced to pay fine of ksh.10,000/- in default to serve 6 months in prison.

3. From the record, the applicant was convicted on 6th May 2024. In my view, the sentence served is sufficient. The applicant is released forthwith unless otherwise lawfully held.
