Briefly, t}{\insrsid4148038 hat background}{\insrsid9770293 was}{\insrsid11951434 as follows: \par }{\insrsid7894694 \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16018716 {\insrsid666982 The State}{\insrsid8336479 alleged that o}{\insrsid7894694 n 20}{\super\insrsid7894694\charrsid7894694 th}{\insrsid7894694 June 2006}{ \insrsid5339504 at around 11.00 a.m}{\insrsid7894694 the applicant }{\insrsid5339504 carelessly drove}{\insrsid7894694 motor vehicle registration No. UAB 484}{\insrsid7894694\charrsid7894694 }{\insrsid7894694 along Gaba road}{\insrsid6491414 . As a result, t}{\insrsid5339504 he police arrest}{\insrsid12740827 ed the applicant}{\insrsid10308035 ; and}{\insrsid6491414 took him to a}{\insrsid5339504 police station}{\insrsid1069304 . Thereafter, the police}{\insrsid5339504 released him on}{ \insrsid1069304 a}{\insrsid8471299 bond. On 28}{\super\insrsid5339504\charrsid5339504 th}{\insrsid5339504 J}{\insrsid12740827 une 2006 the applicant reported}{\insrsid13837400 at the}{\insrsid1069304 police station. This time the police took him to a Magistrate\rquote s c}{\insrsid5339504 ou}{\insrsid7817912 rt at Makindye}{\insrsid13837400 ; and}{\insrsid1069304 charged him}{\insrsid5339504 with the offence of careless driving contrary to sections 119 and 46(1}{\insrsid7817912 ) (}{\insrsid5339504 c) of the Traffic and Road Safety Act (Cap}{\insrsid1069304 . 361)}{\insrsid10308035 . The applicant denied that}{\insrsid1069304 offence.}{ \insrsid7817912 }{\insrsid1603918 Later on, a Magistrate }{\insrsid2307875 released him}{\insrsid4138885 on bail; and }{\insrsid1069304 fixed}{\insrsid2307875 his}{\insrsid11551950 case}{\insrsid4136649 for}{\insrsid15206299 hear}{\insrsid11551950 ing}{\insrsid4136649\charrsid4136649 }{\insrsid11551950 on 11}{\super\insrsid4136649\charrsid3150445 th}{\insrsid11551950 July 2006. On 11}{\super\insrsid11551950\charrsid11551950 th}{\insrsid11551950 July 2006, at the request of }{\insrsid14317476 his counsel}{\insrsid1603918 (Mr. Sebuliba) the said Magistrate}{\insrsid11551950 adjourned the}{\insrsid14317476 applicant\rquote s}{\insrsid11551950 case to 1}{\super\insrsid11551950\charrsid11551950 st}{\insrsid11551950 }{\insrsid14317476 August 2006}{\insrsid11551950 . When that day came}{\insrsid1603918 ,}{\insrsid1069304 }{\insrsid856334 Mr. Sebuliba raised}{\insrsid4138885 a preli}{\insrsid4136649 minary objection}{\insrsid1525420 . Among other things, he submitted}{\insrsid4136649 that}{\insrsid1520686 failure}{\insrsid14317476 on the part of the police}{\insrsid1520686 to comply with}{\insrsid856334 the procedural requirements of the law }{\insrsid1520686 in}{\insrsid856334 section 159 of}{\insrsid4136649 the}{ \insrsid856334\charrsid856334 }{\insrsid856334 Traffic and Road Safety Act (Cap. 361)}{\insrsid1520686 before taking}{\insrsid856334 the}{\insrsid4136649 applicant}{\insrsid1520686 to court rendered the applicant\rquote s prosecution}{ \insrsid10502183 in Makindye TOR 171/06}{\insrsid4743943 a}{\insrsid1520686 futile}{\insrsid4743943 exercise}{\insrsid1520686 .}{\insrsid16078700 Therefore, Mr. Sebuliba pr}{\insrsid8459648 ayed the }{\insrsid1525420 Magistrate}{\insrsid8459648 to}{ \insrsid856334 dismiss the charge against the applicant.}{\insrsid4136649 Mr}{\insrsid6817412 . Ejoku (the DPP}{\insrsid1520686 \rquote s}{\insrsid4136649 representative) did not ag}{\insrsid1520686 ree with Mr. Sebuliba\rquote s submission. In Mr. Ejoku\rquote s opinion}{\insrsid4136649 the}{\insrsid11359805 police}{\insrsid4136649 properly}{\insrsid1520686 brought}{\insrsid10105145 the applicant}{\insrsid1520686 to}{\insrsid6817412 the Magistrate\rquote s}{ \insrsid4136649 court}{\insrsid6817412 ;}{\insrsid4136649 and}{\insrsid10105145 }{\insrsid4136649 his }{\insrsid16018716 prosecution was not}{\insrsid11998717 a}{\insrsid16018716 futile}{\insrsid11998717 exercise}{\insrsid16018716 . After considering the}{\insrsid1520686 above submissions}{\insrsid16018716 the learned trial Magistrate ag}{\insrsid1520686 reed with Mr. Ejoku}{\insrsid14644389 . She }{\insrsid16018716 over-ruled Mr. Sebuliba in respe}{\insrsid14644389 ct of the preliminary objection; and ordered that the trial}{\insrsid16538679 of the applicant}{\insrsid14644389 should proceed.}{\insrsid16018716 That d}{\insrsid14644389 ecision aggrieved the applicant. Therefore,}{\insrsid16018716 through his advocates}{\insrsid16018716\charrsid16651460 }{\insrsid16018716 (Messrs Shonubi, Musoke & Company Advocates & Soli}{\insrsid6817412 citors) the applicant made an application to}{\insrsid16018716 this Honourab}{\insrsid3935151 le Court with a view to}{\insrsid1209703 o}{\insrsid14633892 btaining an Order in revision}{\insrsid1209703 nullify}{\insrsid14633892 ing}{\insrsid16018716 the}{\insrsid1209703 learned}{\insrsid16018716 Magistrate\rquote s }{\insrsid14633892 decision }{\insrsid6817412 .}{\insrsid11360297 \par }{\insrsid14633892 \par }{\insrsid11360297 At the time of hearing the}{\insrsid200827 application}{\insrsid11360297 Mr. Sebuliba represented the applicant; and Mr. Byansi represented the Director of P}{\insrsid4549257 u}{\insrsid2061331 blic Prosecutions. However}{ \insrsid200827 I will not reproduce learned counsel}{\insrsid7300108 \rquote s}{\insrsid4549257 submissions}{\insrsid8219190 here}{\insrsid2061331 , for those submissions}{\insrsid4549257 are}{\insrsid11360297 }{\insrsid14906334 substanti}{ \insrsid8328182 ally the same as the ones}{\insrsid1841764 the}{\insrsid11360297 parties}{\insrsid14906334 herein}{\insrsid7300108 made}{\insrsid6817412 before the learned Magistrate}{\insrsid4549257 on 1}{\super\insrsid4549257\charrsid4549257 st}{ \insrsid4549257 August 2006}{\insrsid11360297 .}{\insrsid6817412 }{\insrsid1841764 Nevertheless,}{\insrsid4549257 whoever might wish to}{\insrsid14906334 read }{\insrsid1841764 those}{\insrsid4549257 submissions}{\insrsid14906334 will readily find them on }{\insrsid1841764 the record of this Honourable Court.}{\insrsid11360297 \par }{\insrsid4549257 \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid3560994 {\insrsid398757 A}{\insrsid1841764 t this junctur}{\insrsid6830644 e, Court}{\insrsid13649074 wish}{\insrsid6830644 es point out a few things.}{ \insrsid6762845 Firstly, }{\insrsid8396258 o}{\insrsid4674695 n a quick reading of the}{\insrsid2061331\charrsid2061331 }{\insrsid4674695 Traffic and Road }{\insrsid13371375 Safety Act (Cap. 361) it is}{\insrsid4674695 clear that }{\insrsid2061331 the offence the applicant allegedly committed falls under Part V1 of}{\insrsid2061331\charrsid15028710 }{\insrsid2061331 the {\*\bkmkstart OLE_LINK1}{\*\bkmkstart OLE_LINK2}Traffic and Road Safety Act (Cap. 361){\*\bkmkend OLE_LINK1}{\*\bkmkend OLE_LINK2 }.}{\insrsid13371375 For that reason the provisions}{\insrsid4995549 of section 159 of the above law}{\insrsid16521650 }{\insrsid9896785 were}{\insrsid13371375 a}{\insrsid858561 relevant factor in that}{\insrsid16521650 matter}{\insrsid858561 .}{ \insrsid13649074 \par \par }{\insrsid6830644 Secondly}{\insrsid4542200 ,}{\insrsid6830644 it is}{\insrsid8331713 also}{\insrsid6830644 clear that}{\insrsid13649074 the record of the Magistrate\rquote s court}{\insrsid12520131 in}{\insrsid12520131\charrsid12520131 }{ \insrsid12520131 respect of Makindye TOR 171/06 }{\insrsid6830644 does not}{\insrsid13649074 bear any evidence contradicting the applicant\rquote s complaint to the effect that the police did not comply with any of the requirements in section 159}{ \insrsid12520131 (1) of the above law.}{\insrsid4542200 }{\insrsid9245083 Therefore}{\insrsid1708201 , in resolving the}{\insrsid15227381 matter}{\insrsid1708201 that is before this Honourable}{\insrsid15092763 C}{\insrsid1708201 ourt}{ \insrsid15092763 the all important}{\insrsid6043625 }{\insrsid12600833 question to answer is this: Did}{\insrsid15092763 non-compliance with the procedural requirements in section 159 of the}{\insrsid15092763\charrsid15092763 }{\insrsid15092763 Traffic and Road Safety Act (Cap. 361) render }{\insrsid8530869 the prosecution of the applicant}{\insrsid15092763 in r}{\insrsid6043625 espect of the offence in section 119 of the above Act}{\insrsid15092763 a futile exercise?}{\insrsid2260255 \par \par }{\insrsid5316128 In Court\rquote s opinion}{\insrsid7099051 ,}{\insrsid2260255 the answer to the above question}{\insrsid7099051 is to be found}{\insrsid1189525 in}{\insrsid7099051 various sections}{\insrsid2260255 of the}{ \insrsid2260255\charrsid2260255 }{\insrsid2260255 Traffic and Road Safety Act (Cap. 361)}{\insrsid8530869 and the Magistrates Courts Act (Cap. 16)}{\insrsid1189525 ; and its substance lies in whet}{\insrsid7099051 her or not compliance with the}{ \insrsid1189525 procedural requirements}{\insrsid7099051 in question}{\insrsid1189525 is mandatory.}{\insrsid2260255 }{\insrsid6632129 \par \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16018716 {\insrsid15616077 The relevant parts}{\insrsid6632129 of}{\insrsid2260255 section 159 of the}{\insrsid16274161\charrsid16274161 }{\insrsid16274161 Traffic and Road Safety Act (Cap. 361)}{\insrsid5062056 read}{\insrsid15092763 }{\insrsid12286652 as follows}{\insrsid16521650 :}{\insrsid2061331 }{\insrsid934722 \par \par }{\i\insrsid934722\charrsid934722 \'93Institution of proceedings\'94}{\i\insrsid934722 \par \par }{\b\insrsid934722\charrsid934722 159.}{\b\insrsid934722 Warning to be given before prosecution.}{\b\insrsid934722\charrsid934722 \par }{\insrsid934722 \par }{\i\insrsid934722\charrsid934722 (1) Where a person is prosecuted for an offence under Part V1 of this Act (excluding the regulations)}{\i\insrsid934722 , he or she shall not be convicted unless - \par }{\i\insrsid12063626 \par }{\i\insrsid934722 (a) he or she was warned in writing at the time the offence was committed that the \par question of prosecuting him or her for an offence under }{\i\insrsid934722\charrsid934722 Part V1 of this Act}{\i\insrsid934722 would \par be considered; \par }{\i\insrsid12063626 \par }{\i\insrsid2379569 }{\i\insrsid12063626 (b) within twenty-eight days after the commission of the offence, a summons for the \par }{\i\insrsid2379569 }{\i\insrsid12063626 offence was served on him or her; or \par \par }{\i\insrsid2379569 }{\i\insrsid12063626 (c) within twenty-eight days after a notice of the intended prosecution specifying the \par }{\i\insrsid2379569 }{\i\insrsid12063626 nature of the alleged offence and the time and place where it is alleged to have been \par }{\i\insrsid2379569 }{\i\insrsid12063626 committed was served on him or her or sent by registered post to him or her or the \par }{\i\insrsid2379569 }{\i\insrsid12063626 person}{\i\insrsid4019062 registered as the owner of the motor vehicle, \'85 at the time of the commission}{\i\insrsid12063626 \par }{\i\insrsid2379569 }{\i\insrsid4019062 of the offence. \par \par (2) Notwithstanding anything in subsection (1) \endash \par \par (a) failure to comply with a requirement of subsection (1) shall not be a bar to the \par }{\i\insrsid15220766 c}{\i\insrsid4019062 onviction of the accused in any case where the court is satisfied that }{\i\insrsid15220766 \endash }{\i\insrsid4019062 \par }{\i\insrsid15220766 \par (i) neither the name and address of the accused nor the name and address of the \par registered owner of the motor vehicle, \'85could, with reasonable diligence, have \par been ascertained in time for a summons to be served or for a notice to be served \par or sent under that subsection; or \par \par (ii) the accused by his or her own conduct contributed to the failure; and \par \par (b) the requirements of this section shall, in every case, be presumed to have been \par complied with until the contrary is proved.\'94 \par }{\i\insrsid12221152 \par }{\insrsid12221152\charrsid12221152 Despite}{\insrsid12221152 creating exceptions and}{\insrsid5661973 ,}{\insrsid8009923 in a}{\insrsid16256549 way}{\insrsid5661973 ,}{\insrsid12221152 shifting the burden on the accused in subsection (2) the general tone of section 159 of the}{\insrsid12221152\charrsid15092763 }{\insrsid12221152 Traffic and Roa}{\insrsid14384498 d Safety Act (Cap. 361) gives the impression}{\insrsid12221152 that the procedural}{\insrsid3292374 requi}{\insrsid5661973 rements laid out}{\insrsid3105688 in that}{\insrsid14384498 law could be}{\insrsid3292374 mandatory.}{\insrsid16256549 This is par}{\insrsid14384498 ticularly so when it comes to light that }{\insrsid16256549 subsection (1)}{\insrsid6628535 of the above section}{\insrsid14384498 uses}{\insrsid14384498\charrsid14384498 }{\insrsid14384498 the word }{\b\i\insrsid14384498\charrsid16256549 \'93shall\'94}{\b\i\insrsid6628535 , }{ \insrsid6628535 which}{\insrsid8586785 ordinarily has a mandatory import.}{\insrsid14384498 \par \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid459568 {\insrsid6628535 However, the foregoing}{\insrsid1246853 is not all there is}{\insrsid14384498 to consider }{\insrsid2379569 before making a final decision i }{\insrsid14384498 n}{\insrsid2379569 this matter.}{\insrsid14384498 }{\insrsid6904894 S}{\insrsid7630704 ection 161 }{\insrsid2379569 of the}{\insrsid2379569\charrsid2379569 }{\insrsid2379569 Traffic and Road Safety Act (Cap. 361) is}{\insrsid6904894 also}{\insrsid328970 important}{\insrsid2379569 to keep in mind}{\insrsid7630704 .}{\insrsid459568 It provides as follows: \par \par }{\b\i\insrsid459568\charrsid10056969 \'93161. Institution of traffic proceedings. \par \par }{\i\insrsid459568\charrsid10056969 (1) Traffic proceedings may be instituted - \par \par {\listtext\pard\plain\i\lang1033\langfe1033\langnp1033\langfenp1033\insrsid459568\charrsid10056969 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \qj \fi-360\li660\ri0\widctlpar \jclisttab\tx660\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin660\itap0\pararsid8331713 {\i\insrsid459568\charrsid10056969 in the ma}{\i\insrsid7818659 nner provided by the Magistrate}{\i\insrsid459568\charrsid10056969 s }{ \i\insrsid7818659\charrsid10056969 Court}{\i\insrsid7818659 s }{\i\insrsid7818659\charrsid10056969 Act}{\i\insrsid8331713 ; or}{\i\insrsid459568 \par }\pard \qj \li300\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin300\itap0\pararsid8331713 {\i\insrsid8331713 \par {\listtext\pard\plain\i\lang1033\langfe1033\langnp1033\langfenp1033\insrsid8331713 \hich\af0\dbch\af0\loch\f0 (b)\tab}}\pard \qj \fi-360\li660\ri0\widctlpar\jclisttab\tx660\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin660\itap0\pararsid8331713 { \i\insrsid8331713 \'85\'94 \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid459568 {\i\insrsid459568 \par }{\insrsid550582 Following the above}{\insrsid7220602 to its logical conclusion s}{\insrsid7818659 ection 42(1) of the Magistrates Courts Act}{\insrsid986624 (Cap. }{\insrsid550582 16}{\insrsid986624 )}{\insrsid6904894 provides that}{\insrsid7818659 criminal proceedings }{\insrsid4207968 may be instituted where a police officer brings}{\insrsid7818659\charrsid4207968 a person}{\insrsid4207968 he or she has}{\insrsid7818659\charrsid4207968 }{\insrsid3823301\charrsid4207968 arrested, with}{ \insrsid7818659\charrsid4207968 or without a warrant}{\insrsid6904894 ,}{\insrsid7818659\charrsid4207968 before }{\insrsid4207968 a Magistrate upon a charge.}{\insrsid2379569 \par \par Indeed,}{\insrsid7220602 t}{\insrsid1182415 he charge refe}{\insrsid7220602 rred to above }{\insrsid2501669 means}{\insrsid4207968 any charge (traffic or otherwise).}{\insrsid7220602 }{\insrsid3823301 Consequently}{\insrsid13045661 ,}{\insrsid9572636 where the above}{\insrsid1182415 }{\insrsid7220602 happens the Magistrate before whom such person is brought}{\insrsid4207968 has power to hear}{\insrsid12474873 and determine}{\insrsid4207968 the case }{\insrsid14811440 in question}{ \insrsid12474873 ; and}{\insrsid9572636 no}{\insrsid7806461 one would, lawfully, be able to raise a query against}{\insrsid9572636 the procedure used in bringing such person to}{\insrsid4082722 the Mag}{\insrsid7806461 istrate for trial. }{ \insrsid459568 \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11369247 {\insrsid1182415 \par }\pard \qj \li0\ri0\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid6492709 {\insrsid6828532 All in all, the}{\insrsid13180145 above}{\insrsid6622266 boils down to this:}{\insrsid1182415 The procedural requirement}{ \insrsid13516451 s}{\insrsid1182415 in s}{\insrsid6622266 ection 159 of the Traffic }{\insrsid1182415 and Road Safety Act (Cap. 361) are}{\insrsid12474873 not mandatory.}{\insrsid10437785 Their purpose is simply to}{\insrsid16153481 high-light}{ \insrsid16398440 the}{\insrsid16153481 ideal}{\insrsid818901 standard}{\insrsid16398440 .}{\insrsid5458112 In turn, that means}{\insrsid7236426 there is}{\insrsid3285776 no}{\insrsid7236426 conflict between}{\insrsid15933899 section 159 of the }{ \insrsid4471949 Traffic and Road Safety Act (Cap. 361) }{\insrsid5527272 (as a specific law) and section 42 (1) of}{\insrsid6710914 the Mag}{\insrsid5601386 istrates Courts Act (Cap. 16)}{\insrsid5527272 ) (as a general law)}{\insrsid5458112 that would} {\insrsid9851010 justify}{\insrsid5458112 the need to invoke}{\insrsid6710914 the rule of statutory interpretation Mr. Sebuliba}{\insrsid5458112 referred to in his submissions in the lower court and in this Court.}{\insrsid4471949 After all, the application of section 42 (1) of the Magistrates}{\insrsid3169220 Courts Act (Cap. 16) enters}{\insrsid4471949 the above scenario}{\insrsid15872028 , not on its own initiative, but}{\insrsid4471949 at the behest of section 161 of the Traffic and Road Safety Act (Cap. 361). }{\insrsid7236426 }{\insrsid5527272 \par }{\insrsid5458112 \par }{\insrsid11080129 From the foregoing it follows}{\insrsid7616352 that non}{\insrsid11080129 -compliance with the}{\insrsid7616352 requirements}{\insrsid11080129 of section 159 of the}{\insrsid11080129\charrsid11080129 }{\insrsid11080129 Traffic and Road Safety Act (Cap. 361)}{\insrsid7616352 did not render the prosecution of the applicant in respect of the offence in question a futile exercise.}{\insrsid3099154 In any case, the applicant did not even allege that the said default on the part of the police would later on prejudice him in his defence!}{\insrsid11080129 \par \par }{\insrsid4535316 In conclusion Court has no choice, but to dismiss the application herein}{\insrsid6492709 ;
