Shortly put the objection was that the application was time barred in view of the provisions of section 39 (1) of the Judicature Statute as amended, Rule 5 (1) of the Civil procedure (Amendment)}{\fs24\insrsid9324666\charrsid16130040 (Judicial Review) Rules and Statutory Instrument 75 of 2003. The period for applying for }{\fs24\insrsid997913\charrsid16130040 judicial}{\fs24\insrsid9324666\charrsid16130040 review therein given is three months and learned counsel contended that the application was brought outside this period.}{\fs24\insrsid10493591\charrsid16130040 \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16130040 {\fs24\insrsid9324666\charrsid16130040 \par }\pard \qj \fi90\li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16130040 {\fs24\insrsid9324666\charrsid16130040 Mr. Rwaganika learned Counsel for the Applicant was not caused. In our argument which was a}{ \fs24\insrsid997913\charrsid16130040 }{\fs24\insrsid9324666\charrsid16130040 bit difficult to comprehend}{\fs24\insrsid997913\charrsid16130040 ; he}{\fs24\insrsid9324666\charrsid16130040 contended, it appears to me, that time did not begin to ran until the Permanent Secretary, Public Service wrote to the Secretary Education Servic e Commission indicating that the Ministry of Education and Sports was treating the Applicant unfairly and directed that Applicant be redeployed. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16130040 {\fs24\insrsid9324666\charrsid16130040 \par I now proceed to examine the merits of the objection raised. \par Rule 5 (1) of the Civil Procedure (Amendment) (Judicial Review) Rules, 2003 provides as here under following: \par \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid9324666\charrsid16130040 \'935(1) An application for judicial review shall be made promptly and in }{ \fs24\insrsid8924525\charrsid16130040 \par }{\fs24\insrsid9324666\charrsid16130040 any event within three months from the }{\fs24\insrsid8924525\charrsid16130040 date when the grounds of the \par application first arose unless the Court considers that there is good \par reason for extending the period within which the application shall \par be made.\'94}{\fs24\insrsid9324666\charrsid16130040 \par }{\fs24\insrsid8924525\charrsid16130040 \par }\pard \qj \fi-540\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid8924525\charrsid16130040 Rule 5 (2) of the said Rules provides as follows: \par \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid285067\charrsid16130040 \'93(}{\fs24\insrsid8924525\charrsid16130040 2) Where the relief sought is an order of certiorari in respect of any \par }{\fs24\insrsid285067\charrsid16130040 Judgment}{\fs24\insrsid8924525\charrsid16130040 , order, }{\fs24\insrsid538656\charrsid16130040 conviction}{\fs24\insrsid8924525\charrsid16130040 or other proceedings, the date when the \par grounds for the application first arose shall be taken to be the \par date of that judgment, order, conviction or proceedings if that \par decision is delivered in an open court, but where the judgment, \par order, conviction or proceedings is ordered to be sent to the \par parties, or their advocates, (if any), the date when the decision \par was delivered to the parties, their advocates or prison officers, \par or sent by post.\'94 \par \par }\pard \qj \fi-450\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid8924525\charrsid16130040 The application before me does not set out the grounds for the application. \par }{\fs24\insrsid7685148\charrsid16130040 It simply states that: \par \tab \'93THIS APPLICATION is made under the provisions of the Law aforesaid \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid7685148\charrsid16130040 and based upon reasons and grounds set out in the affidavit of BAMANYA \par GERSHOM, the applicant filed herewith and any other affidavit(s) that \par may be filed hereafter and upon the reasons and grounds set in herein below \par and as shall be read and relied upon at the time of hearing the application.\'94 \par }\pard \qj \fi-540\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid7685148\charrsid16130040 \tab The nearest one can get to a Semblance of a ground on which the application}{ \fs24\insrsid8924525\charrsid16130040 \par }{\fs24\insrsid7685148\charrsid16130040 \tab Is probably grounded is where it is a}{\fs24\insrsid6184610\charrsid16130040 covered}{\fs24\insrsid7685148\charrsid16130040 : \par }\pard \qj \fi540\li180\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin180\itap0\pararsid16130040 {\fs24\insrsid157270\charrsid16130040 \'93}{\fs24\insrsid7685148\charrsid16130040 6. }{\fs24\insrsid4269083\charrsid16130040 \tab }{ \fs24\insrsid7685148\charrsid16130040 That the Permanent Secretary, Ministry of Education and Sports, Mr. F. X. \par }\pard \qj \fi-540\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16130040 {\fs24\insrsid7685148\charrsid16130040 \tab Lubanga, took a decision to set the applicant dismissed from Public Service contrary to the principles of natural justice. \par \par }{\fs24\insrsid4269083\charrsid16130040 }{\fs24\insrsid157270\charrsid16130040 \tab \'93}{\fs24\insrsid7685148\charrsid16130040 7}{\fs24\insrsid4269083\charrsid16130040 . \tab The interdic}{\fs24\insrsid7685148\charrsid16130040 tion}{ \fs24\insrsid4269083\charrsid16130040 letter contains materials which are greatly injurious to the }{\fs24\insrsid7685148\charrsid16130040 \par }{\fs24\insrsid4269083\charrsid16130040 \tab credit, character and reputation of the applicant and the Applicant has thereby been greatly injured in his reputation, office and occupation and has been brought unto public scandal, hatred, redicule and cont empt. \par }{\fs24\insrsid6491295\charrsid16130040 \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid6491295\charrsid16130040 \hich\af0\dbch\af0\loch\f0 8.\tab}}\pard \qj \fi-360\li900\ri0\sl360\slmult1\widctlpar \jclisttab\tx900\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin900\itap0\pararsid16130040 {\fs24\insrsid6491295\charrsid16130040 The Permanent Secretary, Ministry of Education and Sports took a decision to remove the applicant from office without just cause. \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid6491295\charrsid16130040 \hich\af0\dbch\af0\loch\f0 9.\tab}The Permanent Secretary, Ministry of Education and Sports acted unlawfully when he denied the applicant deployment and purported to retire him in Public interest. \par {\listtext\pard\plain\lang1033\langfe1033\langnp1033\langfenp1033\insrsid6491295\charrsid16130040 \hich\af0\dbch\af0\loch\f0 10.\tab}That it was irregular to retire the Applicant in public interest without giving him a hearing.\'94 \par }\pard \qj \li180\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin180\itap0\pararsid16130040 {\fs24\insrsid157270\charrsid16130040 \par From the above, I think with respect that it can safely be assumed that the act complained of is the interdiction of the Applicant and his eventual retirement in Public Interest. If I am right in so assuming, it can be seen that the dates on which those acts complained of one not given. \par \par It is because of this c}{\fs24\insrsid13334306\charrsid16130040 omma that learned Counsel for the Attorney General referred this Court to the annextures attached to the application, and to those I must now turn.}{\fs24\insrsid157270\charrsid16130040

\par }{\fs24\insrsid13334306\charrsid16130040 \par But perhaps before that I should first deal with the contention of the learned Counsel for Applicant that time must be taken to ran time the 16}{\fs24\super\insrsid13334306\charrsid16130040 th}{\fs24\insrsid13334306\charrsid16130040 of August 2004 whe n the Permanent Secretary, Public Service wrote to the Secretary Education Service Commission indication that the Ministry of Education and Sports was treating the Applicant unfairly and directing the redeployment of the Applicant. With the greatest resp ect this argument is colourless. As properly pointed out by Ms. Kiryabwire for the Attorney General, this was }{\fs24\insrsid8945365\charrsid16130040 I}{\fs24\insrsid13334306\charrsid16130040 nter-}{\fs24\insrsid8945365\charrsid16130040 Ministerial}{ \fs24\insrsid13334306\charrsid16130040 Communication to which Applicant was not entitled access. Indeed this Communication was not copied to him. He must ha}{\fs24\insrsid8945365\charrsid16130040 ve access ed it by furtive means. How then could it regulate his affairs? This argument is completely unavailing. \par \par From Annexture \'93A\'94 to the application it is crystal clear that Applicant was interdicted from duty with effect from the 31}{\fs24\super\insrsid8945365\charrsid16130040 st}{\fs24\insrsid8945365\charrsid16130040 October 2002.}{ \fs24\insrsid13334306\charrsid16130040 \par }{\fs24\insrsid9207369\charrsid16130040 \par Annexture \'93g\'94 to the application leaves no room for doubt that Applicant was retired from the Public Service of the Republic of Uganda in the public interest on 25}{\fs24\super\insrsid9207369\charrsid16130040 th}{ \fs24\insrsid9207369\charrsid16130040 June 2003 when the letter retiring the Applicant was received by him as stated in paragraph 16 of his affidavit in support of the application. In my humble ruling the period for judicial review purposes started to run from this day }{\fs24\insrsid6184610\charrsid16130040 i.e.}{\fs24\insrsid9207369\charrsid16130040 25/06/2003. Any other ruling to the contrary appears to me to be out of t}{\fs24\insrsid6184610\charrsid16130040 im}{\fs24\insrsid9207369\charrsid16130040 e with the reality of this case. \par \par The application for review was not filed until the 16}{\fs24\super\insrsid9207369\charrsid16130040 th}{\fs24\insrsid9207369\charrsid16130040 of November, 2004, No reasons have been put forward for this obvious litigious somnolence. \par }{\fs24\insrsid16267353\charrsid16130040 \par It appears to me with respect that the objection ought to be sustained.
