Ruling

1. The Applicant was charged with the offence of Stealing contrary to Section 278 of the Penal Code Cap 63 (Laws of Kenya). He was arraigned in court on 19/10/2021 when he pleaded guilty to the charge and was sentenced to three (3) years imprisonment on October 26, 2021. According to Prisons, his earliest date of release is October 15, 2023. The Report by Esiromo G Oduya Probation Officer dated 27/2/2022 does not recommend his release on Community Service Order on account of the short period of the sentence served, I hereby decline the application for review and direct that he continues serving his sentence in custody until such time an application is made at another time for consideration. Orders accordingly.
