The applicant is the Barclays Bank of Uganda, Limited, while }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid5246930 the }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 respondent is the National Union of Clerical, Commercial, professional and Technical Employees. The applicant was and still is a member }{\lang1033\langfe2057\langnp1033\insrsid5246930\charrsid5246930 of}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid5246930 t}{\lang1033\langfe2057\langnp1033\insrsid5246930 he ass}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ociation of Uganda Bankers and was party to the collective Bargaining Agreement, together with other }{\lang1033\langfe2057\langnp1033\insrsid5246930 member banks which was concluded}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 with the respondent under }{\lang1033\langfe2057\langnp1033\insrsid5246930 the Trade Dispute (Arbitration }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Settlements) Act, Cap. 200 of the Laws of Uganda, as amended by Decree 18 of 1974 called \'93The Trades Disputes (Arbitration & Settlements) (Amendment) Decree, 1974. \par \line The brief back ground to this application will assist in understanding the issues involved. On 22/6/94, a }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 recognition agreement }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 was entered into between the applicant (collectively with the other members of the Association of Ugan da Bankers) and the respondent (on behalf of the Association Unionised Employees). Thereafter a collective agreement was signed governing the general terms and conditions of service of the said unionised employees. An appendix to the Agreement known as Ap pendix \lquote B\rquote which governs the salaries and other benefits of the employees seems to be the source of this applications}{\lang1033\langfe2057\langnp1033\insrsid2499797 .}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 A dispute arose between the signatories to the correct interpretation of Annexture \lquote B\rquote , as regards the application of the terms and conditions of service for the period 1st January to}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid2499797 }{\lang1033\langfe2057\langnp1033\insrsid2499797\charrsid2499797 31}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2499797 December, 1993}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 . This matter was in due course referred to the Minister of Labour. The Minister, in turn, referred the matter to the Industrial Court for its interpretation }{ \lang1033\langfe2057\langnp1033\insrsid2499797 o}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 f the award it had made on }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid2499797 18/4/95}{ \i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 and which had switched the effect of the award retro}{\lang1033\langfe2057\langnp1033\insrsid2499797 s}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 pe}{\lang1033\langfe2057\langnp1033\insrsid2499797 c}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 t}{\lang1033\langfe2057\langnp1033\insrsid2499797 i}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 v}{\lang1033\langfe2057\langnp1033\insrsid2499797 e}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ly to the period 1st January to 31st December, 1993. The Industrial Court gave its interpretation on 11/2/97. Section 8(4):\emdash \par }\pard \s15\ql \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid5246930 {\lang1033\langfe2057\langnp1033\insrsid2762481 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \'93Th}{\lang1033\langfe2057\langnp1033\insrsid2762481 e decision of the arbitration tri}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 bunal or the Industrial Court as to the effective date of the award shall be conclusive, so, however}{ \lang1033\langfe2057\langnp1033\insrsid2762481 , that if no such date has been }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 determined by the tribunal or the Court, the award shall take effect from the date of its publication under}{ \lang1033\langfe2057\langnp1033\insrsid2762481 Subsection (1) of this section}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \'94.}{\lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Section }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid2762481 11}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 subsection (1) provides:\emdash \line \'93If any question a}{\lang1033\langfe2057\langnp1033\insrsid2762481 rises as to the interpretation }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 of any award of an arbitration}{\lang1033\langfe2057\langnp1033\insrsid2762481 tribunal or the Industrial Cou}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 rt, the Minister or any party to the award may, }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 within twenty}{\ul\lang1033\langfe2057\langnp1033\insrsid2762481 }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 eight days from the time of publication of the award,}{\ul\lang1033\langfe2057\langnp1033\insrsid2762481 }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 apply }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 to the tribunal or the Court for a decision on such question, and the tribunal or the Court shall decide the matter after hearing the parties, or without such hearing provided the consent of the parties has been fir}{ \lang1033\langfe2057\langnp1033\insrsid2762481 s}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 t obtained\'94.}{\lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \line Whereas the time within which a tribunal\rquote s or the Court\rquote s award must be published after the awar d is made has not been provided by the Act, it is clear that for such award to be submitted to the tribunal or the Court for interpretation, such submission or application must be made within 28 days from the time of publication of the decision in the gaz ette, pursuant to section 8(1) of the Act. This implies that the publication is mandatory and this is fortified by the provisions of S. 8A whi}{\lang1033\langfe2057\langnp1033\insrsid2762481 ch constitute failure to implem}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ent a published award a punishable offence. This is what }{\lang1033\langfe2057\langnp1033\insrsid2762481\charrsid8143859 S.8A (}{\lang1033\langfe2057\langnp1033\insrsid2762481 l) says in this regard. }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \line }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \'93(1) Every }{\lang1033\langfe2057\langnp1033\insrsid2762481\charrsid8143859 employer}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 who fails or refuses to implement an award of an arbitration tribunal or the Industrial C}{\lang1033\langfe2057\langnp1033\insrsid2762481 ourt within 28 days from the da}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 te of its publication under subsection (1) of section of this Act, commits an offence and shall be liable to a fine not exceeding five thousand shillings or to imprisonment for a term not exceeding twelve months or to both\'94.}{\lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 In}{\lang1033\langfe2057\langnp1033\insrsid2762481 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 my understanding, an award under this Act must be published. If it is not published, it cannot be referred to the tribunal or the Court for the interpretation of the award made by the tribunal or the}{\lang1033\langfe2057\langnp1033\insrsid2762481 Court since submissio}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 n of the award to the tribunal or the Court for such interpretation must be within the period of 28 days from the award\rquote s publication. In short,}{ \lang1033\langfe2057\langnp1033\insrsid2762481 no publication of the award, no}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2762481\charrsid8143859 referral}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 of such award back to the tribunal or the Court which made the award for interpretation. If an application is made to the Court under S. }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid2762481 11(1)}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 before it has been published, the Co}{ \lang1033\langfe2057\langnp1033\insrsid2762481 urt should decline to interprete}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 it.}{\lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 I need not go into the que stion whether or not the award had been published when it was referred to the Court for interpretation, since Counsel Kanyerezi, on saying so, Counsel Matovu did not oppose him or produce proof that the award had been published in the gazette.}{ \lang1033\langfe2057\langnp1033\insrsid2762481 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \line In the result, an award that was not published at the time it was referred to the Court for interpretation should not have been so referred and the Court should}{ \lang1033\langfe2057\langnp1033\insrsid2762481 not have interpreted it. I declare}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 that its }{\lang1033\langfe2057\langnp1033\insrsid2762481\charrsid8143859 interpretation}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 was ultra vires the Act and that}{\lang1033\langfe2057\langnp1033\insrsid2762481 it was null and void and should}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 not be obeyed. }{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \par It is necessary to add tha}{\lang1033\langfe2057\langnp1033\insrsid6701919 t condonation of non-}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 publication of an award under 6. 8(1) of the Act, being a penal offence }{ \lang1033\langfe2057\langnp1033\insrsid6701919\charrsid8143859 under}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 S. 8(A) of the Act, it should not be condoned for to condone it is to condone an illegality which Courts ca}{ \lang1033\langfe2057\langnp1033\insrsid6701919 nnot do. (}{\lang1033\langfe2057\langnp1033\insrsid1064865 See}{\lang1033\langfe2057\langnp1033\insrsid6701919 Prof. Syed Hug \emdash vs}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \emdash The Islamic Univ}{\lang1033\langfe2057\langnp1033\insrsid6701919 ersity in }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Uganda, Supreme Court Civil Appeal No. }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid6701919 47/95}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ). }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 I have, I must say, looked at the decision of Rajasingham J, in the case of Trade Dispute No. }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid6701919 4/91}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid6701919 (NIC \emdash Vs}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \emdash NUOCCP & TECHNICAL EMPL0Y. ES). The judge did not attempt the question of publication in his decision which only }{\lang1033\langfe2057\langnp1033\insrsid6701919\charrsid8143859 concentrated}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 on the interpretation of S. 101 of the Civil Procedure Act \emdash In any case, even if the Judge had dealt with the issue of the time of publication of an award, I get the im} {\lang1033\langfe2057\langnp1033\insrsid6701919 pression that he would have erro}{\lang1033\langfe2057\langnp1033\insrsid6701919\charrsid8143859 r}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 . This is because he had started on the wrong premises where he stated at page 2 that \'93section 11 of the Act as amended by Decree 18 of}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 1974}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 permits a party to an award to request for an interpretation of the award \lquote within }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 28 days from the time of the award\rquote \'94. }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 With due respect to the Judge, 3.11(1) and S. 8(3) of the Act permit a party to apply for an interpretation of an award within 28 days of the }{ \ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 publication, }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 and }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 not of t}{ \ul\lang1033\langfe2057\langnp1033\insrsid1064865 h}{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 e award }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 as he stated. \line Should my decisio n on the first ground be wrong, I then turn to grounds 2 and }{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 5. }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 This is with regard to the decision of the Industrial Court in its ward given on }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 18/4/95}{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 but made retrospectively to cover the period 1st January to 31st December 1993. When the Court was asked to i}{\lang1033\langfe2057\langnp1033\insrsid1064865 nterpret its award pursuant to S.11 of the }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Act, it deci}{\lang1033\langfe2057\langnp1033\insrsid1064865 d}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ed that the award would apply to all the employees }{\lang1033\langfe2057\langnp1033\insrsid1064865\charrsid1064865 of the banks involved in the award}{\b\lang1033\langfe2057\langnp1033\insrsid1064865 }{ \lang1033\langfe2057\langnp1033\insrsid1064865\charrsid1064865 working with}{\b\lang1033\langfe2057\langnp1033\insrsid1064865 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 su}{\lang1033\langfe2057\langnp1033\insrsid1064865 ch Banks at any time during 1993}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 .}{\lang1033\langfe2057\langnp1033\insrsid1064865 \par The present application}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 disputes that interpre}{\lang1033\langfe2057\langnp1033\insrsid1064865 tation. Mr. Masembe Kanyerezi thi}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 nks that the empl}{\lang1033\langfe2057\langnp1033\insrsid1064865 o}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 yees who should ben}{ \lang1033\langfe2057\langnp1033\insrsid1064865 e}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 fit by the awa}{\lang1033\langfe2057\langnp1033\insrsid1064865 rd are those employees wh}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 o were working as the employees of the applicant when the Industrial Court\rquote s proceedings were commenced because, according to Counsel, those were the employee s who were party to the proceedings. In my view the question which arises is the same or analogous to the question that arises with regard to ground number }{\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 5, }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 and I think this is the reason why Mr.. Kanyerezi argued the two grounds }{\lang1033\langfe2057\langnp1033\insrsid1064865 together.}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 He argues that the date from which the award takes place was 1.l2.9. Mr., Kanyerezi heavily relies o}{\lang1033\langfe2057\langnp1033\insrsid1064865 n the continuation clause of th}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 e}{\lang1033\langfe2057\langnp1033\insrsid1064865 collective Agreement (Annextu}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 re \lquote A\rquote to the affidavit of Peter H. Boyd sworn in support of }{\lang1033\langfe2057\langnp1033\insrsid1064865\charrsid8143859 these applications}{\lang1033\langfe2057\langnp1033\insrsid1064865 .}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 The clause reads:\emdash }{\lang1033\langfe2057\langnp1033\insrsid1064865 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \'93In the event o}{\lang1033\langfe2057\langnp1033\insrsid1064865 f negotiations taking place on }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 salaries, Rent Subsidy, leave Allowance, Medica}{\lang1033\langfe2057\langnp1033\insrsid1064865 l Allowance, Cost of Living all}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ow}{\lang1033\langfe2057\langnp1033\insrsid1064865 an}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ce Transport Subsidy, Luncheon Subsidy and Night Computer Allowance after twelve monthly intervals and in the event that on the parties entering into negotiations on the terms and conditions of a New agreement after 3 years, until such time as such negotiations are }{\lang1033\langfe2057\langnp1033\insrsid1064865\charrsid8143859 finalized}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 the provisions of the present Agreement shall continue in force\'94.}{\lang1033\langfe2057\langnp1033\insrsid1064865 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Mr}{\lang1033\langfe2057\langnp1033\insrsid1064865 .}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 Kanyerezi has advanced a number of argument s to support his contention that the effective date of the award was not 1st January}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 1993}{ \i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 but 1st }{\lang1033\langfe2057\langnp1033\insrsid1064865 De}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 cember }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid1064865 1993}{\b\i\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 . }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 One of such arguments is that where a par}{ \lang1033\langfe2057\langnp1033\insrsid6433391 ty was dismissed }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 party to the suit, he is not bound by the }{\lang1033\langfe2057\langnp1033\insrsid6433391 remuneration and cannot benefit s}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 o he concludes that even though the Ind}{\lang1033\langfe2057\langnp1033\insrsid6433391 u}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 strial Court made its }{ \lang1033\langfe2057\langnp1033\insrsid10501098 decision of 18.4.95 but making ret}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 rospective t}{\lang1033\langfe2057\langnp1033\insrsid10501098 o 1st January}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 1993, only the employees who were in employment on 1.12.93 would be entitled to the benefits}{\lang1033\langfe2057\langnp1033\insrsid10501098 of the award. He says this is }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 b}{\lang1033\langfe2057\langnp1033\insrsid10501098 ecau}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 se 1.12.93 was the date when the Industrial Court proceedings commenced. }{\lang1033\langfe2057\langnp1033\insrsid10501098 \par }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \line There are two points to remember when Mr. Kanyerezi\rquote s above argument is being}{\lang1033\langfe2057\langnp1033\insrsid10449483 considered. One point is that }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 the Industrial Court is empowered by }{\lang1033\langfe2057\langnp1033\insrsid10449483 S.8(3) of the Act a to make a retrospective}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 award \'93to a }{\ul\lang1033\langfe2057\langnp1033\insrsid10449483 date not being }{\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 earlier than. the date on which the dispute to which the award relates first arose\rquote .}{\ul\lang1033\langfe2057\langnp1033\insrsid10449483 \par }\pard\plain \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\ipgp1\pararsid16061090 \fs24\lang2057\langfe2057\cgrid\langnp2057\langfenp2057 {\ul\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 \line This means that if the date on which the dispute arose which gave rise to the award was 1.12.93, then my second point is}{\lang1033\langfe2057\langnp1033\insrsid7950618 }{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 that the Court was wrong to swit}{\lang1033\langfe2057\langnp1033\insrsid7950618 ch the award to \line date when the }{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 1st January 1993 which is a date earlier than the/dispute \line arose. The Court\rquote s award should have been made retrospective but not to a date earlier than the date on which the dispute arose which, as I am told, was 1.12.93. T he award of the Court to cover the period 1st }{\lang1033\langfe2057\langnp1033\insrsid7950618 Janua}{\lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ry to 31st December 1993 was therefore manifestly wrong and I uphold Mr. Kanyerezi\rquote s contention that there was an error in the Court\rquote s award and in its interpretation thereof on the face of the record. If I may say, }{\lang1033\langfe2057\langnp1033\insrsid7950618 the Court had no power to disob}{ \lang1033\langfe2057\langnp1033\insrsid2183542\charrsid8143859 ey the statutory provisions of S.8 i}{\lang1033\langfe2057\langnp1033\insrsid16061090 n subsection (3) which provides}{\lang1033\langfe2057\langnp1033\insrsid7950618 \par }{\lang1033\langfe2057\langnp1033\insrsid16061090 \lquote an award of an arbitration tribunal or the industrial court shall take effect from such date as maybe determined by the tribunal or the court}{\lang1033\langfe2057\langnp1033\insrsid12338691 as the case maybe, and maybe made retrospective to date not being earlier than the date on which the dispute to which the award relates first.\'94}{\lang1033\langfe2057\langnp1033\insrsid16061090 \par }{\lang1033\langfe2057\langnp1033\insrsid12338691 This is also a sufficient ground to set aside the industrial court\rquote s interpretative decision and to quash its awa rd and I hereby set aside the decision and quash the award. But I will still proceed to consider grounds 3 and four of the application . Ground 3 states that there is an error of law}{\lang1033\langfe2057\langnp1033\insrsid8596561 on the face of the record in that the industrial court erred in law in holding that as long as the dispute remained undetermined there was no }{\lang1033\langfe2057\langnp1033\insrsid12403374 current agreement}{ \lang1033\langfe2057\langnp1033\insrsid8596561 in existence when on the true interpretation of the annual collective agreements the agreement for the previous period remained in }{\lang1033\langfe2057\langnp1033\insrsid12403374 force and}{ \lang1033\langfe2057\langnp1033\insrsid8596561 was applicable up }{\lang1033\langfe2057\langnp1033\insrsid12403374 till such}{\lang1033\langfe2057\langnp1033\insrsid8596561 time as the negotiations on a new agreement were concluded and it came into force.}{\lang1033\langfe2057\langnp1033\insrsid12338691 \par }{\lang1033\langfe2057\langnp1033\insrsid8596561 There is not much I can do other than refer to the continuing clause of the collective agreement (see the penultimate paragraph of }{\lang1033\langfe2057\langnp1033\insrsid12403374 clause 2 at page 1 of Annexture `A\rquote the supporting affidavit of Mr. P. H. In other words, if an employee had been retired}{ \lang1033\langfe2057\langnp1033\insrsid15141161 or to say, retrenched before the}{\lang1033\langfe2057\langnp1033\insrsid16065784 date on which the award commenced to apply he had nothing to benefit from that award. I do agree with the applicants \rquote contention that any letter of retirement received before the 1}{\lang1033\langfe2057\super\langnp1033\insrsid16065784\charrsid16065784 st}{\lang1033\langfe2057\langnp1033\insrsid16065784 day of December 1993 was lawful with its packages. The industrial court award was not in any way applicable to retirements that took place before 1.12.93.}{\lang1033\langfe2057\langnp1033\insrsid12403374 \par }{\lang1033\langfe2057\langnp1033\insrsid16065784 In the result, all grounds upon which this application was based are upheld and I find for the applicant and grant the orders as applied for in the application.
