The court must be satisfied that the dispute presented in the main or head suit is not \hich\af0\dbch\af37\loch\f0 \hich\af0\dbch\af37\loch\f0 a sham but a genuine dispute and that the applicant has probabilities of succeeding in the main suit. \line Now, in}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 the application before me, the main}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 remedy which the applicant seeks in the head suit is a declaration that the propert}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 y at Lungujja known as Kib\hich\af0\dbch\af37\loch\f0 uga Block 1, P}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 lot }{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 5}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 58}{\i\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 , }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 is a matrimonial home for her and the second respondent and that she should not be evicted from that property upon that ground. \line }{\f0\insrsid2522725\charrsid16273001 \par }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 The evidence before me, however, shows that the property in dispute was first brought under the Registration of Titles Act, way back in \hich\af0\dbch\af37\loch\f0 1975}{ \i\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 when it was registered under the proprietorship of S}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 arah Ndagire, the mother of the respondents. The property is cu\hich\af0\dbch\af37\loch\f0 rrently registered in the names of T}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 ereza Mwewulize, the first respondent. There is no evidence to show that the second respondent either owns the property or is in possession of it. In the terms of the provisions of section \hich\af0\dbch\af37\loch\f0 56}{ \i\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 of the Registration of Title\hich\af0\dbch\af37\loch\f0 s Act, this court must conclude that the person whose name appears on the certificate of title is the owner of the property in question. \line }{\f0\insrsid2522725\charrsid16273001 \par }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 It has been argued, on behalf of the applicant, that the property was bequeathed to the second respondent by his moth\hich\af0\dbch\af37\loch\f0 er Sarah Ndagire and that the first respondent who is the administrator o}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 f the estate of the late Sarah }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 Ndagire is registered merely as the administrator of the estate of Sarah Ndagire. To support this argument, a copy of the last will of Sarah Ndagire has\hich\af0\dbch\af37\loch\f0 been presented produced before this court \line }{ \f0\insrsid2522725\charrsid16273001 \par }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 I have perused the will of Sarah Ndagire. I find that it was clearly an invalid will. It was invalid because it did not comply with the provisions of section 51 of the Succession Act, Cap 139. The will was never\hich\af0\dbch\af37\loch\f0 attested to, by at least two witnesses, as required under that provision of the Succession Act. That fact clearly appears to have constituted the reason why, in Administration Cause No. 117 of 1987, the will of Sarah Ndagire was never probated. Instead, \hich\af0\dbch\af37\loch\f0 l\hich\af0\dbch\af37\loch\f0 etters of administration for the estate of Sarah Ndagire were granted to the late Rev. Fr. Boniface Mubiru and Tereza Mwewulize, the first respondent. That meant that the late Sarah Ndagire died intestate. She did not leave a valid will. The terms of the \hich\af0\dbch\af37\loch\f0 d\hich\af0\dbch\af37\loch\f0 ocument presented before this court as the will of Sarah Ndagire and to show that}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 the property in dispute was be}{ \f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 queathed by her the second respondent, has, thus no probative value. Its contents are of}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 no effect in law and c}{ \f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 annot be acted upon. \line For that re\hich\af0\dbch\af37\loch\f0 ason, t}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 his court must believe the averm}{ \f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 ent of second respondent in paragraph 9 of his affidavit in reply and that of the first respondent in paragraph \hich\af0\dbch\af37\loch\f0 5}{\i\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 of her affidavit in reply-to the effect that the first respondent is registered as proprietor in her ow\hich\af0\dbch\af37\loch\f0 n personal right and not as administrator of the estate }{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 of Sarah Ndagire or on behalf of the s}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 econd respondent. That means, of course, that the claim by the applicant that the property in dispute is her matrimonial home has no basis whatever. The second re\hich\af0\dbch\af37\loch\f0 spondent has never either owned that property or has he ever been in possession of it. \line }{\f0\insrsid2522725\charrsid16273001 \par }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 I also agree with the submission made by Mr. Ssend}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 e}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 ge, learned counsel for the respondents that the position of the law seems to be that even if it were true that the property in Kibuga Block 1, plot \hich\af0\dbch\af37\loch\f0 558}{\i\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 , }{ \f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 was the matrimonial home of the applicant and the second respondent, the applicant would have no right\hich\af0\dbch\af37\loch\f0 to possession superceding that of the registered owner. The applicant having no apparent right to ownership of the property would at best have claimed to reside in the property merely as a licence of her husband. Her rights as a wife to the second respon \hich\af0\dbch\af37\loch\f0 d\hich\af0\dbch\af37\loch\f0 ed for entitlement to a matri}{\f0\insrsid2522725\charrsid16273001 \hich\af0\dbch\af37\loch\f0 monial home are personal rights.}{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 They are rights }{\f0\ul\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 in personam. }{\f0\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 They do not extend against third parties. They would not constitute a genuine triable issue as against the registered proprietor. The decision in }{\b\f0\ul\insrsid15481181\charrsid16273001 \hich\af0\dbch\af37\loch\f0 National Provincial \hich\af0\dbch\af37\loch\f0 Bank Ltd. Vs. Ainsworth (1965) 2 All E.
