He submitted that }{\insrsid3678159\charrsid9068287 this}{\insrsid10319647\charrsid9068287 non }{\insrsid3678159\charrsid9068287 compliance with the above legal}{\insrsid5506590\charrsid9068287 requirement }{\insrsid12350007\charrsid9068287 tendered}{\insrsid5506590\charrsid9068287 this }{\insrsid10319647\charrsid9068287 appeal }{\insrsid3678159\charrsid9068287 incompetent}{\insrsid10319647\charrsid9068287 }{\insrsid3678159\charrsid9068287 a} {\insrsid10319647\charrsid9068287 nd }{\insrsid5506590\charrsid9068287 prayed that it}{\insrsid10319647\charrsid9068287 must }{\insrsid5506590\charrsid9068287 be struck}{\insrsid10319647\charrsid9068287 .}{\insrsid5506590\charrsid9068287 \par }{\insrsid10319647\charrsid9068287 For the appellant, Mr}{\insrsid5506590\charrsid9068287 .}{\insrsid12350007\charrsid9068287 Atare replied that the legal }{\insrsid10319647\charrsid9068287 requirement fully }{\insrsid5506590\charrsid9068287 complied}{ \insrsid10319647\charrsid9068287 with }{\insrsid5506590\charrsid9068287 by the appellant enume}{\insrsid10319647\charrsid9068287 rating in }{\insrsid5506590\charrsid9068287 th}{\insrsid10319647\charrsid9068287 e }{\insrsid5506590\charrsid9068287 Memorandum}{\insrsid10319647\charrsid9068287 }{\insrsid5506590\charrsid9068287 of his appeal all the irregularities}{\insrsid10319647\charrsid9068287 in the order of the lower court }{\insrsid5506590\charrsid9068287 against which the appeal}{ \insrsid10319647\charrsid9068287 was lodged }{\insrsid5506590\charrsid9068287 as required by section 78 (1}{\insrsid10319647\charrsid9068287 ) }{\insrsid5506590\charrsid9068287 of the Civil Proce}{\insrsid10319647\charrsid9068287 dure }{ \insrsid5506590\charrsid9068287 A}{\insrsid10319647\charrsid9068287 ct. That this }{\insrsid5506590\charrsid9068287 is exactly what the appellant di}{\insrsid10319647\charrsid9068287 d in thi}{\insrsid5506590\charrsid9068287 s}{ \insrsid10319647\charrsid9068287 appeal and he prayed that the argument of the Responde}{\insrsid9461141\charrsid9068287 nt on this point should be dismissed and the court should that}{\insrsid10319647\charrsid9068287 t}{\insrsid9461141\charrsid9068287 his}{\insrsid10319647\charrsid9068287 appeal }{\insrsid12350007\charrsid9068287 is competent. \par H}{\insrsid10319647\charrsid9068287 aving }{\insrsid15421314\charrsid9068287 heard the arguments of both counsels on this}{\insrsid10319647\charrsid9068287 point and having carefully perused the }{\insrsid15421314\charrsid9068287 authorities cited}{ \insrsid10319647\charrsid9068287 and the relevant law in this regard, I am}{\insrsid15421314\charrsid9068287 of}{\i\insrsid10319647\charrsid9068287 }{\insrsid10319647\charrsid9068287 the }{\insrsid15421314\charrsid9068287 view that M}{ \insrsid10319647\charrsid9068287 r. }{\insrsid15421314\charrsid9068287 Atare dismi}{\insrsid10319647\charrsid9068287 ssed one }{\insrsid16676560\charrsid9068287 vital point here, this point is}{\insrsid10319647\charrsid9068287 the meaning of}{ \insrsid16676560\charrsid9068287 the words \'93decree\'94 or \'93order\'94 is}{\insrsid10319647\charrsid9068287 }{\insrsid16676560\charrsid9068287 u}{\insrsid10319647\charrsid9068287 sed }{\insrsid16676560\charrsid9068287 section}{ \insrsid10319647\charrsid9068287 232 (}{\insrsid16676560\charrsid9068287 1)}{\insrsid10319647\charrsid9068287 of }{\insrsid16676560\charrsid9068287 the Magistrates Courts Act. A decree or order from which appeal is preferred must be extracted and ti}{\insrsid10831907\charrsid9068287 led together with the Memorandum of }{\insrsid10319647\charrsid9068287 Appeal. S. Versi and Anor (}{\b\ul\insrsid10319647\charrsid9068287 1953}{\b\ul\insrsid9118600\charrsid9068287 ) 20 E}{ \b\ul\insrsid10319647\charrsid9068287 ACA 26.}{\insrsid10319647\charrsid9068287 He also cited the case, of }{\b\ul\insrsid10319647\charrsid9068287 Kiwe}{\b\ul\insrsid9118600\charrsid9068287 g}{\b\ul\insrsid10319647\charrsid9068287 e and }{ \b\ul\insrsid9118600\charrsid9068287 Mgude Sisal Estate Ltd}{\b\ul\insrsid10319647\charrsid9068287 }{\b\ul\insrsid9118600\charrsid9068287 -}{\b\ul\insrsid10319647\charrsid9068287 vs-}{\b\insrsid10319647\charrsid9068287 }{ \b\ul\insrsid10319647\charrsid9068287 M. Nathw}{\b\ul\insrsid9118600\charrsid9068287 ani (1952) 19 EACA 1}{\b\ul\insrsid10319647\charrsid9068287 60 }{\insrsid10319647\charrsid9068287 wh}{\insrsid9118600\charrsid9068287 ere it}{ \insrsid10319647\charrsid9068287 }{\insrsid9118600\charrsid9068287 was h}{\insrsid10319647\charrsid9068287 eld that without a decree an appeal is incom}{\insrsid9118600\charrsid9068287 p}{\insrsid10319647\charrsid9068287 e}{ \insrsid9118600\charrsid9068287 tent and premature.}{\insrsid10319647\charrsid9068287 }{\insrsid9118600\charrsid9068287 Sin}{\insrsid10319647\charrsid9068287 ce then }{\insrsid9118600\charrsid9068287 this court has consistently been holding that appeal}{ \insrsid10319647\charrsid9068287 withou}{\insrsid9118600\charrsid9068287 t a decree is incompetent. It is th}{\insrsid10319647\charrsid9068287 e duty of the appellant or his counsel to ensure that such a decree or order is extracted}{ \i\insrsid10319647\charrsid9068287 }{\insrsid9118600\charrsid9068287 and made available}{\insrsid11797362\charrsid9068287 when he files his }{\insrsid9118600\charrsid9068287 Memorandum}{\insrsid8128505\charrsid9068287 of Appeal.}{ \insrsid10319647\charrsid9068287 (}{\b\insrsid10319647\charrsid9068287 See }{\b\ul\insrsid8128505\charrsid9068287 Kisule \emdash vs Nampewo (1984) HCB 55; \line Kyomutali -v}{\b\ul\insrsid10319647\charrsid9068287 s- Zirondumu (1}{ \b\ul\insrsid8128505\charrsid9068287 979)}{\b\ul\insrsid10319647\charrsid9068287 HCB}{\b\ul\insrsid8128505\charrsid9068287 2}{\b\ul\insrsid10319647\charrsid9068287 1}{\b\ul\insrsid8128505\charrsid9068287 9)}{\ul\insrsid10319647\charrsid9068287 }{ \insrsid8128505\charrsid9068287 \par }{\insrsid10319647\charrsid9068287 In the instant appeal, no decree or order from which the appeal was lodged was at all extracted and filed with the Memorandum of the Appe}{\insrsid8128505\charrsid9068287 al. The appellant filed only a }{ \insrsid10319647\charrsid9068287 Memorandum of Appeal. This i}{\insrsid8128505\charrsid9068287 s not enough. It does not fully}{\insrsid10319647\charrsid9068287 comply with the requirement of the law. On the author ities cited hereabove, this appeal is clearly incompetent on this ground. This is enough t}{\insrsid8128505\charrsid9068287 o throw out the appeal. \par }{\insrsid10319647\charrsid9068287 The second point which Mr. Orach raised is that the order of the Chief Magistrate against }{\insrsid8128505\charrsid9068287 which the purported appeal was l}{\insrsid10319647\charrsid9068287 o}{ \insrsid8128505\charrsid9068287 dged is}{\insrsid10319647\charrsid9068287 a}{\insrsid8128505\charrsid9068287 n order which is not automatically appealable }{\insrsid10319647\charrsid9068287 from. He relied on section 77 (1) of the}{ \insrsid8128505\charrsid9068287 Civil Proced}{\insrsid10319647\charrsid9068287 ur}{\insrsid8128505\charrsid9068287 e A}{\insrsid10319647\charrsid9068287 ct and order }{\insrsid8128505\charrsid9068287 40 r 1 of the }{\insrsid10319647\charrsid9068287 Civil }{\insrsid8128505\charrsid9068287 Proc}{\insrsid10319647\charrsid9068287 edure Rules. He}{\insrsid8128505\charrsid9068287 pointed out that the}{\insrsid10319647\charrsid9068287 Ruling whic}{\insrsid8128505\charrsid9068287 h is the subject of this appeal}{\insrsid10319647\charrsid9068287 is excluded from the categories of orders which are automatically appealab}{\insrsid8128505\charrsid9068287 le from. That on this ground this appeal is incom}{ \insrsid10319647\charrsid9068287 petent. For the appellant, Mr. Ata}{\insrsid8128505\charrsid9068287 re did not answer this point. \par O.40 r }{\insrsid10319647\charrsid9068287 1 of the Civil Procedure Rules and section 77 (1) of the Civil Procedure Act have listed the orders from which appeal lie automatically as of right. These lists exclude the order under which, this ruling, was made. }{\insrsid5114687\charrsid9068287 The applic}{\insrsid10319647\charrsid9068287 ation t}{\insrsid5114687\charrsid9068287 he ruling on which is the subject matter of}{\insrsid10319647\charrsid9068287 this Appeal wa}{\insrsid5114687\charrsid9068287 s made under O.48 r }{\insrsid10319647\charrsid9068287 1 of the Civil }{\insrsid5114687\charrsid9068287 P}{ \insrsid10319647\charrsid9068287 roced}{\insrsid5114687\charrsid9068287 ure}{\insrsid10319647\charrsid9068287 Rules }{\insrsid5114687\charrsid9068287 a}{\insrsid10319647\charrsid9068287 nd sections 220 of the Magistrates Courts Act and Se}{ \insrsid5114687\charrsid9068287 c}{\insrsid10319647\charrsid9068287 t}{\insrsid5114687\charrsid9068287 ion 101 of the Civil Procedure Act. \par O}{\insrsid10319647\charrsid9068287 .48 r}{\insrsid5114687\charrsid9068287 }{\insrsid10319647\charrsid9068287 1 of the Civil Procedure Rules i}{\insrsid5114687\charrsid9068287 s excluded from the list under O.40 r}{\insrsid10319647\charrsid9068287 1 of the Civil Procedure Rules and }{\insrsid5114687\charrsid9068287 also}{\insrsid10319647\charrsid9068287 from the list under section 77 }{\insrsid5114687\charrsid9068287 (1}{\insrsid10319647\charrsid9068287 ) of the Civil Procedure Act. It follows that appeal from order}{\insrsid5114687\charrsid9068287 }{\insrsid10319647\charrsid9068287 made }{\insrsid5114687\charrsid9068287 under that order 48 r }{\insrsid10319647\charrsid9068287 1 of the Civil Procedure Rules which is excluded from the ab}{\insrsid5114687\charrsid9068287 o}{\insrsid10319647\charrsid9068287 ve list can only lie with leave of the cour}{\insrsid5114687\charrsid9068287 t}{\insrsid10319647\charrsid9068287 making the order sought to be appe}{\insrsid5114687\charrsid9068287 aled against or of the court to}{\insrsid10319647\charrsid9068287 }{\insrsid5114687\charrsid9068287 which an appeal would if leave were given lie. The procedure for applying for such }{ \insrsid10319647\charrsid9068287 leave is provided for un}{\insrsid5114687\charrsid9068287 der O.40 r}{\insrsid10319647\charrsid9068287 1 (4)}{\insrsid5114687\charrsid9068287 of the Civil Procedure Rules. \par }{\insrsid10319647\charrsid9068287 In the }{\insrsid5114687\charrsid9068287 instant case no such leave was even sought and was therefo}{\insrsid10319647\charrsid9068287 re not granted. Under those circumstances the appeal}{\insrsid5114687\charrsid9068287 }{\insrsid10319647\charrsid9068287 is once again on this ground incompetent.}{\insrsid5114687\charrsid9068287 I}{\insrsid10319647\charrsid9068287 have}{\b\insrsid10319647\charrsid9068287 }{\insrsid10319647\charrsid9068287 n}{ \insrsid5114687\charrsid9068287 oted the procedure}{\insrsid10319647\charrsid9068287 in which th}{\insrsid5114687\charrsid9068287 e original application the ruli}{\insrsid10319647\charrsid9068287 ng in which is the subject of this purported appea}{ \insrsid5114687\charrsid9068287 l was brought. I will revert to}{\insrsid10319647\charrsid9068287 it }{\insrsid5114687\charrsid9068287 later in this ruling. \par }{\insrsid10319647\charrsid9068287 The third ground on which Mr. Orach chall}{\insrsid5114687\charrsid9068287 e}{\insrsid10319647\charrsid9068287 nged this appeal as being incompetent was that it}{\insrsid5114687\charrsid9068287 }{ \insrsid10319647\charrsid9068287 is}{\insrsid5114687\charrsid9068287 time barred. He cited section 80 (1}{\insrsid10319647\charrsid9068287 ) of the Civil Procedure Ac}{\insrsid5114687\charrsid9068287 t and O.39 r }{\insrsid10319647\charrsid9068287 8 of the Civi}{\insrsid5114687\charrsid9068287 l Procedure Rules to support hi}{\insrsid10319647\charrsid9068287 s contenti}{\insrsid5114687\charrsid9068287 on. He argued that section 80 (1) of the Civil Proc}{\insrsid10319647\charrsid9068287 edur}{ \insrsid5114687\charrsid9068287 e}{\insrsid10319647\charrsid9068287 Act stipulates tha}{\insrsid5114687\charrsid9068287 t all appeal to the High Court mu}{\insrsid10319647\charrsid9068287 st b lodged within 30 days from the date}{ \insrsid5114687\charrsid9068287 }{\insrsid10319647\charrsid9068287 of the}{\insrsid5114687\charrsid9068287 decr}{\insrsid10319647\charrsid9068287 ee or order appealed from. That }{\insrsid5114687\charrsid9068287 O.39 r 8 of the Civil Procedure Rule p}{ \insrsid10319647\charrsid9068287 rovides the procedure in which such an appeal to }{\insrsid1858139\charrsid9068287 th}{\insrsid10319647\charrsid9068287 e }{\insrsid1858139\charrsid9068287 High Court should commence}{\insrsid10319647\charrsid9068287 . That it should }{\insrsid1858139\charrsid9068287 commence}{\insrsid10319647\charrsid9068287 }{\insrsid1858139\charrsid9068287 by filing }{\insrsid10319647\charrsid9068287 Memorandum of the Appeal signed by the ap}{\insrsid1858139\charrsid9068287 pell}{ \insrsid10319647\charrsid9068287 ant o}{\insrsid1858139\charrsid9068287 r b}{\insrsid10319647\charrsid9068287 y his advocate but n}{\insrsid1858139\charrsid9068287 ot by a Notice of Appeal. He pointed out that in the instant Appeal}{ \insrsid10319647\charrsid9068287 the Memorandum of the Appeal was }{\insrsid1858139\charrsid9068287 filed on 31-5-1991 marking the comm}{\insrsid10319647\charrsid9068287 enc}{\insrsid1858139\charrsid9068287 ement of this appeal almost one}{ \insrsid10319647\charrsid9068287 year from the date when the order against which }{\insrsid1858139\charrsid9068287 the appeal is lodged was made.}{\insrsid10319647\charrsid9068287 This order was }{\insrsid1858139\charrsid9068287 made on 3-4-}{ \insrsid10319647\charrsid9068287 1990. Counsel submitted that the purported filing of the Notice of the Appeal within 30 days from the date o}{\insrsid1858139\charrsid9068287 f the order is of no legal con}{\insrsid10319647\charrsid9068287 sequence since the filing of the Notice did n}{\insrsid1858139\charrsid9068287 ot signal }{\insrsid10319647\charrsid9068287 the }{\insrsid1858139\charrsid9068287 commencement of the Appeal.}{\insrsid10319647\charrsid9068287 From the above counsel prayed that the appeal should be struck out as being incompetent for being filed out of time witho}{\insrsid1858139\charrsid9068287 ut leave of extension of time. \par For the appellant, Mr. }{\insrsid10319647\charrsid9068287 Atare replied that although there is n}{\insrsid1858139\charrsid9068287 o legal requirement for commenc}{\insrsid10319647\charrsid9068287 ing a Civil Appeal to the High Court by filing a Notice of Appeal, the court neve}{\insrsid1858139\charrsid9068287 rtheless}{\insrsid10319647\charrsid9068287 takes judicial Notice that such a Notice must be given. He relied on the case of }{ \ul\insrsid10319647\charrsid9068287 S}{\ul\insrsid1858139\charrsid9068287 ulemani \endash vs- }{\ul\insrsid2559370 By}{\ul\insrsid10319647\charrsid9068287 ekwa}{\ul\insrsid1858139\charrsid9068287 so H. C. C._Appeal No. 4/}{ \ul\insrsid10319647\charrsid9068287 86. }{\insrsid10319647\charrsid9068287 In that case, the appeal was com}{\insrsid1858139\charrsid9068287 menced by a Notice of Appeal which was}{\insrsid10319647\charrsid9068287 filed within 30 days f}{ \insrsid1858139\charrsid9068287 rom the date of the decree appeal}{\insrsid10319647\charrsid9068287 ed from. The Memorandum of Appeal was filed six months later. At the hearing, a prelimi}{\insrsid1858139\charrsid9068287 nary point was taken for the res}{ \insrsid10319647\charrsid9068287 pondent arguing that th}{\insrsid1858139\charrsid9068287 e appeal was fatally irregular i}{\insrsid10319647\charrsid9068287 t having been instituted by a Notice of Appeal instead of by a Memorandum of Appeal. For the Appellant it was contented that the appeal was competent and that the procedure he adopted was the correct one. That if that was}{ \insrsid15091502\charrsid9068287 irregularity, the rul}{\insrsid10319647\charrsid9068287 e of procedure being }{\insrsid15091502\charrsid9068287 the handmaid of justice should not operate}{\insrsid2559370 to defeat it. That }{ \insrsid15091502\charrsid9068287 in these circ}{\insrsid10319647\charrsid9068287 umstances }{\insrsid15091502\charrsid9068287 the filing of Notice of Appeal do}{\insrsid10319647\charrsid9068287 e}{\insrsid15091502\charrsid9068287 s}{ \insrsid10319647\charrsid9068287 not render the subsequent Memorandum }{\insrsid15091502\charrsid9068287 of Appeal a nullity}{\insrsid10319647\charrsid9068287 . Relying on the above }{\insrsid15091502\charrsid9068287 ruling}{ \insrsid10319647\charrsid9068287 Mr. Atare urged this court to }{\insrsid15091502\charrsid9068287 follow i}{\insrsid10319647\charrsid9068287 t and to hold that the pre}{\insrsid15091502\charrsid9068287 sent appeal is not time barred. \par The procedure of presenting a }{\insrsid2559370\charrsid9068287 civil}{\insrsid15091502\charrsid9068287 appeal to the High }{\insrsid10319647\charrsid9068287 Court }{\insrsid15091502\charrsid9068287 is covered under O.39 r 8 of the Civil Procedure Rules} {\insrsid10319647\charrsid9068287 . This}{\insrsid15091502\charrsid9068287 rule appears to me quite clear}{\insrsid10319647\charrsid9068287 Civil Appeal is commenced in the High Court by }{\insrsid15091502\charrsid9068287 lodging}{ \insrsid10319647\charrsid9068287 with its Registry a Memorandum of Appeal but not a }{\insrsid15091502\charrsid9068287 Notice of Appeal. Notice of Appeal is }{\insrsid10319647\charrsid9068287 not at all a legal requi}{\insrsid15091502\charrsid9068287 rement in the procedure of com}{\insrsid10319647\charrsid9068287 menci}{\insrsid15091502\charrsid9068287 ng a Civil Appeal in the High Court. \par In }{\insrsid10319647\charrsid9068287 my view }{\insrsid15091502\charrsid9068287 the}{\insrsid10319647\charrsid9068287 case}{\insrsid15091502\charrsid9068287 of }{\b\ul\insrsid1381583\charrsid9068287 Sulemani .v. By}{ \b\ul\insrsid15091502\charrsid9068287 ekwaso}{\insrsid10319647\charrsid9068287 above is }{\insrsid15091502\charrsid9068287 distinguishable}{\insrsid10319647\charrsid9068287 fr}{\insrsid15091502\charrsid9068287 om the c}{\insrsid10319647\charrsid9068287 ase before me in that}{\insrsid15091502\charrsid9068287 in }{\b\ul\insrsid15091502\charrsid9068287 Byekwaso\rquote s}{\b\ul\insrsid10319647\charrsid9068287 case}{\insrsid10319647\charrsid9068287 , }{\insrsid1381583\charrsid9068287 the}{ \insrsid10319647\charrsid9068287 issue was }{\insrsid1381583\charrsid9068287 that the institution of the appeal in High}{\insrsid10319647\charrsid9068287 }{\insrsid1381583\charrsid9068287 Co}{\insrsid10319647\charrsid9068287 urt by }{ \insrsid4140391\charrsid9068287 a Notice of Appeal was fatally irregular}{\insrsid10319647\charrsid9068287 whereas in the instant case the issue is that filing a Notice of Appeal within the 30 days from the date of the decree appealed from does not save the appeal from being time barred if the Memorandum of the Appeal was }{\insrsid7740392\charrsid9068287 not }{\insrsid10319647\charrsid9068287 filed w}{\insrsid7740392\charrsid9068287 ithin the time allowed by law. \par In com}{\insrsid10319647\charrsid9068287 puting }{\insrsid4536489\charrsid9068287 the time for lodging an appeal }{\insrsid10319647\charrsid9068287 the time lost in obtaining records of the proceedings of the lower court must be excluded. }{ \b\ul\insrsid10319647\charrsid9068287 (See }{\b\ul\insrsid4536489\charrsid9068287 J. A. DIAS \endash vs- AHMED S. S.}{\b\ul\insrsid10319647\charrsid9068287 SWEDAN (1960) EA 984)}{\insrsid4536489\charrsid9068287 . The limitation time begin}{ \insrsid5770166\charrsid9068287 s to run }{\insrsid4536489\charrsid9068287 imme}{\insrsid10319647\charrsid9068287 diately after the decree from which appeal is lodged, was passed. \par }{\insrsid5770166\charrsid9068287 Such a limitation time would s}{\insrsid10319647\charrsid9068287 top to run as soon as a request in writing is made for copies}{\insrsid5770166\charrsid9068287 }{\insrsid10319647\charrsid9068287 of the proceedings of the lower}{\b\insrsid10319647\charrsid9068287 }{\insrsid5770166\charrsid9068287 court and}{\insrsid10319647\charrsid9068287 resum}{\insrsid2916156\charrsid9068287 es to }{\insrsid5770166\charrsid9068287 run when copies of the proceedings}{\insrsid10319647\charrsid9068287 are sent to the Appellant. The argument that a Notice of Appeal serves to move, the lower cour}{\insrsid2916156\charrsid9068287 t to supply the intended Appell}{ \insrsid10319647\charrsid9068287 ant with copies of the proceedings of the}{\insrsid2916156\charrsid9068287 }{\insrsid10319647\charrsid9068287 lo}{\insrsid2916156\charrsid9068287 wer court is in my view not whol}{\insrsid10319647\charrsid9068287 ly satisfactory because such a Notice \lquote does not make request for copies of proceedings of the lower court to be sent to the intended appellant. Such a request has to be implicit. Only then can the limitation }{\insrsid13990729\charrsid9068287 p}{ \insrsid10319647\charrsid9068287 eriod }{\insrsid13990729\charrsid9068287 stop }{\insrsid10319647\charrsid9068287 r}{\insrsid13990729\charrsid9068287 u}{\insrsid10319647\charrsid9068287 nn}{\insrsid13990729\charrsid9068287 i}{ \insrsid10319647\charrsid9068287 ng against the intended }{\insrsid13990729\charrsid9068287 appellant as}{\insrsid10319647\charrsid9068287 from the date of the letter requesting for copies of the proceedings of the lower court. }{ \insrsid13990729\charrsid9068287 \par I}{\insrsid10319647\charrsid9068287 n the }{\insrsid13990729\charrsid9068287 insta}{\insrsid10319647\charrsid9068287 nt case, the order against which the appeal was lodged was passed }{\insrsid13990729\charrsid9068287 on 3-4-1990}{ \insrsid10319647\charrsid9068287 and the }{\insrsid13990729\charrsid9068287 Notice of Appeal }{\insrsid10319647\charrsid9068287 w}{\insrsid13990729\charrsid9068287 as}{\insrsid10319647\charrsid9068287 }{\insrsid13990729\charrsid9068287 filed}{ \insrsid10319647\charrsid9068287 seventeen}{\insrsid13990729\charrsid9068287 }{\insrsid10319647\charrsid9068287 days later }{\insrsid13990729\charrsid9068287 on 20-4-}{\insrsid10319647\charrsid9068287 1990. This is}{\insrsid13990729\charrsid9068287 foll}{\insrsid10319647\charrsid9068287 owed on}{\insrsid13990729\charrsid9068287 }{\insrsid10319647\charrsid9068287 5}{\insrsid13990729\charrsid9068287 -11-1}{\insrsid16127153\charrsid9068287 990 by a specific request}{\insrsid10319647\charrsid9068287 in writing for copies}{\insrsid16127153\charrsid9068287 }{\insrsid10319647\charrsid9068287 of the lower court\rquote s proceedings. This was about six}{\b\insrsid10319647\charrsid9068287 }{\insrsid10319647\charrsid9068287 months after the order appealed from was made. In my view the limitation period had stopped runnin}{\insrsid11281949\charrsid9068287 g against the intended appel}{\insrsid10319647\charrsid9068287 lant }{\insrsid11281949\charrsid9068287 on 5-11-}{ \insrsid10319647\charrsid9068287 1990, six}{\b\insrsid10319647\charrsid9068287 }{\insrsid11281949\charrsid9068287 months later when a written request for copies of the pro}{\insrsid10319647\charrsid9068287 ceedings of the lower court was made. While I do admit th}{\insrsid6508552\charrsid9068287 at rules of procedure are handm}{\insrsid10319647\charrsid9068287 aids of justice but not to defeat it, they must prima facie be obeyed and the time prescribed for a, particular step must be complied with u}{\insrsid6508552\charrsid9068287 nless otherwise extended. }{\b\ul\insrsid6508552\charrsid9068287 (A. K}{ \b\ul\insrsid10319647\charrsid9068287 aliwin Mukaya }{\b\ul\insrsid6508552\charrsid9068287 -Vs}{\b\ul\insrsid10319647\charrsid9068287 - J }{\b\ul\insrsid6508552\charrsid9068287 Kasigwa (1978) HC}{\b\ul\insrsid10319647\charrsid9068287 B }{ \b\ul\insrsid6508552\charrsid9068287 251)}{\insrsid6508552\charrsid9068287 . A distinction }{\insrsid10319647\charrsid9068287 must be drawn between a case where a litig}{\insrsid6508552\charrsid9068287 ant is being represented by an }{ \insrsid10319647\charrsid9068287 advocate and one where }{\insrsid6508552\charrsid9068287 he is not. In the former, courts should be more }{\insrsid10319647\charrsid9068287 strict to en}{\insrsid6508552\charrsid9068287 s}{\insrsid10319647\charrsid9068287 ure adherence to the rules of }{\insrsid6508552\charrsid9068287 procedure}{\insrsid10319647\charrsid9068287 because an advocate is a }{\insrsid6508552\charrsid9068287 professional}{\insrsid1601774\charrsid9068287 man. He professes and}{ \insrsid10319647\charrsid9068287 indeed is deemed to possess the requisite professional experience and skills. He is thus expected to employ those experience and skills in handling his clients\rquote cases. Undue general laxity in enforcing the observance of such rules of procedure by courts are apt to produce injustice. For this ground I hold the view that }{\insrsid2041058\charrsid9068287 this appeal in the circum}{\insrsid10319647\charrsid9068287 stances was filed out of time. As such it is}{\insrsid2041058\charrsid9068287 time barred aid, incompetent. \par }{\insrsid16254683\charrsid9068287 Mr. Orach}{\insrsid10319647\charrsid9068287 }{\insrsid16254683\charrsid9068287 further, challenged the 4}{\super\insrsid16254683\charrsid9068287 th}{\insrsid16254683\charrsid9068287 }{\insrsid10319647\charrsid9068287 it}{\insrsid16254683\charrsid9068287 em in the Memorandum of the Appeal as being also incompetent because it did no}{\insrsid10319647\charrsid9068287 t}{\insrsid16254683\charrsid9068287 comp}{\insrsid10319647\charrsid9068287 ly}{ \insrsid16254683\charrsid9068287 }{\insrsid10319647\charrsid9068287 with}{\insrsid16254683\charrsid9068287 section 63 (1}{\insrsid10319647\charrsid9068287 ) of the Civil}{\insrsid16254683\charrsid9068287 Procedure Act. This section requires the consent of the Attorney }{\insrsid10319647\charrsid9068287 General for anyone person to bring an action for a public nuisance. Item 4 of the Memorandum of }{\insrsid16254683\charrsid9068287 Appeal was seeking a relief f}{\insrsid10319647\charrsid9068287 or an alleged public nuisance but the re}{\insrsid16254683\charrsid9068287 quisite consent of the Attorney }{\insrsid10319647\charrsid9068287 General was not obtained. Mr. Atare conceded to this}{\insrsid16254683\charrsid9068287 error and withdrew this item. \par }{\insrsid10319647\charrsid9068287 For the Respondent a Notice }{\insrsid16254683\charrsid9068287 of Cross-}{\insrsid10319647\charrsid9068287 Appeal was placed }{\insrsid16254683\charrsid9068287 o}{\insrsid10319647\charrsid9068287 n the court file but no fee was paid for filing it. Mr. Ata}{\insrsid16254683\charrsid9068287 re attacked the Notice of Cross-}{\insrsid10319647\charrsid9068287 Appeal as being incompetent for non payment of appropriate f}{ \insrsid16254683\charrsid9068287 iling fee. He argued that Cross-}{\insrsid10319647\charrsid9068287 Appeal is a suit within section 2 of the Civil Procedure Act and that filing fee must be paid on filing it. That no }{\insrsid16254683\charrsid9068287 document is properly filed in c}{\insrsid10319647\charrsid9068287 ourt until appropriate fee is paid. }{\insrsid16254683\charrsid9068287 \par }{\insrsid10319647\charrsid9068287 He relied on the cases of }{\b\ul\insrsid16254683\charrsid9068287 Babizahirwa Francis -vs- Bay}{\b\ul\insrsid10319647\charrsid9068287 an}{\b\ul\insrsid16254683\charrsid9068287 ja}{\b\ul\insrsid12006399\charrsid9068287 } {\b\ul\insrsid10319647\charrsid9068287 Twenyo Co. LTD. HCCS}{\b\ul\insrsid16254683\charrsid9068287 No.}{\b\ul\insrsid10319647\charrsid9068287 10781/88 and }{\b\ul\insrsid16254683\charrsid9068287 UNTA}{\b\ul\insrsid10319647\charrsid9068287 E}{ \b\ul\insrsid16254683\charrsid9068287 XP}{\b\ul\insrsid10319647\charrsid9068287 ORT}{\b\ul\insrsid16254683\charrsid9068287 LTD \endash vs-}{\b\ul\insrsid10319647\charrsid9068287 }{\b\ul\insrsid16254683\charrsid9068287 CU}{ \b\ul\insrsid10319647\charrsid9068287 STOM (1970) EA 648 }{\insrsid16254683\charrsid9068287 and prayed that the Cross-Appeal be struck out. \par }{\insrsid10319647\charrsid9068287 Mr. Orach replied for the Re}{\insrsid16254683\charrsid9068287 spondent that a Notice of Cross-}{\insrsid10319647\charrsid9068287 Appeal is not a suit within section 2 of the P. C. A and therefore that no fee is req}{ \insrsid16254683\charrsid9068287 uired for filing it. That there}{\insrsid10319647\charrsid9068287 is even no procedure has been provided under our Civil Procedure Rules for instituting a Cross\emdash Appeal and that in the circumstances recourse must be made to section 17 (2) of the Judicature Act 1967. This section empowers High Court cases where no procedure is laid down, to adopt a procedure which is justifiable by the circumst}{ \insrsid1246294\charrsid9068287 ances of the case. He referred }{\insrsid10319647\charrsid9068287 me to }{\b\ul\insrsid1246294\charrsid9068287 S. M. HeM}{\b\ul\insrsid10319647\charrsid9068287 ani _}{\b\ul\insrsid1246294\charrsid9068287 .}{ \b\ul\insrsid10319647\charrsid9068287 vs}{\b\ul\insrsid1246294\charrsid9068287 ._Mawjiwalj}{\b\ul\insrsid10319647\charrsid9068287 i Civil Appeal No. 73/59, (}{\b\ul\insrsid1246294\charrsid9068287 a)}{\b\ul\insrsid10319647\charrsid9068287 }{ \b\ul\insrsid1246294\charrsid9068287 case No.10 }{\b\ul\insrsid10319647\charrsid9068287 reported in Digest of Uganda Hig}{\b\ul\insrsid1246294\charrsid9068287 h}{\b\ul\insrsid10319647\charrsid9068287 Court Cases vol}{\b\ul\insrsid1246294\charrsid9068287 .3}{\b\ul\insrsid10319647\charrsid9068287 cases on Civil Procedure and Evidence}{\insrsid10319647\charrsid9068287 . }{\insrsid1246294\charrsid9068287 In that case the }{\insrsid10319647\charrsid9068287 Responde}{\insrsid1246294\charrsid9068287 nt cross-} {\insrsid10319647\charrsid9068287 appealed by filing a Notice thereof. }{\insrsid1246294\charrsid9068287 Appellant argued that the Cross-}{\insrsid10319647\charrsid9068287 Appeal was incompet}{\insrsid1246294\charrsid9068287 ent for failure to comply with O}{\insrsid10319647\charrsid9068287 .39 regulating the rules of filing appeal by M emorandum of Appeal and section 80 regarding the period when an appeal should he lodged. It was held that there is no procedure laid down under our C}{\insrsid1246294\charrsid9068287 ivil Procedure Rules for instituting a Cross-}{ \insrsid10319647\charrsid9068287 Appeal. A proce}{\insrsid1246294\charrsid9068287 dure applicable in U. K under RSC O.58 r }{\insrsid10319647\charrsid9068287 6 was followed. Under this rule it is }{\insrsid1246294\charrsid9068287 permissive}{ \insrsid10319647\charrsid9068287 not }{\insrsid1246294\charrsid9068287 mandatory for a respondent}{\insrsid10319647\charrsid9068287 to file a Notice of appeal}{\insrsid1246294\charrsid9068287 but not a Memorandum of Cross-Appeal. Under O.58 r }{ \insrsid12006399\charrsid9068287 7 of }{\insrsid10319647\charrsid9068287 that RSC it was sufficient if such Notice was given within }{\insrsid1246294\charrsid9068287 8 days of the appeal being heard}{\insrsid10319647\charrsid9068287 . }{ \insrsid2691551\charrsid9068287 \par }{\insrsid10319647\charrsid9068287 In my view the issue raised by Mr. Atare still stan}{\insrsid2691551\charrsid9068287 ds. It is the question of paym}{\insrsid10319647\charrsid9068287 ent}{\insrsid2691551\charrsid9068287 of fee in filing such a Notice.} {\insrsid10319647\charrsid9068287 Section 2 of the Civil Procedure Act defines suit so widely as}{\insrsid2691551\charrsid9068287 to cover even Notice of Cross-Appeal}{\insrsid10319647\charrsid9068287 . As such payment of appropriate fee on filing it is necessary. It is an established law of this country that no document is properly filed in court until appropriate filing fees have been paid. See }{\b\ul\insrsid2691551\charrsid9068287 UNTA Export Ltd \endash vs-}{ \b\ul\insrsid10319647\charrsid9068287 Custom (1970) EA 648 :}{\b\ul\insrsid2691551\charrsid9068287 }{\b\ul\insrsid10319647\charrsid9068287 and}{\b\ul\insrsid2691551\charrsid9068287 Margaret}{\b\ul\insrsid10319647\charrsid9068287 Mu}{ \b\ul\insrsid2691551\charrsid9068287 sango -vs- Francis Mugongo}{\b\ul\insrsid10319647\charrsid9068287 (1979) (HCB) 226}{\ul\insrsid10319647\charrsid9068287 .}{\insrsid10319647\charrsid9068287 In }{\b\ul\insrsid2691551\charrsid9068287 Margaret Musango \rquote s}{\b\ul\insrsid10319647\charrsid9068287 case}{\insrsid10319647\charrsid9068287 , the appellant who was allowed to appeal out of time, lodged his Memorandum of the appeal in time but due to lack of Receipt book with the court Registry, be did not pay the filing fee until two days out of time. It was held that}{ \insrsid11743226\charrsid9068287 the appeal was not properly filed until }{\insrsid10319647\charrsid9068287 when the fee was }{\insrsid11743226\charrsid9068287 paid}{\insrsid10319647\charrsid9068287 . Hence that appeal was out of }{ \insrsid11743226\charrsid9068287 time. \par }{\insrsid10319647\charrsid9068287 In the instant case, Notice of}{\insrsid11743226\charrsid9068287 }{\insrsid10319647\charrsid9068287 the }{\insrsid11743226\charrsid9068287 Cross-}{\insrsid10319647\charrsid9068287 Appeal was }{ \insrsid11743226\charrsid9068287 lodged with the court on 26.6.1991 and because the file was}{\insrsid10319647\charrsid9068287 already with the Judge, filing fee was not paid on }{\insrsid11743226\charrsid9068287 the Notice. \par }{\insrsid10319647\charrsid9068287 Following the authorities cited above, the Respondent who }{\insrsid11743226\charrsid9068287 decides to file a Notice of Cross-}{\insrsid10319647\charrsid9068287 Appeal must p}{\insrsid11743226\charrsid9068287 ay the necessary filing fee for}{\insrsid10319647\charrsid9068287 it. Considering the fact that the Respondent was }{\insrsid11743226\charrsid9068287 served}{\insrsid10319647\charrsid9068287 with the M}{\insrsid11743226\charrsid9068287 emorandum of the appeal when }{\insrsid10319647\charrsid9068287 the hearing of the appeal had started thus necessitating the late pres}{\insrsid11743226\charrsid9068287 entation of the Notice of cross-}{\insrsid10319647\charrsid9068287 Appeal, the Respondent is allowed un}{\insrsid11743226\charrsid9068287 der section 100 of the Civil Procedure Act }{\insrsid10319647\charrsid9068287 to pa}{\insrsid11743226\charrsid9068287 y the appropriate filing fee on the Notice. \par }{\insrsid10319647\charrsid9068287 I now revert to consider the procedure in which the original application the ruling in which is the }{\insrsid11743226\charrsid9068287 subject}{\insrsid10319647\charrsid9068287 matter of this appeal was brought to court. There was a \line dispute between the appellant and the respondent as to which the two is the rightful allocatee of a D. A. P. C. B building }{\insrsid11743226\charrsid9068287 on Plot No. M35B on }{ \insrsid10319647\charrsid9068287 Atwal Road in Gulu}{\insrsid11743226\charrsid9068287 }{\insrsid10319647\charrsid9068287 Munici}{\insrsid11743226\charrsid9068287 pal}{\insrsid10319647\charrsid9068287 ity. The Applicant/Re}{ \insrsid11743226\charrsid9068287 spondent brought an application by a Notice of Motion under O.48 r 1 C. P. R; section 220 }{\insrsid10319647\charrsid9068287 of the M. C.}{\insrsid11743226\charrsid9068287 A, 1970 }{\insrsid10319647\charrsid9068287 and under the inh}{\insrsid11743226\charrsid9068287 erent jurisdiction of the court under section }{\insrsid10319647\charrsid9068287 101 of the Civil Procedure Act. In the applicati}{\insrsid11743226\charrsid9068287 on the appl}{ \insrsid10319647\charrsid9068287 icant sought a declaratory ruling determining the dispute between the parties. I am of the view that the procedure adopted in bringing this application to court was }{\insrsid11743226\charrsid9068287 fundamentally wrong as O.48 r 1}{\insrsid10319647\charrsid9068287 }{\insrsid11743226\charrsid9068287 C.}{\insrsid10319647\charrsid9068287 P. R}{\i\insrsid10319647\charrsid9068287 }{\insrsid10319647\charrsid9068287 was used as if it was an originating Motion and the section 101 of the Civil Procedure Act was called to play in a situation where the law provides a remedy. }{\insrsid11743226\charrsid9068287 This in my view is illegality. \par }{\insrsid10319647\charrsid9068287 It is the right and duty of a court to consider illegality at any stage. It is true an appellate court must be }{\insrsid11743226\charrsid9068287 cautious}{\insrsid10319647\charrsid9068287 and consider whether the illegality }{\insrsid11743226\charrsid9068287 is sufficiently proved. }{\b\ul\insrsid11743226\charrsid9068287 (See Halram Singh vs. S. Singh Dhiman}{\b\ul\insrsid10319647\charrsid9068287 (1955)}{ \b\i\ul\insrsid10319647\charrsid9068287 }{\b\ul\insrsid10319647\charrsid9068287 18 EACA 75).}{\insrsid9502945\charrsid9068287 \par }{\insrsid10319647\charrsid9068287 I think it is also the duty of the court as the legal protector of all persons and legal }{\insrsid12006399\charrsid9068287 custodian}{\insrsid10319647\charrsid9068287 of the rights of all person}{ \insrsid12006399\charrsid9068287 s in its jurisdiction consider illegality}{\insrsid10319647\charrsid9068287 which could be exploited by a Party to result into unfair enrichment.
