Brian Indiazi Kivisi v Republic [2018] KEHC 9832 (KLR)

Full Case Text

REPUBLIC OF KENYA

IN THE HIGH COURT OF KENYA AT NAIROBI

CRIMINAL DIVISION

CRIMINAL REVISION NO. 830 OF 2018

BRIAN INDIAZI KIVISI....................................APPLICANT

VERSUS

REPUBLIC.......................................................RESPONDENT

RULING

The bond terms are not only commensurate with the offence but are lenient.  The Applicant was allegedly armed with a pistol and he faces a second count of being in possession of a firearm.  Although he is presumed innocent until proved guilty, the seriousness of the offence also determines the bond terms.  I am disinclined, in the circumstances to vary the bond terms.

The application dated 27/9/2018 is accordingly dismissed.

DATED and DELIVERED this 13th day of November, 2018
