Cause\hich\af41\dbch\af38\loch\f41 No. 4/2010) }{\f41\fs28\insrsid8917018 \hich\af41\dbch\af38\loch\f41 and }{ \b\f41\fs28\insrsid8917018 \hich\af41\dbch\af38\loch\f41 Titus Atugonza Vs Attorney General & 5 Others }{\f41\fs28\insrsid8917018 \hich\af41\dbch\af38\loch\f41 and similar questions had been }{\f41\fs28\insrsid11539267 \hich\af41\dbch\af38\loch\f41 framed for reference}{\f41\fs28\insrsid8917018 \hich\af41\dbch\af38\loch\f41 to this Court}{\f41\fs28\insrsid16198728 \hich\af41\dbch\af38\loch\f41 and whose outcome still remained unknown}{\f41\fs28\insrsid8917018 \hich\af41\dbch\af38\loch\f41 . \par }{\f41\fs28\insrsid13788416 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid11539267 {\f41\fs28\insrsid11539267 \hich\af41\dbch\af38\loch\f41 Mr. Adrole Richard, a }{\f41\fs28\insrsid13788416 \hich\af41\dbch\af38\loch\f41 State Attorney }{\f41\fs28\insrsid11539267 \hich\af41\dbch\af38\loch\f41 appeared for the Petitioner whil}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 e Mr. Ladis}{\f41\fs28\insrsid11539267 \hich\af41\dbch\af38\loch\f41 laus \hich\af41\dbch\af38\loch\f41 Rwakafuuzi represented the Respondent.}{\f41\fs28\insrsid13788416 \par }{\f41\fs28\insrsid11539267 \par \hich\af41\dbch\af38\loch\f41 The case for the Petitioner as stated by Mr. Adrole is that Article 50 (4) of the Constitution specifically provides that Parliament shall make laws for enforcement of the rights and freedoms in Chapter four of the \hich\af41\dbch\af38\loch\f41 Constitution. \par \par \hich\af41\dbch\af38\loch\f41 Therefore, in making Statutory Instrument 55/08 which clearly provides for the enforcement of the rights and freedoms under Article 50 of the Constitution, the Rules Committee usurped the powers of Parliament.}{ \b\f41\fs28\insrsid11539267 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13788416 {\f41\fs28\insrsid7758164 \par \hich\af41\dbch\af38\loch\f41 He }{\f41\fs28\insrsid15075297 \hich\af41\dbch\af38\loch\f41 further }{\f41\fs28\insrsid7758164 \hich\af41\dbch\af38\loch\f41 reasoned that the J\hich\af41\dbch\af38\loch\f41 udicature Act, Cap 13 under which the S.1 was made is not a law for enforcement of rights and freedoms. It is a law intended to consolidate and revise the Judicature Act to take account of the provisions of the Constitution relating to the Judiciary. Th \hich\af41\dbch\af38\loch\f41 e\hich\af41\dbch\af38\loch\f41 Judicature Act was made in obedience to Article 150 (1) of the Constitution and not Article 50.}{\f41\fs28\insrsid13788416 \par }{\f41\fs28\insrsid7758164 \par \hich\af41\dbch\af38\loch\f41 To illustrate this point, Mr. Adrole pointed out that whereas the Constitutional (Petitions and References) Rules were also made by the Rules Committee under \hich\af41\dbch\af38\loch\f41 Section 41 of the Judicature Act}{ \f41\fs28\insrsid8271754 \hich\af41\dbch\af38\loch\f41 ,}{\f41\fs28\insrsid7758164 \hich\af41\dbch\af38\loch\f41 it must be noted that unlike Article 50 (4), Article 137 of the Constitution}{\f41\fs28\insrsid15075297 \hich\af41\dbch\af38\loch\f41 }{ \f41\fs28\insrsid7758164 \hich\af41\dbch\af38\loch\f41 which confers jurisdiction on the Constitutional Court does not impose the mandatory requirement for Parliament to enact law}{\f41\fs28\insrsid15075297 \hich\af41\dbch\af38\loch\f41 s}{ \f41\fs28\insrsid7758164 \hich\af41\dbch\af38\loch\f41 for the interpretat\hich\af41\dbch\af38\loch\f41 ion of the Constitution by this Court. \par }{\f41\fs28\insrsid12201349 \par }{\f41\fs28\insrsid2760183 \hich\af41\dbch\af38\loch\f41 He prayed Court to find that by enacting the impugned Rules, the Rules Committee contravened Article 50 (4) of the Constitution. \par \par }{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 In reply, }{\f41\fs28\insrsid10038252 \hich\af41\dbch\af38\loch\f41 Mr. Rwakafuuzi contended that the Rules Committee acted within its powers un\hich\af41\dbch\af38\loch\f41 der S.41 of the Judicature Act in making the Rules. \par \par \hich\af41\dbch\af38\loch\f41 Article 139 (1) of the Constitution confers unlimited original jurisdiction upon the High Court in all matters, including enforcement of fundamental rights and freedoms enshrined in Articles 20 \hich\f41 \endash \loch\f41 45 of t\hich\af41\dbch\af38\loch\f41 he Constitution. By providing the procedure by which the High Court may exercise its original jurisdiction, the Rules Committee acted within its powers to make rules of procedure including the rules for enforcement of the rights and freedoms guaranteed i \hich\af41\dbch\af38\loch\f41 n\hich\af41\dbch\af38\loch\f41 Articles 20 \hich\f41 \endash \loch\f41 45. \par \par \hich\af41\dbch\af38\loch\f41 He further argued that Parliament cannot make rules}{\f41\fs28\insrsid16198728 \hich\af41\dbch\af38\loch\f41 nor can the }{\f41\fs28\insrsid10038252 \hich\af41\dbch\af38\loch\f41 Rules Committee make laws, and did not purport to make laws for enforcement of fundamental freedoms and rights by making Statutory Instrument 55/08. \par \par \hich\af41\dbch\af38\loch\f41 Even if the Rules C\hich\af41\dbch\af38\loch\f41 ommittee was not empowered to make the said Rules}{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 as alleged,}{\f41\fs28\insrsid10038252 \hich\af41\dbch\af38\loch\f41 the Committee was in fact acting in further}{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 ance}{\f41\fs28\insrsid10038252 \hich\af41\dbch\af38\loch\f41 of the Constitution. To do so,}{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 according to him,}{\f41\fs28\insrsid10038252 \hich\af41\dbch\af38\loch\f41 is not acting unconstitutionally. \par \par \hich\af41\dbch\af38\loch\f41 He prayed that the question be answered in the negative}{\f41\fs28\insrsid14306707 \hich\af41\dbch\af38\loch\f41 so th\hich\af41\dbch\af38\loch\f41 at the several matters pending before the High Court can be determined finally.}{\f41\fs28\insrsid10038252 \par }{\f41\fs28\insrsid14306707 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid5117538 {\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 In rejoinder, Mr. Adrole re}{\f41\fs28\insrsid4473035 \hich\af41\dbch\af38\loch\f41 -}{ \f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 asserted his position and a}{\f41\fs28\insrsid4549587 \hich\af41\dbch\af38\loch\f41 r}{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 g}{\f41\fs28\insrsid4549587 \hich\af41\dbch\af38\loch\f41 ue}{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 d that the power of the Rules Committee to make laws is not in contention. What is in contention is the power of th\hich\af41\dbch\af38\loch\f41 e Rules Committee to make laws where the mandate is for Parliament under Article 50 (4) and not the Rules Committee. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13788416 {\f41\fs28\insrsid5117538 \par }{\f41\fs28\insrsid6885820 \hich\af41\dbch\af38\loch\f41 Our duty in this ref}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 erence is to interpret Article 50 (4) of the Constitution to answer the above questions one way or the other. In so d \hich\af41\dbch\af38\loch\f41 oing, we must bear in mind the guiding Constitutional interpretation }{\f41\fs28\insrsid8271754 \hich\af41\dbch\af38\loch\f41 principles which are}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 to the effect that the Constitution is to be looked at as a whole. It has to be read as an integrated whole with no o}{\f41\fs28\insrsid8271754 \hich\af41\dbch\af38\loch\f41 ne}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 particular provision destroying another but s\hich\af41\dbch\af38\loch\f41 upporting }{\f41\fs28\insrsid8271754 \hich\af41\dbch\af38\loch\f41 each}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 other. All provisions concerning an issue should be considered together to give effect to the purpose of the Instrument. See }{\b\f41\fs28\insrsid10621462\charrsid10621462 \hich\af41\dbch\af38\loch\f41 Dr. James Rwanyarare & Others Vs Attorney General Constitution Petition No. 7 of 2002}{\f41\fs28\insrsid10621462 \hich\af41\dbch\af38\loch\f41 .}{\f41\fs28\insrsid6885820 \par }{\f41\fs28\insrsid10621462 \par }{\f41\fs28\insrsid13655281 \hich\af41\dbch\af38\loch\f41 S.1 55/08 was made by the \hich\af41\dbch\af38\loch\f41 Rules Committee on the 26}{\f41\fs28\super\insrsid13655281\charrsid13655281 \hich\af41\dbch\af38\loch\f41 th}{\f41\fs28\insrsid13655281 \hich\af41\dbch\af38\loch\f41 day of February, 2008, in exercise of the powers conferred upon the Committee by Section 41 (1) of the Judicature Act which provides that: \par \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid13655281 {\b\f41\fs28\insrsid13655281\charrsid13655281 \loch\af41\dbch\af38\hich\f41 \'93\loch\f41 The Rules Committee may, by statutory instrument, make rules for regulating the practic\hich\af41\dbch\af38\loch\f41 \hich\f41 e and procedure of the Supreme Court, the Court of Appeal and the High Court of Uganda and for all other Courts in Uganda subordinate to the High Court.\'94 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13788416 {\f41\fs28\insrsid7758164 \par }{\f41\fs28\insrsid13655281 \hich\af41\dbch\af38\loch\f41 The long title of the Judicature Act, Cap 13 states that it is:}{\f41\fs28\insrsid7758164 \par }{\f41\fs28\insrsid13655281 \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid13655281 {\b\f41\fs28\insrsid13655281\charrsid14306707 \loch\af41\dbch\af38\hich\f41 \'93\loch\f41 An Act to consolidate and revise th \hich\af41\dbch\af38\loch\f41 \hich\f41 e Judicature Act to take account of the provisions of the Constitution relating to the Judiciary\'94 \par }{\f41\fs28\insrsid13655281 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13655281 {\f41\fs28\insrsid13655281 \hich\af41\dbch\af38\loch\f41 The provisions of the Constitution relating to the Judiciary are found in Chapter eight of the Constitution. \par \par \hich\af41\dbch\af38\loch\f41 Article 150 (1) which falls under Chapter 8 pro\hich\af41\dbch\af38\loch\f41 vides that: \par \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid13655281 {\b\f41\fs28\insrsid13655281\charrsid14306707 \loch\af41\dbch\af38\hich\f41 \'93\loch\f41 (1) subject to the provision of this Constitution, Parliament may make laws providing }{\b\f41\fs28\insrsid4473035 \hich\af41\dbch\af38\loch\f41 f}{\b\f41\fs28\insrsid13655281\charrsid14306707 \hich\af41\dbch\af38\loch\f41 \hich\f41 or the structures, procedures, and functions of the Judiciary.\'94 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid13655281 {\f41\fs28\insrsid13655281 \par }{\f41\fs28\insrsid10571371 \hich\af41\dbch\af38\loch\f41 The Rules Committee therefore derives }{\f41\fs28\insrsid8271754 \hich\af41\dbch\af38\loch\f41 its}{\f41\fs28\insrsid10571371 \hich\af41\dbch\af38\loch\f41 powers to make rules from Article 150 (1) of the\hich\af41\dbch\af38\loch\f41 Constitution. The Rules are }{\f41\fs28\insrsid5117538 \hich\af41\dbch\af38\loch\f41 for}{\f41\fs28\insrsid10571371 \hich\af41\dbch\af38\loch\f41 regulating the practice and procedure in the Judiciary.}{\f41\fs28\insrsid13655281 \par }{\f41\fs28\insrsid10571371 \par \hich\af41\dbch\af38\loch\f41 However, applications from which this reference arose were made under Article 50 of the Constitution.
