Application No. 678/2009}{\insrsid13834412\charrsid7166526 . The said order reads;}{ \insrsid16327871\charrsid7166526 \par }{\b\insrsid13834412\charrsid7166526 \'93A temporary injunction is hereby issued restraining the Respondent}{\b\insrsid13006025\charrsid7166526 s, their agents, servants, successors in title, assigns or representatives from using the newly registered Trademark Registration No. 2009}{\b\insrsid9974089\charrsid7166526 /}{\b\insrsid13006025\charrsid7166526 40/21 SUPERMATCH whose logo , trade dress, design, layout and colours appear confusingly similar or closely resembles that of the Applicant\rquote s SPORTSMAN trademark, pending final determination of High Court Civil Suit No. 445 of 2009\'94. \par }{\insrsid411450\charrsid7166526 \par }{\insrsid13006025\charrsid7166526 }{\insrsid16605807\charrsid7166526 The respondents filed a Notice of Appeal to this court with the application seeking an interim order for stay of execution pending a substantive application before a full bench. \par }{\insrsid5012306\charrsid7166526 \par }{\insrsid16605807\charrsid7166526 Before the hearing commenced}{\insrsid411450\charrsid7166526 ,}{\insrsid16605807\charrsid7166526 Mr. }{\insrsid11630769\charrsid7166526 Christopher }{\insrsid16605807\charrsid7166526 Madrama}{ \insrsid5012306\charrsid7166526 , learned counsel for }{\insrsid15205916\charrsid7166526 the }{\insrsid13006025\charrsid7166526 applicant raised three preliminary objections in points of law}{\insrsid11630769\charrsid7166526 , only two of which are relevant to this reference namely that: \par {\listtext\pard\plain\insrsid11630769\charrsid7166526 \hich\af0\dbch\af0\loch\f0 a)\tab}}\pard \qj \fi-360\li795\ri0\sl360\slmult1\widctlpar\jclisttab\tx795\aspalpha\aspnum\faauto\ls4\adjustright\rin0\lin795\itap0\pararsid7166526 { \insrsid11630769\charrsid7166526 The registrar had no jurisdiction in as far as the application had been brought under }{\b\insrsid11630769\charrsid7166526 Rule 53(1)}{\insrsid11630769\charrsid7166526 which gives power to a single judge to hear such applications; \par {\listtext\pard\plain\insrsid11630769\charrsid7166526 \hich\af0\dbch\af0\loch\f0 b)\tab}That the order o}{\insrsid411450\charrsid7166526 f}{\insrsid11630769\charrsid7166526 the High Court was not capable of being executed and thus no order of stay can issue against it. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7166526 {\insrsid11630769\charrsid7166526 The learned Registrar overruled the objections and ordered that the application proceed. However}{ \insrsid411450\charrsid7166526 ,}{\insrsid11630769\charrsid7166526 Mr. Madrama objected and applied for a reference. Hence this reference to a single justice. \par Mr. }{\insrsid5012306\charrsid7166526 Madrama addressed me at }{\insrsid15205916\charrsid7166526 great length }{\insrsid411450\charrsid7166526 often}{\insrsid15205916\charrsid7166526 del}{\insrsid411450\charrsid7166526 v}{ \insrsid15205916\charrsid7166526 ing }{\insrsid411450\charrsid7166526 into}{\insrsid15205916\charrsid7166526 the substantive issues of the main application. I will nonetheless confine myself to what I consider pertinent to the application before the Registrar. \par \par Learned counsel contended that the Registrar had no jurisdiction to entertain the application before him because an order of stay would interfere with the judgement of the High Court. \par In his view}{\insrsid13834412\charrsid7166526 }{\insrsid15205916\charrsid7166526 an order for an injunction }{\insrsid1391926\charrsid7166526 is absolute and }{\insrsid15205916\charrsid7166526 takes immediate effect. Th erefore it cannot be stayed and can only }{\insrsid1391926\charrsid7166526 be }{\insrsid15205916\charrsid7166526 set aside. He }{\insrsid1391926\charrsid7166526 cited several authorities amongst which are}{\insrsid733440\charrsid7166526 }{ \b\insrsid733440\charrsid7166526 Knight and Another Vs Chiftan & Ors (1971)2 ALL ER. 380}{\insrsid733440\charrsid7166526 }{\b\insrsid733440\charrsid7166526 at 381}{\insrsid411450\charrsid7166526 }{\insrsid733440\charrsid7166526 and especially }{ \b\insrsid733440\charrsid7166526 Hastens Transport (St. Helena) Ltd Vs Transport and General Workers Union...(1972) 3 ALL E. R}{\b\insrsid1391926\charrsid7166526 101.}{\insrsid733440\charrsid7166526 }{\insrsid1391926\charrsid7166526 H}{ \insrsid733440\charrsid7166526 e asked me to deduce from the }{\insrsid1391926\charrsid7166526 said authorities}{\insrsid733440\charrsid7166526 that an injunction takes effect immediately and }{\insrsid411450\charrsid7166526 cannot be executed. \par }{\insrsid733440\charrsid7166526 He submitted that in view of the foregoing}{\insrsid411450\charrsid7166526 ,}{\insrsid733440\charrsid7166526 there is no order capable of execution }{\insrsid411450\charrsid7166526 in the instant application }{ \insrsid733440\charrsid7166526 and consequently an interim order of stay of execution would not be required. }{\insrsid1391926\charrsid7166526 The}{\insrsid1205994\charrsid7166526 interim order of the Registrar purporting to stay }{ \insrsid1391926\charrsid7166526 an}{\insrsid1205994\charrsid7166526 order of a temporary injunction }{\insrsid1391926\charrsid7166526 would}{\insrsid1205994\charrsid7166526 not }{\insrsid13793577\charrsid7166526 only }{\insrsid1391926\charrsid7166526 be }{\insrsid13793577\charrsid7166526 ultra vires P}{\insrsid1205994\charrsid7166526 ractice }{\insrsid13793577\charrsid7166526 D}{\insrsid1205994\charrsid7166526 irections No. 1 of 2004}{\insrsid13793577\charrsid7166526 but is }{ \insrsid3227696\charrsid7166526 also }{\insrsid13793577\charrsid7166526 without jurisdiction.}{\insrsid411450\charrsid7166526 It is not one of those orders envisaged by the Practice Direction.}{\insrsid3227696\charrsid7166526 It}{ \insrsid13793577\charrsid7166526 }{\insrsid411450\charrsid7166526 would }{\insrsid13793577\charrsid7166526 interfere with the High Court judgement}{\insrsid3227696\charrsid7166526 which it}{\insrsid411450\charrsid7166526 would }{ \insrsid13793577\charrsid7166526 reverse}{\insrsid3227696\charrsid7166526 , }{\insrsid411450\charrsid7166526 since it took effect immediately }{\insrsid13793577\charrsid7166526 upon pronouncement of the judgement. }{\insrsid3227696\charrsid7166526 The }{ \insrsid13793577\charrsid7166526 Practice Direction No. 1 of 2004 does not vest the Registrar or even a single judge with powers to grant the interim order of stay. That power resides in the full bench.}{\insrsid3227696\charrsid7166526 }{ \b\insrsid3227696\charrsid7166526 \endash East African General Insurance Co. Ltd V Mambhai Patel & 2others C. A Civil Application No. 14 of 2001.}{\b\insrsid13793577\charrsid7166526 \par }{\insrsid13793577\charrsid7166526 An order of stay of execution can only be granted where the order sought to be stayed is capable of execution in any of the ways prescribed under Section 38}{\insrsid411450\charrsid7166526 of the Civil Procedure Act, which concerns an order not yet implemented or executed.}{\insrsid13793577\charrsid7166526 \par }{\insrsid411450\charrsid7166526 \par }{\insrsid13793577\charrsid7166526 Mr. Madrama }{\insrsid411450\charrsid7166526 submitted}{\insrsid13793577\charrsid7166526 that it is anomalous that a Registrar who is supposed to support the powers of a single judge c}{\insrsid411450\charrsid7166526 ould}{\insrsid13793577\charrsid7166526 have more powers than the judge. \par A single judge has no powers or jurisdiction to entertain an application for an interim order of stay of an order of a temporary injunction. \par }{\b\insrsid13793577\charrsid7166526 Rules 53, 6(2) (b) and 2(2)}{\insrsid13793577\charrsid7166526 under which the application was brought apply to a single judge.}{\insrsid14449930\charrsid7166526 However, the Registrar may make an interim order where it does not interfere with the judgement. \par He prayed court to uphold grounds 1 and 2 and dismiss the application for stay of execution for want of jurisdiction. \par }{\insrsid411450\charrsid7166526 \par }{\insrsid14449930\charrsid7166526 Ground No. 3 was in the alternative that the Registrar erred to entertain an application for stay of execution made first to the Court of Appeal when it should have}{\insrsid3227696\charrsid7166526 first}{ \insrsid14449930\charrsid7166526 been made }{\insrsid411450\charrsid7166526 before}{\insrsid14449930\charrsid7166526 the High Court. No exceptional grounds had been shown for adopting that procedure. He cited }{\b\insrsid14449930\charrsid7166526 Francis Mansi Micah Vs Nuwa Walakira S. C. C. Application No. 9 of 1990}{\insrsid14449930\charrsid7166526 , and }{\b\insrsid14449930\charrsid7166526 National Pharmacy Limited Vs Kampala City Council (1979) HCB 132. \par }{\insrsid14449930\charrsid7166526 \par In reply}{\insrsid411450\charrsid7166526 ,}{\insrsid14449930\charrsid7166526 Mr. Kabiito Karamagi for the respondents opposed all the grounds advanced by Mr. Madrama. He observed that much of the arguments }{\insrsid3227696\charrsid7166526 advanced }{ \insrsid14449930\charrsid7166526 ought to have been made before }{\insrsid411450\charrsid7166526 the}{\insrsid14449930\charrsid7166526 full bench. The Registrar ought to have been given a chance to rule on the application on its merits. \par }{\insrsid9587487\charrsid7166526 \par }{\insrsid5012306\charrsid7166526 Regarding G}{\insrsid14449930\charrsid7166526 round 1}{\insrsid9587487\charrsid7166526 Mr. Kabiito asserted that the Practice Directions does not impose such limitations as is apparent on its face. \par The order bef}{\insrsid4340128\charrsid7166526 ore the Registrar is executable }{\insrsid9587487\charrsid7166526 \endash }{\insrsid4340128\charrsid7166526 }{\b\insrsid9587487\charrsid7166526 O.41 rule 2(3)}{\insrsid9587487\charrsid7166526 allows court to attach property or arrest a person who disobeys court orders. \par That prohibitive orders take immediate effect is superfluous; Mr. Kabiito contended all judgements once delivered take immediate effect unless otherwise directed in the judgement. \par The Practice Direction gives powers to the registrar to attend to applications of an interim }{\insrsid411450\charrsid7166526 nature}{\insrsid9587487\charrsid7166526 under }{\b\insrsid9587487\charrsid7166526 Rule 6}{\insrsid9587487\charrsid7166526 . These interim orders are given un}{\insrsid4088944\charrsid7166526 der }{\insrsid9587487\charrsid7166526 compelling circumstances \endash }{\b\insrsid9587487\charrsid7166526 Wilson Mukiibi Vs James Semusambwa SC Civil Application No. 9 of 2003}{ \insrsid9587487\charrsid7166526 pp. 2 and 3.}{\insrsid14449930\charrsid7166526 \par }{\insrsid5012306\charrsid7166526 \par }{\insrsid9587487\charrsid7166526 Learned counsel argued that an interim order is not a substitute to the main application and should be given by a single judge in exercise of }{\insrsid4088944\charrsid7166526 the }{\insrsid9587487\charrsid7166526 inherent powers to prevent justice being defeated. \par He rejected}{\insrsid4088944\charrsid7166526 the argument that the Practice Direction}{\insrsid9587487\charrsid7166526 gives more powers to the registrar than a single justice. \par The Directions only allow the Registrar to attend to interim applications under the inherent powers of the court to assist in the administration of justice.}{\insrsid2846561\charrsid7166526 He observed that the preliminary objections raised centered on the prayer for an injunction}{\insrsid4088944\charrsid7166526 , ignoring the rest of the judgement}{\insrsid2846561\charrsid7166526 . \par He submitted that }{\insrsid4088944\charrsid7166526 t}{\insrsid2846561\charrsid7166526 his court recognizes the power of the registrar to grant interim orders of injunction and stay of execution. \par }{\b\insrsid2846561\charrsid7166526 - Mandela Auto Spares V Marketing Information Systems Ltd CA Ref. No. 74 of 2008and Tropical Bank CA Ref. No. 64 of 2009. }{\insrsid9587487\charrsid7166526 \par }{\insrsid2846561\charrsid7166526 \par Regarding Ground No.3 Mr. Kabiito pointed out that exceptional ground}{\insrsid4088944\charrsid7166526 s}{\insrsid2846561\charrsid7166526 did not have to be pleaded as they were of a legal nature. They would go to the merit of the application and would be addressed before a full bench. The High Court granted an injunction and the respondent }{\insrsid4088944\charrsid7166526 had }{ \insrsid2846561\charrsid7166526 also applied for an injunction. Under the circumstances it was best to come to this court for such prayer. These matters would not be addressed by the Registrar \endash }{\b\insrsid2846561\charrsid7166526 Wilson Mukiibi V James Semusambwa (supra). \par }{\insrsid2846561\charrsid7166526 \par In rejoinder Mr. Madrama reiterated his earlier submissions that an order which takes immediate effect cannot be stayed, but can }{\insrsid5602880\charrsid7166526 only be set aside}{\insrsid4088944\charrsid7166526 ,}{\insrsid5602880\charrsid7166526 citing }{\b\insrsid5602880\charrsid7166526 Sergeant V Patel (1949) 16 EACA 63}{\insrsid5602880\charrsid7166526 . That the Registrar\rquote s order would interfere with the High Court judgement.}{\insrsid2846561\charrsid7166526 \par }{\insrsid3227696\charrsid7166526 \par I consider it necessary to reproduce }{\b\insrsid5602880\charrsid7166526 The Court of Appeal (Judicial Powers of Registrars) Practice Direction No. 1 of 2004 }{\b\insrsid3227696\charrsid7166526 which }{\b\insrsid5602880\charrsid7166526 reads}{ \insrsid5602880\charrsid7166526 : \par }{\i\insrsid5602880\charrsid7166526 \tab \'93Pursuant to the Court of Appeal Rules Directions 1996 made under Section 41(1) (v) of the Judicature Act, 2000 , and in order to ensure expeditious disposal of cases, the powers of Registrars shall include, but not be limited to entertaining matters under the following rules. \par 1\'85\'85\'85\'85\'85\'85. \par 2\'85. Rule 5 \endash Applications for interim orders\'85\'85..\'94 \par \par }{\insrsid3227696\charrsid7166526 Under S}{\insrsid5602880\charrsid7166526 ection 41 of the Judicature Act the Rules committee is empowered to make rules for regulating the practice and procedure of the courts and}{\insrsid3227696\charrsid7166526 thus }{ \insrsid5602880\charrsid7166526 assign special duties }{\insrsid3227696\charrsid7166526 to officers of the court in order to expedite court business}{\insrsid4088944\charrsid7166526 .}{\insrsid4866327\charrsid7166526 Hence Practice Direction No. 1 of 2004 which mandates a Registrar to entertain applications for interim orders.}{\insrsid5602880\charrsid7166526 \par \par An interim order }{\insrsid4088944\charrsid7166526 therefore }{\insrsid5602880\charrsid7166526 should not be confused with a substantive application for stay }{\insrsid15803486\charrsid7166526 of execution as is often the case. The two are quite dist}{ \insrsid4088944\charrsid7166526 inct}{\insrsid15803486\charrsid7166526 . The distinction was succinctly }{\insrsid4088944\charrsid7166526 spelt out }{\insrsid15803486\charrsid7166526 by Mulenga JSC in }{\b\insrsid15803486\charrsid7166526 Wilson Mukiibi V James Semusambwa S. C Civil Application No. 9 of 2003}{\insrsid15803486\charrsid7166526 thus;}{\insrsid5602880\charrsid7166526 \par }{\i\insrsid15803486\charrsid7166526 \'93\'85\'85\'85\'85..invoking that interim procedure must neither be taken as an alternative to or substitute for the procedure for obtaining a stay, which is envisaged under }{\b\i\insrsid15803486\charrsid7166526 s ub-rule (2)}{\i\insrsid15803486\charrsid7166526 nor should it be used to negative the import of that sub-rule. The interim order ought to be made only in compelling circumstances, to prevent defeat of justice, and }{\i\insrsid4088944\charrsid7166526 strictly}{\i\insrsid15803486\charrsid7166526 pending ascertained hearing of a substantive application by the full Court\'94. \par }\pard \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid7166526 {\b\insrsid15803486\charrsid7166526 Sub-rule (2}{\insrsid15803486\charrsid7166526 ) of rule 49 of the Rules of the Supreme Court excludes inter} {\insrsid4866327\charrsid7166526 -}{\insrsid15803486\charrsid7166526 alia an application for a stay of execution. This is p}{\insrsid4088944\charrsid7166526 a}{\insrsid15803486\charrsid7166526 ri materia rule 53 of the Rules of this Court. \par }{\insrsid4866327\charrsid7166526 Nonetheless t}{\insrsid15803486\charrsid7166526 he Registrar is empowered only to weigh the circumstances of the application and to ascertain }{\insrsid4088944\charrsid7166526 whether}{\insrsid15803486\charrsid7166526 the process is not likely to be abused as is often the case and that the application is made in good faith. Delving into the substantive issues}{\insrsid3762813\charrsid7166526 }{\insrsid15803486\charrsid7166526 is beyond the Registrar\rquote s mandate} {\insrsid3762813\charrsid7166526 .}{\insrsid15803486\charrsid7166526 \par }{\insrsid3762813\charrsid7166526 \par With the above in mind, Mr. Madrama\rquote s contention that the Registrar had no jurisdiction to entertain the present application on ground that an injunction is unexecutable }{\insrsid4866327\charrsid7166526 is unsustainable}{ \insrsid3762813\charrsid7166526 .
