COURT RULING
The plaintiff Cecil Miller seeks from this court by an application dated 12th April 2016 an injunction restraining the defendants Jackson Njeru and Jackline Okuta whether by themselves, their agents and or servants from posting on face book or any other media plat form, commenting, writing or providing any platform for comments by the general public about the plaintiff/applicant on any media platform pending the hearing and determination of the suit. He also seeks for costs.
The application is supported by the affidavit of Cecil Miller the applicant sworn on 12th April 2016 which also annexes copies of the impugned social media (face book) postings of and concerning the plaintiff/applicant by the defendants and their associates in the social media.
The application is not opposed. On 12th April 2016, Honourable Mbogholi Msagha did grant exparte interlocutory order of injunction against the defendants pending interpartes hearing of the application.
The matter is before me for interpartes hearing but so far the defendants have not filed any replying affidavits or grounds of opposition. Neither are they in court to state their position on the matter. The plaintiff/applicant’s counsel has urged this court to confirm the interim orders on record.
In the premise, I hereby grant to the plaintiff/ applicant Cecil Miller an injunction restraining the defendants Jackson Njeru and Jackline Okuta, their agents, servants or representatives from posting on face book or any other media platform, comments, writing or providing any plat form for comments by the general public about(concerning the plaintiff /applicant pending the hearing and determination of the suit herein.
The plaintiff/applicant shall have costs of the application.
