1. Upon perusal of the chamber summons dated 3. 10. 24, the statement of facts of even date, the amended statement of facts and the verifying affidavit I do hereby allow the application and? Make the following orders:-1. The ex parte applicant is hereby granted leave to apply for orders of certiorari and prohibition in terms of prayers Nos. 2 – 4 of the chamber summons within 21 days from the date hereof.2. This leave shall operate as a stay of the implementation of the decision of the Public Procurement Administrative Review Board dated 20th September, 2024 in application No. 85 of 2024 and of the 2nd Respondent’s Notice of Intention to Award contract transmitted to the Applicant on 25. 9.2024. 3.The ex parte Applicant is directed to serve this application, statement of facts, amended statement and verifying affidavit upon the Respondent simultaneously with the substantive application.
