Ruling

1. This file was opened for purposes of considering whether the convict Walter Chandi is suitable for consideration of his sentence review in the spirit of prison decongestion pursuant to the Chief Justice Memo dated 7th December 2022.

2. The applicant was convicted for the offence of Acting as a driver in a public service vehicle without PSV badge contrary to section 103(A)(1) read with 103(A)(7) of the Traffic Act. He was sentenced to pay fine of ksh.10,000/- in default to serve 3 months in prison.

3. I have considered the record of the trial court. I note that the applicant was sentenced on 15th April 2024. In my view, the time served is sufficient sentence.

4. The applicant is released forthwith unless otherwise lawfully held.
