Ruling

1. Before me is a notice of motion application dated 13. 1.2025 brought forth by the plaintiff seeking orders of eviction of the defendants from parcel L.R.No Laikipia/Kalalu/56, and that the said eviction be carried out by a court bailiff with the assistance of the O.C.S Laikipia Central Police Station. The applicant contends that there is a decree issued in his favour, but the respondents have declined to give vacant possession.

2. The application and the directions given on 3. 3.2025 were served but no responses have been filed.

3. I have considered the arguments proffered in the application and the submissions of the applicant. A perusal of the record reveals that judgment was delivered way back on 7. 1.2016 where there was an order for delivery of vacant possession. It follows that the current application is geared towards effectuating the said judgment. Thus in terms of the provisions of Section 34 of the Civil Procedure Act, the application dated 13. 1.2025 is allowed as drawn.
