Alternatively he su bmitted that under order 15 rule 5 of the CPR where a counterclaim is pleaded and the plaintiff does not within ten weeks has not filed }{\insrsid2193709\charrsid16594438 in}{\insrsid9065403\charrsid16594438 a rely the court has the discretion to dismiss the suit for want of }{\insrsid2193709\charrsid16594438 prosecution}{\insrsid9065403\charrsid16594438 . The plaintiff had not filed in reply to the counterclaim and as such the suit be dismissed and counterclaim be }{\insrsid2193709\charrsid16594438 proceeded with}{\insrsid9065403\charrsid16594438 }{\insrsid2193709\charrsid16594438 t}{\insrsid9065403\charrsid16594438 hat there has been gross and inordinate delay in the prosecution of this case. The plaintiff\rquote s lawyer}{\insrsid2193709\charrsid16594438 \rquote s}{\insrsid9065403\charrsid16594438 chambers is situated in Fort Portal and there is }{ \insrsid2193709\charrsid16594438 no e}{\insrsid9065403\charrsid16594438 vidence on record that the applicant has ever been served with any hearing notes while the applicant/defendants lawyers were in }{\insrsid2193709\charrsid16594438 Kampala and they had never been summoned to attend court.}{\insrsid2193709\charrsid16594438 \par }{\insrsid9065403\charrsid16594438 The learned counsel continued to submit that the respondent filed another suit in the Chief Magistrate\rquote s court which is substantially the same as the }{\insrsid2193709\charrsid16594438 p}{ \insrsid9065403\charrsid16594438 resent case. That was to show therefore he was praying around with the court. That was an abuse of court process and wasting courts time. The respondent filed and obtained, a }{\insrsid2193709\charrsid16594438 temporary}{ \insrsid9065403\charrsid16594438 injunction in the Chief Magistrate\rquote s court which he was using to harass the applicants}{\insrsid2193709\charrsid16594438 .}{\insrsid9065403\charrsid16594438 He referred me to th}{\insrsid2193709\charrsid16594438 e case of}{\b\insrsid2193709\charrsid16594438 Milan vs Manibhai B. P}{\b\insrsid9065403\charrsid16594438 atel & }{\b\insrsid2193709\charrsid16594438 others}{\b\insrsid9065403\charrsid16594438 }{\b\insrsid2193709\charrsid16594438 (}{ \b\insrsid9065403\charrsid16594438 HCB}{\b\insrsid2193709\charrsid16594438 )}{\b\insrsid9065403\charrsid16594438 1969 P. 13 }{\insrsid9065403\charrsid16594438 where the suit was dismissed because it was clear that there had been an inordinat e delay on the part of the plaintiff in pursuing the suit. And that the adjournments had always been at his instance and for nearly five years the plaintiff did nothing. The suit was d}{\insrsid2193709\charrsid16594438 ismissed under Order 15 Rule 6 of the CPR. \par }{\insrsid9065403\charrsid16594438 Mr. Musana the learned counsel appearing for the respondent on the other ha}{\insrsid2193709\charrsid16594438 nd submitted that the responden}{\insrsid9065403\charrsid16594438 t/plaintiff was the registered proprietor of land comprised in Burahya Bloc}{\insrsid2193709\charrsid16594438 k 61}{\insrsid9065403\charrsid16594438 Plot 26 and the applicant/defendants are the customary tenants on that land. The respondent}{ \insrsid2193709\charrsid16594438 s}{\insrsid9065403\charrsid16594438 have a firm interest in that land and there have been a dispute between the parties. Since the suit was filed a lot has taken place. There had been correspondences between his client, the In}{\insrsid3691059\charrsid16594438 spector General of }{ \insrsid9065403\charrsid16594438 Government and the District Administrators. It was agreed by both parties }{\insrsid3691059\charrsid16594438 that this suit }{\insrsid9065403\charrsid16594438 should not be continued wit}{\insrsid3691059\charrsid16594438 h and his client agreed not to }{\insrsid9065403\charrsid16594438 continue with the suit on the unde}{\insrsid3691059\charrsid16594438 rstanding that he would compensa}{\insrsid9065403\charrsid16594438 te the defendants and others. And in fact the }{ \insrsid3691059\charrsid16594438 first }{\insrsid9065403\charrsid16594438 defendant/applicant had his properties valued and the money is ready for collection in the District Administrator\rquote s office. There }{\insrsid3691059\charrsid16594438 is a letter from IGG dated 14}{\super\insrsid3691059\charrsid16594438 th}{\insrsid3691059\charrsid16594438 }{\insrsid9065403\charrsid16594438 December, 1988 where it is shown that parties reached an agreement }{\insrsid3691059\charrsid16594438 a}{ \insrsid9065403\charrsid16594438 nd resolved not to proceed with Civil Suit No. 1/1989. }{\insrsid3691059\charrsid16594438 \par }{\insrsid9065403\charrsid16594438 As to the contention that there was}{\insrsid3691059\charrsid16594438 no reply to the counterclaim he}{\insrsid9065403\charrsid16594438 }{\insrsid3691059\charrsid16594438 submitted }{\insrsid9065403\charrsid16594438 that was unt}{\insrsid3691059\charrsid16594438 rue. The reply was filed on 2}{\super\insrsid3691059\charrsid16594438 nd}{\insrsid3691059\charrsid16594438 }{\insrsid9065403\charrsid16594438 March 1989. It dealt }{\insrsid3691059\charrsid16594438 specifically }{\insrsid9065403\charrsid16594438 with the counterclaim. With regard to the contention that no summons were served on the defendants he submitted t hat those were served to the defendants through Mugamba and Co. Advocates. That was as far back as 1988. In the circumstances the application was uncalled for since the parties had agreed that the suit be dismissed and some compensation has already ta}{ \insrsid3691059\charrsid16594438 ken place. He prayed that the application be dismissed. \par }{\insrsid9065403\charrsid16594438 In reply }{\insrsid3691059\charrsid16594438 Mr. }{\insrsid9065403\charrsid16594438 Nyamutale submitted that there was no affidavit in reply to the notice of motion so all that the counsel for the plaintiff was telling the court was not backed up by evidence. He wondered how the court could maintain such assertions when there was no }{ \insrsid3691059\charrsid16594438 reply to the notice of motion. \par }{\insrsid9065403\charrsid16594438 Perhaps it is proper at this}{\insrsid3691059\charrsid16594438 time}{\insrsid9065403\charrsid16594438 to note the events that led to the filing of the instant application. The records show that }{ \insrsid3691059\charrsid16594438 the suit was filed on 4}{\super\insrsid3691059\charrsid16594438 th}{\insrsid3691059\charrsid16594438 }{\insrsid9065403\charrsid16594438 January, }{\insrsid3691059\charrsid16594438 1989. There is no dispute over }{ \insrsid9065403\charrsid16594438 this. What is disputed }{\insrsid3691059\charrsid16594438 was}{\insrsid9065403\charrsid16594438 that the respondent had even set down the s}{\insrsid3691059\charrsid16594438 uit for hearing. However on 6}{ \super\insrsid3691059\charrsid16594438 th}{\insrsid3691059\charrsid16594438 }{\insrsid9065403\charrsid16594438 February, 1989 M/S Nyamutale and Co. Advocates a firm representing the }{\insrsid3691059\charrsid16594438 applicant}{ \insrsid9065403\charrsid16594438 entered appearance and lodged in h}{\insrsid3691059\charrsid16594438 is written statement of defence.}{\insrsid9065403\charrsid16594438 On }{\ul\insrsid3691059\charrsid16594438 2}{ \ul\super\insrsid3691059\charrsid16594438 nd}{\ul\insrsid3691059\charrsid16594438 }{\ul\insrsid9065403\charrsid16594438 March 1989 }{\insrsid9065403\charrsid16594438 the counsel representing the plaintiff filed in a reply to the counterclaim. It is stated in the records that a copy of the reply should be served upon the defendants though their advocates. There was no such service to the learned counsel representing the defendants. }{\insrsid3691059\charrsid16594438 \par }{\ul\insrsid9065403\charrsid16594438 On 2nd March 1989 }{\insrsid9065403\charrsid16594438 the learned counsel representing the Applicant applied for a hearing date and th}{\insrsid3691059\charrsid16594438 e case was fixed for hearing on 5}{ \super\insrsid3691059\charrsid16594438 th}{\insrsid3691059\charrsid16594438 April 1989. On that date all parties}{\insrsid9065403\charrsid16594438 were present except the }{\insrsid3691059\charrsid16594438 second}{\insrsid9065403\charrsid16594438 }{ \insrsid3691059\charrsid16594438 defendant}{\insrsid9065403\charrsid16594438 . Mr. Nyakabwa for the plaintiff was around. Mr. Nyamutale was no where to be seen. The }{\insrsid3691059\charrsid16594438 matter}{\insrsid9065403\charrsid16594438 was adjourned to 26/6/89 but because of the criminal session the case was never handled on that date. Hearing was fixed for 27/4/89. On the latter date bot}{\insrsid3691059\charrsid16594438 h counsels were absent although}{ \insrsid9065403\charrsid16594438 their clients were in attendance the case was }{\insrsid3691059\charrsid16594438 adjourned}{\insrsid9065403\charrsid16594438 sine die by the Distri}{\insrsid3691059\charrsid16594438 ct Registrar/Chief Magistrate. \par }{\insrsid9065403\charrsid16594438 On 13th November 1989 Mr. N}{\insrsid3691059\charrsid16594438 yamutale applied for a hearing d}{\insrsid9065403\charrsid16594438 ate and the case was fixed }{\insrsid3691059\charrsid16594438 for hearing on 23}{ \super\insrsid3691059\charrsid16594438 rd}{\insrsid3691059\charrsid16594438 November 19}{\insrsid9065403\charrsid16594438 89 but none of the counsels showed up}{\insrsid3691059\charrsid16594438 in court at all on that date. \par }{\insrsid9065403\charrsid16594438 Then Mr. Nyakabwa went ahead an}{\insrsid7606352\charrsid16594438 d fixed a hearing date for }{\insrsid9065403\charrsid16594438 23rd February 199}{\insrsid3691059\charrsid16594438 0 but both parties never showed up }{ \insrsid7606352\charrsid16594438 and the matter was }{\insrsid9065403\charrsid16594438 adjour}{\insrsid3691059\charrsid16594438 ned sine die. Thereafter on 7}{\super\insrsid3691059\charrsid16594438 th}{\insrsid3691059\charrsid16594438 }{ \insrsid9065403\charrsid16594438 March, 1991 the learned }{\insrsid3691059\charrsid16594438 counsel}{\insrsid9065403\charrsid16594438 for the defendant f}{\insrsid3691059\charrsid16594438 iled in the present application. \par }{\insrsid9065403\charrsid16594438 From what has transpired above and more particularly with regard to the record it is evident that both counsels are somehow to blame when this suit was fixed for hearing and never showe d up. I say so because on about two }{\insrsid2961990\charrsid16594438 occasions}{\insrsid9065403\charrsid16594438 the learned counsel for the defendant was well aware of the hearing date but did not show up. In almost a similar manner Mr. Nyakabwa did also on a few }{\insrsid7606352\charrsid16594438 occasions}{\insrsid9065403\charrsid16594438 never showed up on the hearing dates. However on most dates where the case was fixed for hearing by the counsel for the plaintiff there was nothing on record to show that there was any servic}{\insrsid16594438 e on the opposite }{ \insrsid9065403\charrsid16594438 party. It cannot therefore be said that for the last 2 years the learned }{\insrsid7606352\charrsid16594438 counsel appearing}{\insrsid9065403\charrsid16594438 for the plaintiff took }{\insrsid16594438 no steps with a view to fixing }{\insrsid9065403\charrsid16594438 a hearing date. See order 15 rule }{\insrsid9065403\charrsid16594438 6}{\b\insrsid9065403\charrsid16594438 }{\insrsid9065403\charrsid16594438 of the CPR. Therefore the case }{ \insrsid7606352\charrsid16594438 referred me by}{\insrsid9065403\charrsid16594438 t}{\insrsid7606352\charrsid16594438 he counsel for Applicant Mule Vs MB Patel Supra is not relevant to the instant case. \par Similarly}{\insrsid9065403\charrsid16594438 this is }{\insrsid7606352\charrsid16594438 not the occasion }{\insrsid9065403\charrsid16594438 where the court wo}{\insrsid7606352\charrsid16594438 uld make use of the provision of}{ \insrsid9065403\charrsid16594438 Order }{\insrsid9065403\charrsid16594438 15}{\b\i\insrsid9065403\charrsid16594438 }{\insrsid7606352\charrsid16594438 rule 2 of the Civil Procedure rules which states:- \par }{\i\insrsid7606352\charrsid16594438 \'93W}{\i\insrsid9065403\charrsid16594438 here the h}{\i\insrsid7606352\charrsid16594438 e}{\i\insrsid9065403\charrsid16594438 aring of a sui}{\i\insrsid7606352\charrsid16594438 t had been adjourned generally }{ \i\insrsid9065403\charrsid16594438 the court may if no application as aforesaid is made within 12 months of the last }{\i\insrsid7606352\charrsid16594438 adjournment give notice to the }{\i\insrsid9065403\charrsid16594438 parties to show cause why }{ \i\insrsid7606352\charrsid16594438 the suit should not }{\i\insrsid9065403\charrsid16594438 be dismissed and if cause is not shown to the}{\i\insrsid7606352\charrsid16594438 satisfaction }{\i\insrsid9065403\charrsid16594438 of the court the suit shall be dismissed.\'94 }{\i\insrsid7606352\charrsid16594438 \par }{\insrsid9065403\charrsid16594438 As}{\i\insrsid9065403\charrsid16594438 }{\insrsid7606352\charrsid16594438 stated earlier I cannot mak}{\insrsid9065403\charrsid16594438 e use of that provision of the law because the case has never been }{ \insrsid7606352\charrsid16594438 adjourned generally before me. And I do not think I need to be laboured over this. \par }{\insrsid9065403\charrsid16594438 It was however }{\insrsid7606352\charrsid16594438 argued and submitted on }{\insrsid9065403\charrsid16594438 behalf of the }{\insrsid7606352\charrsid16594438 applicant}{\insrsid9065403\charrsid16594438 }{ \insrsid7606352\charrsid16594438 that}{\insrsid9065403\charrsid16594438 the court could also consider }{\insrsid7606352\charrsid16594438 dismissing}{\insrsid9065403\charrsid16594438 }{\insrsid9259103\charrsid16594438 the suit under Order }{ \insrsid7606352\charrsid16594438 5 Rule 5 of the Civil Procedure Rules which states :- \par }{\i\insrsid9065403\charrsid16594438 \'93If the plaintiff does not within 8 weeks from the del}{\i\insrsid16594438 ivery of any defence or where a }{\i\insrsid9065403\charrsid16594438 counterclaim is }{\i\insrsid9259103\charrsid16594438 pleaded}{ \i\insrsid9065403\charrsid16594438 }{\i\insrsid9259103\charrsid16594438 thereof}{\i\insrsid9065403\charrsid16594438 set down the suit for hearing, then the defendant may either set down the suit for hearing or apply to th}{ \i\insrsid9259103\charrsid16594438 e}{\i\insrsid9065403\charrsid16594438 }{\i\insrsid9259103\charrsid16594438 co}{\i\insrsid9065403\charrsid16594438 ur t to dismiss the suit for want of prosecution, and on the hearing of such application the court may order the suit to be dismissed accordingly or may make such other order and on such terms, a}{\i\insrsid9259103\charrsid16594438 s to the court may seem just.\'94 \par }{\insrsid9259103\charrsid16594438 The learned counsel for the appl}{\insrsid9065403\charrsid16594438 icant had submitted that there was}{\insrsid16594438 }{\insrsid9259103\charrsid16594438 no reply to the counterclaim a}{ \insrsid9065403\charrsid16594438 nd the same was never }{\insrsid9259103\charrsid16594438 served}{\insrsid9065403\charrsid16594438 on him but }{\insrsid9259103\charrsid16594438 the position is }{\insrsid9065403\charrsid16594438 that there was a reply on the records service on the a}{\insrsid9259103\charrsid16594438 pplicant\rquote s}{\insrsid16594438 }{\insrsid9065403\charrsid16594438 advocate as not known. In his address to this court the learned counse l for the respondent submitted that service was through Mugamba & Co. Advocates another firm of Advocates not representing the applicant and since then much less }{\insrsid9259103\charrsid16594438 e}{\insrsid9065403\charrsid16594438 ffort were taken b}{ \insrsid9259103\charrsid16594438 y the plaintiff\rquote s advocates to }{\insrsid9065403\charrsid16594438 have this matter fixed for hearing as is }{\insrsid9259103\charrsid16594438 evidenced}{\insrsid9065403\charrsid16594438 from the submission by the learned counsel for the plaintiff and the records }{\insrsid9065403\charrsid16594438 there}{\b\i\insrsid9065403\charrsid16594438 }{\insrsid9065403\charrsid16594438 are no longer interested in the case because the counsel for the plaintiff alleges that matters were settled between the parties a fact not known either to the applic ants advocate nor to the applicants themselves leave alone this court. My finding here is that though there is a reply to }{\insrsid9259103\charrsid16594438 counterclaim}{\insrsid9065403\charrsid16594438 filed in court record but the same was never served on the applicants advocate. So as far as this court is concerned ther e was no reply to the counterclaim and I therefore upheld the submission of the learned counsel for the applicant over this matter in that the defendants did not within 10 weeks from the delivery of the counterclaim set down the suit for hearing.
