RULING
This application has been brought through Chamber Summons under Section 356 and 357 (1) and (2) of the CPC and all enabling provisions of the law. The same seeks the following orders:
(a) THAT the Honourable Court be pleased to order that the appellant/applicant be released on reasonable bail/bond terms pending the hearing and determination of the appeal filed herein.
(b) THAT the Honourable Court be pleased to grant such further and/or justifiable orders as it may deem fit and as may be appropriate in the circumstance of this matter.
(c) Costs of this application be costs in the cause.
Since the said application has not been opposed by the state, I hereby grant the prayers as sought. In pursuance of the above, the appellant is hereby released on his own bond of Kshs.100,000/= with a surety.
