JUDGMENT

1. D K J (K) was convicted after trial before the Chief Magistrate’s Court Nanyuki with the offence of causing a child to be in need of care and protection contrary to section 127(1)(b) of the Children’s Act.In order to appreciate the offence with which K was convicted on I will reproduce the particulars of the charge as follows:-

“D K J: On the 5th day of September 2016 at [particulars withheld], within Nyeri County being a guardian neglected your duties to take care of the said child namely A. M. which led to her being defiled by STANLEY KARANJA thereby causing her to be a child in need of care and Protection.”

2. D on being convicted was sentenced to serve two years imprisonment. She has filed this appeal against that sentence. The facts of the case as told by the minor, a nine year old child A.M. are that on the 5th day of September 2016 she had been left in the care of the appellant. The appellant was employed to help in that house. On that particular day A. M. and the appellant were the only two people in the house. The other members of the household had travelled. On that night the appellant left A. M. in the house alone. She returned to the house at 9 p.m. accompanied by a man. When they arrived at the home the man sent the appellant to go and buy meat. A. M. was left in the house with that man. A. M. in evidence stated that the man proceeded to defile her. After defiling her he left. The appellant arrived at home at 10 p.m. She found A. M. crying. When A.M. explained to her why she is crying the appellant ignored her and told her to go to sleep. Although A. M. complained that she had a stomach-ache the appellant threatened her with a knife if she was to tell anyone what had taken place. It was not until the following day on the arrival of the aunt to A. M. that A. M. was taken to hospital and was confirmed to have been defiled.

3. The appellant has submitted in support of her appeal that she is a single mother of three child who depend upon her. She also submitted that she is remorseful and reformed. She stated that she was first time offender when she was convicted by a trial court.

4. I have considered the facts of the case and the submissions made by the appellant. It cannot be ignored that the appellant abandoned A.M. to a man and from the evidence it seems that the appellant was aware of what the man would do to A.M. The man sexually assaulted a nine year old girl with the connivance of the appellant. I wholly agree with the sentencing remarks of the trial court where in part the learned trial magistrate stated:

“……….the child suffered serious physical and emotional injuries.”

I would add that the child possibly will suffer lifelong emotional injuries from the act which was allowed by the appellant.

5. When the appellant appeared before the court for the hearing of her appeal she had with her a very young child whom she said she delivered while in custody. That as it may be it is this court’s view that the offence committed by the appellant as deserving custodial sentence. Indeed the fact that the appellant is a mother of four children makes it more terrible to imagine that she would expose a girl child to a man as she did to A. M. In this court’s view the appellant needs to learn that her behaviour cannot be tolerated or approved by the society. She needs to be in custody to know that her behaviour is disapproved and denounced.

6. It is on that ground that the appellant appeal against sentence is denied and dismissed. The trial court sentence is hereby confirmed.
