R U L I N G

Before me is an Originating Summons dated 7th December 2011 filed by the applicants D. M. K. and J. A. M. who are husband and wife. It is for the adoption of a child E. M. to be known as J. N. M.

The application was filed with a Statement of the applicants as required by law. Several documents were annexed to the statement. It was also filed with an affidavit of the applicants.

On 3rd February 2012 the court appointed a guardian ad litem. The Director of Children Services through the District Children Officer at Kitui filed their report. The report recommends that request for adoption be granted.

Having evaluated the application, documents filed and submissions of counsel for the applicant Mrs Kalinga, I am of the view that the adoption will be in the best interests of the child. It will give this otherwise abandoned child an opportunity to live and grow up in a family under the care and guidance of parents.

I therefore allow the application and order as follows:-

1. The applicants be and are hereby authorized to adopt the child E. M. to be known as J. N. M.

2. M. K. is appointed as the legal guardian of the child.

3. The Registrar General will enter this adoption in the adopted children register, in the prescribed manner.
