\insrsid12586102\charrsid470423 remise}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the first issue is in the aff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 irmative. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 On the second issue}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 whether the said land was leased to Jeraj & Sons ltd and Karmal Rashid ltd for 99 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 years. \par T}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 here is evidence here t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 show that the suit land was leased to }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 wo companies as per the testimony of PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 the plaintiff and that of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 4. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 After registering PW1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 as the owner of the suit property on }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 27}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid9523522\charrsid470423 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 January, 1967 \insrsid12586102\charrsid470423 had some }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 encumbrances registered on 5}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid9523522\charrsid470423 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 February, 1965.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The lessees were Jeraj and Sons ltd }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 and Karmal R}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ashid limited. The lease ag}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 reement between the father of the plainti}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ff and the lessee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9523522\charrsid470423 s }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 was exhibited in court as exhibit P2. Evidence further went on to show that sugar and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 tea was planted in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the said Estate but because of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 departure}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 of the lessees t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 he estate was not attended to. I}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 t was overgrown by the bush, sugarcanes and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 tea was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 no longer there }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 All the structures on the suit premises were dilapidated. The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 electric}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 generator and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 electric pump pumping wat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 er for the jaggery factory was no longer there. Most of the buildings were pulled down. Iron sheets, do}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 ors and windows were taken away.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 There was no body to maintain whate}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 ver remained there. \par The defendants}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 denied that the suit premises had bee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 n abandoned. DWI wanted to plant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 sugar and cut the te}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 a slabs but the place was bushy and there were some disused machineries on the site like boilers, j}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ggery plant and generator. The sugar plantation was in a bad shape and the tea plantation had turned }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 into wild forest.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 An effort was made to rehabilitate the place but there }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 were}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 problems. In 1985 DW1 left the place. When she returned she tried to plant maize and wheat but because of the logistics she could not start }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 n the work. She planted some }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 sugarcane}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 and got some molasses but there was no market for it. DWI does not stay at }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3236013\charrsid470423 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 he estate. He had title over the demised premises.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The allocation therefore by the Custodian Board of the property to Mary Hall Ki}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 sembo the 2}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid15481935\charrsid470423 nd}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 defendant was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 erroneous}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 since the first defendant (The DAPCB) had no title to pass over. Also since the demised property belonged to the plaintiff who was a Ugandan the same never vested in the Government the }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 first defendant.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 In the premises the demised properties never vested in the Government under S. 4 of the }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Assets}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Departed Asian De}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 cree 1973 (Decree 22 of 1973). \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 In a similar way it is my considere}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 d view that Decrees 27 of 1972 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 and Decree 29 of 197}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 2 which amended the former were not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 applicable to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 instant case since the plaintiff as lessor had a lease agreement }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 with the lessees}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the Asia}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 ns before their exodus. The 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid15481935\charrsid470423 st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 defendant was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 not a party to the lease agreeme}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 nt and as such had no title to p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ass over to the second defenda}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 nt. In the light of what has been explained}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 abov e the demised property never vested in the first defendant and the latter had no title to transfer to the second defendant. This issue is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 therefore in the negative. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The sixth issue was whether the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 contract}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 or the lease }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 between}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the plaintiff\rquote s father and the two }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 companies}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 unconscionable. The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\insrsid15481935\charrsid470423 Oxford Concise}{\rtlch\fcs1 \af0 \ltrch\fcs0 \b\insrsid12586102\charrsid470423 Dictionary}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 defin}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 es the word unconscionable as \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid15481935 {\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 \'93Having}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 no }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 conscience}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 , contrary to the dictates of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 conscience}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 , no}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid470423\charrsid470423 righter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 reasonable; unreaso}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 nab1e excessive.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 The learned counsel appearing for the p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 arties were }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 f no assistance to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 court over this issue. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid470423\charrsid470423 They did not submit }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 anything on this issue albeit }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 the fact that they had agreed on}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 the framing of the same. Nonetheless I had the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 occasion}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 to peruse the lease }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 agreement. It was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 not contrary to the dictates of conscience and it was a reasonable one. This issue}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 is therefore in the negative}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid470423\charrsid470423 \'94}{\rtlch\fcs1 \af0 \ltrch\fcs0 \i\insrsid15481935\charrsid470423 . \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 seventh}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 issue is whether the land was legally passed over to the first defendant and if not whether the plaintiff was entitled to e}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 xercise his right of re-entry. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 In order to answer this issue satisfactorily, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 t is befitting to review the evidence on record and in so acting I could not avoid making som}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 e repetitions}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 about the issues and evidence I have already }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 dealt with. \par According to PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 he }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 became}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the proprietor of the su}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 it premise after the demise of his father in 1967}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 . There was an agreement between his father and the Asian/lessees}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 which was to run for 99 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15481935\charrsid470423 y}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 ears. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The lease agreement was tendered in court an}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 d marked as exhibit P2. The 1esse}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 es}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 had to pay rent for }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 25}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ye} {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 ars at once. They paid the rents}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 and the premium after which they had to pay the rents }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 annually }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 commencing with November 1989. Since then the a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15232820\charrsid470423 nnual rent had never been met. \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid6428540 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The land was for Agricultural purposes, Sugarca nes had been planted there. It was no longer there. No body maintains whatever remained there. Most of the buildings were pulled down. Iron sheets, doors and even windows were taken away. Also taken away were the electr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 ic machineries and generators. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The land was no longer being used. It had been }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2373326\charrsid470423 abandoned}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 . }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2373326\charrsid470423 evidence further showed that PW1 made efforts to re-}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 enter the demised land but his efforts to do so were frustrated. The lessee encumbrances }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 were registered on }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 5/2/1965.}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid2373326\charrsid470423 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 When DW1 started having interest in the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 land in question, she applied }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 for allocation of the demised premises to the Mi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 nister of Commerce }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2373326\charrsid470423 in the year }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1976. She was allocated the land}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 in 1977. When she went to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 sugar plantation it was in bad shape. The tea plantation had turned into wild fore} {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2373326\charrsid470423 st. Her business in molasses }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 collapsed and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2373326\charrsid470423 she stopped producing molasses.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The Obote soldiers as they ran away set fire on the banana pla}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 ntation and sugarcane.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 She}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 left the area for a short time.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 She planted maize and }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 was contemplating}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 of planting wheat. She could not begin the jaggery because the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 machineries are gone. \par DW2 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 he Regional Manager Custodian }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 Board for Toro, Bunyoro, Kasese,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Bundibugyo, Hoima and Masindi conceded surprisingly that P. W.1 was the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 owner of the land at Bulyambuzi.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 I use the word surprisingly because in their written statement of defence the defendants denied that the plaintiff was the proprietor of the suit }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 premises. His testimony however}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 was to the effect that the actual owner of the land at Bulyambuzi was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 plaintiff. The latter succee}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 ded his father who passed away. The Custodian }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Board cou}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 ld continue paying the ground re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 whe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ev}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 er claimed. They did not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 pay the grounds rents }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 to PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 because he had never requested for it. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 If PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 asked for it they would still pay him. DW2 had never seen an application by the plaintiff. If he receive}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 d one he would recommend him}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 to the headquarters of t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 he Custodian Board in Kampala. Cases like the instant one where a U}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 gandan leases properties to Asians such case goes to the verificati}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 on and negotiation committee. DW3 was quoted by him PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 .2 as having had a similar situation like th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 at obtaining of the plaintiff. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Turning to the issue I have already found that P. W.1 was the registered proprietor of the demised land and there was a lease agreement between him and the lessees the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 Asians. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 The learned counsel appearing for the defence submitted that the lessees were among the many people who were expelled in 1972 and legislation was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 promulgated}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 vesting certain properties into the custody of the board. That DW3 had continued to earn his living through rents. After 1989 the plaintiff has no t persuaded }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 court that he }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 had}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 tried to ask for the rents from the Custodian }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 Board nor had he shown that his}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 application}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 for rent had at any one stage been rejected }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 outright}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 . The board could not have considered what was not tendered before it. That }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 explained}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 why Mr. Manyindo had not been paid rents but Musisi }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 (DW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 2) assured court that it is not too late in the premises. The learned counsel continued that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 property}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 was turned to the owner o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 n 3/6/1991}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 under certificate No. 0572 and the certificate was signed by the Minister of Finance. And that if the plaintiff applied}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 he would be considered under section}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 4 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 & }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 5 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 of the expropriated property Act 1982 but as the case stood the plaintiff had no relief and if he had any the proper person to proceed ag}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6386536\charrsid470423 ainst wer e not the defendants. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Mr. Musana counsel appearing for the plaintiff submitted that the land never vested in the first defendant and Act 9 of 1982 was not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 applicable to the instant case}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 . I seem to agree with the learned counsel over this matter. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid200604\charrsid470423 In }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid12586102\charrsid470423 Evaristo Mugabi }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid200604\charrsid470423 vs. Ag. H. C. C. S No.1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid12586102\charrsid470423 36 of 1984. }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 There the owner of the land was Ugandan and he leased his land to various Asians when those people left the Minister purported to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 repossess}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the land. It was held that the Custodian Board should not have taken over because the properties belonged to a Ugandan and so the certificate signed by the Minister, of Finance did not }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 affect the land. \par }\pard \ltrpar\s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid200604 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Turning }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 to the instant case P}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 . W.1 was a Ugandan and the registered proprietor of the demised property which he had leased to the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 departed Asians.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 Since the land belonged to an indigenous }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 Ugandan}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 it was not affected by the A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 ssets of Departed Asians decree, Decree 27 of 1973}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 . The properties therefore never vested in the first defendant and also the same properties were not affected by the Expropriated properties Act 1982 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 ince they never vested in the g}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 overnment and were never transferred to the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 Custodian Board. See section 1(i)}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 (a) of the said Act. In the premises the }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 certificate}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 signed by the Minister returning the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 demised}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 land to Jeraj & Karmal the leases was to say the 1e}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 st of no effect as re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 ga}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 rds the r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 ights of P. W.1 over the suit land. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 I am of }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid200604\charrsid470423 view that PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 .1 could exercise his rights of re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 -}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 entry because of the following reasons. No rents have been paid to since November 1989. It is inconceivable that the plaintiff had to run after the Custodian }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 Board in order to have the rent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 s paid. That }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 would make him look like a beggar. On}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 the contrary the Custodian Board had to }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 look}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 for him. Since 1972 this }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 covenant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 has not been followed.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 There was evidence from both PW.1 & DW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 that the l}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 and has grown bushy and that DW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 had failed to maintain it and wa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 trying to borrow money and rehabilitate the land. D}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 W}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1 had introduced a lot }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 of new things}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 on this land. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid12586102\charrsid470423 In Victor Namanyanja }{\rtlch\fcs1 \af0 \ltrch\fcs0 \ul\insrsid6493970\charrsid470423 vs. D. This issue has been covered when considering the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 seventh issue and I}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 do not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 think ha}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 ve got anything useful to add. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 And as regards the ninth issue}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 whether the plaintiff had ri}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 ghtly exercised his right of re-}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 entry. On the available evidence this issue }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 is also in the affirmative. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 In the end I find that the plaintiff has proved his claim on a balance of probabilities and I give }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 this judgment in his fa vour and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423 make the following orders. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 1. A declaration that the lease of the suit property }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 never}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 passed } {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6493970\charrsid470423 on the first defendant. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 2. When Mr. Nyakabwa passed away before }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423\charrsid470423 completing the case M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 r. Musana ok over. (Mr. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423\charrsid470423 N}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 yakabwa had closed the plaintiff\rquote s case). The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid470423\charrsid470423 re was no objection from the def}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12586102\charrsid470423 ence.
