Ruling

1. The applicant was charged and convicted for the offence of trafficking in narcotic drugs contrary to section 4(a) of the Narcotic Drugs and Psychotropic Substances (Control) Act No. 4 of 1994. His appeal before this court was dismissed on 1st December 2023.

2. The applicant has previously filed several applications seeking a review of sentence. Each of these applications was either dismissed for lack of merit or struck out for want of territorial jurisdiction.

3. The applicant has now filed the current application dated 27th May 2025, seeking the transfer of the file to the High Court at Makadara.

4. However, the court record indicates that there is no existing file capable of being transferred. The original trial court file was transferred to the Chief Magistrate’s Court at JKIA, while the appeal file was closed upon conclusion of the matter.

5. In the premises, this application is dismissed for being an abuse of the court process.Orders accordingly.
