JUDGMENT

In an amended original summons dated 19th May, 2014, E K N and R K K, applicants herein seek authorization to adopt a child, E.   P N N had consented to be the legal guardian to the child.

I have carefully read affidavits sworn in support of the application, documents filed and reports filed pursuant to the requirements of the law.

Baby E, a male child was found abandoned within Kahawa West area.  He was committed to Happy Life Children’s Home for Care and Protectionon the 24thday of June, 2007. Consequently he was committed to the applicants as his foster parents.  A certificate of declaration of the child being free to be adopted No. [Particulars withheld] was issued on the 9th January, 2014.

The applicants herein have fostered the child since 2009per the report of the Sub-County Children’s Officer, who does not have any objection to the applicants adopting the child.

This court having considered the information availed by the Child Welfare Society of Kenyaand the Children’s Officer, it is apparent that the applicants are God-fearing people who so far have  provided the child with love, affection and basic requirements.  The child having been abandoned and efforts to trace his biological parents having been fruitless, their consent is hereby dispensed with.

Consequently, I grant orders as hereunder;-

The applicants be and are hereby authorized to adopt Baby E who will be known as E M K.

P N N is appointed as the legal guardian of the child.

The child be declared a Kenyan citizen.

The Registrar General shall make an entry of the adoption in the Adopted Children’s Register in the manner prescribed.
