Tinyinondi on 3}{\super\insrsid9457987\charrsid10182800 rd}{\insrsid9457987\charrsid10182800 February, 2006.}{\insrsid7297469\charrsid10182800 \par {\listtext\pard\plain\insrsid9457987\charrsid10182800 \hich\af0\dbch\af0\loch\f0 8.\tab}}\pard \qj \fi-720\li1584\ri864\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin864\lin1584\itap0\pararsid10182800 {\insrsid9457987\charrsid10182800 On perusal of the bill of costs, it transpired that counsel for the respondent had caused the file to be moved from }{\b\insrsid9457987\charrsid10182800 Nakawa }{\insrsid9457987\charrsid10182800 to }{\b\insrsid9457987\charrsid10182800 Kampala }{ \insrsid9457987\charrsid10182800 on 13}{\super\insrsid9457987\charrsid10182800 th}{\insrsid9457987\charrsid10182800 April, 2005 after the case was apparently re-allocated to Justice Tinyinondi. The re-allocation was not noted in the Register. \par {\listtext\pard\plain\insrsid15744297\charrsid10182800 \hich\af0\dbch\af0\loch\f0 9.\tab}}{\insrsid15744297\charrsid10182800 Counsel for he respondent subsequently fixed the appeal for hearing on 3}{\super\insrsid15744297\charrsid10182800 rd}{ \insrsid15744297\charrsid10182800 February, 2006, according to a copy of the hearing notice on the file. \par {\listtext\pard\plain\insrsid15744297\charrsid10182800 \hich\af0\dbch\af0\loch\f0 10.\tab}W}{\insrsid16350674\charrsid10182800 e were not served with the said hearing notice and there is no affidavit of service on the record.}{ \insrsid15744297\charrsid10182800 \par {\listtext\pard\plain\insrsid6840058\charrsid10182800 \hich\af0\dbch\af0\loch\f0 11.\tab}}{\insrsid6840058\charrsid10182800 The appellant and his counsel were therefore prevented from appearing due to re-allocation of the file without notice, and fixing the hearing without service of a hearing notice.}{\insrsid16350674\charrsid10182800 \par {\listtext\pard\plain\insrsid10433094\charrsid10182800 \hich\af0\dbch\af0\loch\f0 12.\tab}}{\insrsid10433094\charrsid10182800 After the dismissal, the respondent\rquote s counsel filed and had a bill of costs taxed without notice to the appellant\rquote s counsel. Copies are annexed hereto marked \'93C\'94 and \'93D\'94 respectively. \par {\listtext\pard\plain\insrsid9531114\charrsid10182800 \hich\af0\dbch\af0\loch\f0 16.\tab}}{\insrsid9531114\charrsid10182800 On arrest of the appellant on 13}{\super\insrsid9531114\charrsid10182800 th}{\insrsid9531114\charrsid10182800 March, 2006, he paid Shs. 2,500,000/= to the court bailiff as part of the sum claimed plus a further Shs. 1,500,000/= as bailiff\rquote s costs.
