That in any case, there was no evidence to show that the advocate was ill and }{\insrsid986260\charrsid14361973 therefore }{\insrsid7625654\charrsid14361973 could not come to court}{\insrsid986260\charrsid14361973 .}{\insrsid7625654\charrsid14361973 }{\insrsid986260\charrsid14361973 He charged that h}{\insrsid7625654\charrsid14361973 is client\rquote s statement about }{\insrsid986260\charrsid14361973 his illness }{\insrsid7625654\charrsid14361973 was not satisfactory to justify }{\insrsid986260\charrsid14361973 the grant of }{ \insrsid7625654\charrsid14361973 an adjournment. Mr. Muhwezi went on to }{\insrsid9704052\charrsid14361973 complain }{\insrsid986260\charrsid14361973 about }{\insrsid14815699\charrsid14361973 the length of the period of ti me between the 28/06/06 when the suit was last called on for hearing and 30/}{\insrsid986260\charrsid14361973 08}{\insrsid14815699\charrsid14361973 /10 when he had it set down for hearing}{\insrsid10491104\charrsid14361973 . }{ \insrsid14815699\charrsid14361973 He charged}{\insrsid10491104\charrsid14361973 that the plaintiff and his advocates took no action whatsoever to ensure that the suit was listed for hearing until the 27/05/2007 when he fixed it for hearing but th}{ \insrsid14815699\charrsid14361973 at}{\insrsid10491104\charrsid14361973 hearing did not take place. \par \par Mr. Muhwezi }{\insrsid986260\charrsid14361973 further }{\insrsid10491104\charrsid14361973 complained that after that }{\insrsid986260\charrsid14361973 hearing fell through, }{\insrsid10491104\charrsid14361973 the plaintiff and his advocates did not bother to }{\insrsid14815699\charrsid14361973 ensure}{\insrsid10491104\charrsid14361973 that the case }{\insrsid14815699\charrsid14361973 was}{\insrsid10491104\charrsid14361973 fixed for hearing}{ \insrsid986260\charrsid14361973 again}{\insrsid10491104\charrsid14361973 till he moved court and obtaine}{\insrsid986260\charrsid14361973 d}{\insrsid14815699\charrsid14361973 a slot on}{\insrsid10491104\charrsid14361973 the 30/08/2010. He said that Mr. Magala was served with a hearing notice on 13/07/10 and there was an affidavit of service deposed by Adam Bunya on the 25/08/2010. }{\insrsid14815699\charrsid14361973 He }{\insrsid986260\charrsid14361973 further }{ \insrsid14815699\charrsid14361973 contended }{\insrsid10491104\charrsid14361973 that the information}{\insrsid14815699\charrsid14361973 by his client}{\insrsid10491104\charrsid14361973 that Mr. Magala }{\insrsid14815699\charrsid14361973 was unwell }{ \insrsid10491104\charrsid14361973 was}{\insrsid14815699\charrsid14361973 }{\insrsid10491104\charrsid14361973 not satisfactory to explain the plaintiff\rquote s failure to attend court. \par \par Mr. Muhwezi went }{\insrsid2570770\charrsid14361973 on }{\insrsid10491104\charrsid14361973 to challenge the right of the 3}{\super\insrsid10491104\charrsid14361973 rd}{\insrsid10491104\charrsid14361973 defendant to the counterclaim to }{ \insrsid986260\charrsid14361973 address court in }{\insrsid10491104\charrsid14361973 the proceedings. He }{\insrsid14815699\charrsid14361973 pointed out}{\insrsid10491104\charrsid14361973 that though he was served with the counterclaim on 7/}{ \insrsid986260\charrsid14361973 05}{\insrsid10491104\charrsid14361973 /05, he}{\insrsid14815699\charrsid14361973 (Mr. Kagolo)}{\insrsid10491104\charrsid14361973 did not file his reply to the counterclaim till the 30/05/2005. }{ \insrsid14815699\charrsid14361973 He}{\insrsid10491104\charrsid14361973 then submitted that }{\insrsid14815699\charrsid14361973 his}{\insrsid10491104\charrsid14361973 reply was out of time, }{\insrsid14815699\charrsid14361973 in contravention of O}{ \insrsid10491104\charrsid14361973 rder 8 rule 11(1) of the Civil Procedure Rules (CPR). He went on to state that the 3}{\super\insrsid10491104\charrsid14361973 rd}{\insrsid10491104\charrsid14361973 defendant to counterclaim also failed to serve his reply on the counterclaimant}{\insrsid16478196\charrsid14361973 or her advocate}{\insrsid10491104\charrsid14361973 in time because he (Mr. Muhwezi) only received it on }{ \insrsid16461694\charrsid14361973 30/05/2006.}{\insrsid10491104\charrsid14361973 He asserted th}{\insrsid16461694\charrsid14361973 at}{\insrsid10491104\charrsid14361973 this was contrary to }{\insrsid5135884\charrsid14361973 Order 8 rule 11(2) CPR which required the defendant to a counterclaim to file his reply thereto within 15 days}{\insrsid986260\charrsid14361973 of filing it}{\insrsid5135884\charrsid14361973 . He }{\insrsid986260\charrsid14361973 then }{ \insrsid5135884\charrsid14361973 submitted that the reply was incompetent since it was filed and served out of time without leave of court. }{\insrsid16461694\charrsid14361973 \par \par Mr. Muhwezi added t}{\insrsid5135884\charrsid14361973 hat }{\insrsid16461694\charrsid14361973 serving the 3}{\super\insrsid16461694\charrsid14361973 rd}{\insrsid16461694\charrsid14361973 defendant to the counterclaim}{\insrsid5135884\charrsid14361973 with a hearing notice}{\insrsid16461694\charrsid14361973 for 30/08/10}{\insrsid5135884\charrsid14361973 was}{\insrsid986260\charrsid14361973 only}{\insrsid5135884\charrsid14361973 to comply with the provisions of Order 9 rules 10 and 11 of the CPR which require the plaintiff to serve hearing notice on a defendant who has not filed a defence. He contended that though he was in court, the 3}{\super\insrsid5135884\charrsid14361973 rd }{\insrsid5135884\charrsid14361973 defendant to the counterclaim had no right to address court due to the fact that he had omitted to file his defence in time. He said that the same would have applied to the 3}{\super\insrsid5135884\charrsid14361973 rd} {\insrsid5135884\charrsid14361973 defendant to the counterclaim even if his advocate had attended court. He then prayed that the plaintiff\rquote s suit be struck out}{\insrsid14954285\charrsid14361973 with costs}{\insrsid5135884\charrsid14361973 for want of prosecution under the provisions of Order 17 rule 4 and Order 9 rule 22}{\insrsid14954285\charrsid14361973 CPR,}{\insrsid5135884\charrsid14361973 because it was only the defendant present in court}{\insrsid15424171\charrsid14361973 when the suit was called on for hearing}{\insrsid5135884\charrsid14361973 .}{\insrsid14434411\charrsid14361973 I then reserved my ruling }{\insrsid14954285\charrsid14361973 for }{\insrsid14434411\charrsid14361973 today because there }{ \insrsid14954285\charrsid14361973 were }{\insrsid14434411\charrsid14361973 a lot of pleadings and correspondence on the }{\insrsid14954285\charrsid14361973 court }{\insrsid14434411\charrsid14361973 record that I needed to go through before coming to my decision.}{\insrsid7625654\charrsid14361973 \par }{\insrsid3479999\charrsid14361973 \par }{\insrsid14620014\charrsid14361973 Given the bulky record that was before me}{\insrsid14954285\charrsid14361973 and the long period of time that the suit had been inactive, }{\insrsid14620014\charrsid14361973 I thought that it would be pertinent to }{ \insrsid14954285\charrsid14361973 set out}{\insrsid14620014\charrsid14361973 the background to this long drawn out }{\insrsid15424171\charrsid14361973 dispute}{\insrsid11361889\charrsid14361973 with a }{\insrsid14954285\charrsid14361973 rather }{ \insrsid11361889\charrsid14361973 chequered history}{\insrsid15424171\charrsid14361973 before }{\insrsid14954285\charrsid14361973 coming}{\insrsid15424171\charrsid14361973 to my decision on Mr Muhwezi\rquote s }{\insrsid14954285\charrsid14361973 complaints}{\insrsid14620014\charrsid14361973 . }{\insrsid3479999\charrsid14361973 On the }{\insrsid5077956\charrsid14361973 6/04/2005, t}{\insrsid10387418\charrsid14361973 he plaintiff sued the defendant in the}{\insrsid5077956\charrsid14361973 Chief Magistrates Court at Mukono }{\insrsid14620014\charrsid14361973 in }{\insrsid5077956\charrsid14361973 C/S No. 001/2005. The defendant filed a defence on the 4/05/2005 }{\insrsid14167868\charrsid14361973 but by an order of Justice V. T. Zehurikize dated 22/06/05 in Msc. Application No.}{\insrsid5392220\charrsid14361973 92/}{\insrsid12680145\charrsid14361973 2005;}{\insrsid5077956\charrsid14361973 the file was transferred to the}{ \insrsid10387418\charrsid14361973 High Court at }{\insrsid14167868\charrsid14361973 Jinja}{\insrsid5077956\charrsid14361973 due to}{\insrsid14167868\charrsid14361973 , among others,}{\insrsid5077956\charrsid14361973 the value of the estate being above the pecuniary jurisdiction of the Chief Magistrate.}{\insrsid16131931\charrsid14361973 }{\insrsid11361889\charrsid14361973 However,}{\insrsid16131931\charrsid14361973 due to pressure of work}{ \insrsid11361889\charrsid14361973 in a Criminal Session at Mukono}{\insrsid14954285\charrsid14361973 at the time}{\insrsid16131931\charrsid14361973 , Justice Zehurikize could not hear the }{\insrsid14954285\charrsid14361973 suit}{ \insrsid16131931\charrsid14361973 . Following a certificate of urgency that was granted on the }{\insrsid15161310\charrsid14361973 11/08/2005, the file was transferred to the High Court at Kampala to }{\insrsid11361889\charrsid14361973 be placed}{ \insrsid15161310\charrsid14361973 before a judge for hearing during the court vacation.}{\insrsid5077956\charrsid14361973 }{\insrsid15424171\charrsid14361973 \par \par }{\insrsid14620014\charrsid14361973 In his suit, t}{\insrsid5077956\charrsid14361973 he plaintiff sought the }{\insrsid10387418\charrsid14361973 revocation of letters of administration that had been granted to }{\insrsid14620014\charrsid14361973 the defendant}{\insrsid10387418\charrsid14361973 by the Chief Magistrate at Mukono in the estate of the late Lt. Col. }{\insrsid15424171\charrsid14361973 Wycliffe}{\insrsid10387418\charrsid14361973 Mwesigwa Ntungura. He also sought for a declaration that}{\insrsid15424171\charrsid14361973 other beneficiaries}{\insrsid10387418\charrsid14361973 and }{\insrsid15424171\charrsid14361973 he }{\insrsid10387418\charrsid14361973 were entitled to their respective shares in the estate of the deceased}{\insrsid14620014\charrsid14361973 . }{\insrsid15424171\charrsid14361973 The plaintiff}{\insrsid14620014\charrsid14361973 further sought}{\insrsid10387418\charrsid14361973 for an order that the defendant account for the property and funds that had come into her possession while she was the administratrix of the estate, }{\insrsid15424171\charrsid14361973 and}{\insrsid10387418\charrsid14361973 an order appointing the plaintiff as the administrator in her stead, }{\insrsid15424171\charrsid14361973 as well as }{\insrsid10387418\charrsid14361973 the costs of the suit. \par \par The plaintiff was the father of the deceased while the defendant was his wife. In his pleadings, the plaintiff claimed that the deceased who died on 25/05/2002 was survived by 7 children, three w}{\insrsid16348085\charrsid14361973 ives}{ \insrsid10387418\charrsid14361973 , his parents and very many dependants. That he had substantial assets both in Mukono District and}{\insrsid16348085\charrsid14361973 Rukungiri Town, all valued at over shs 200m. }{\insrsid6645542\charrsid14361973 Further t}{\insrsid16348085\charrsid14361973 hat the defendant }{\insrsid14954285\charrsid14361973 was not a wife of the deceased and she }{\insrsid16348085\charrsid14361973 did not obtain a certificate of no objection from the }{ \insrsid6645542\charrsid14361973 Administrator}{\insrsid16348085\charrsid14361973 General before she applied for and was granted the letters of administration. That }{\insrsid6645542\charrsid14361973 he}{\insrsid16348085\charrsid14361973 only got to know about the grant when the defendant wrote to his wife, Aida Ntungura, demanding that she surrender to her property that was}{\insrsid6645542\charrsid14361973 situated}{\insrsid16348085\charrsid14361973 in Rukungiri}{ \insrsid6645542\charrsid14361973 and the title thereto}{\insrsid16348085\charrsid14361973 because she had become the administrator of the estate of the deceased. He therefore }{\insrsid14954285\charrsid14361973 complained }{ \insrsid16348085\charrsid14361973 that the defendant misrepresented the value of the estate to the Magistrate}{\insrsid6645542\charrsid14361973 \rquote }{\insrsid15424171\charrsid14361973 s court }{\insrsid14954285\charrsid14361973 but it }{ \insrsid16348085\charrsid14361973 was far beyond the jurisdiction of that court}{\insrsid13575082\charrsid14361973 . The plaintiff}{\insrsid16348085\charrsid14361973 }{\insrsid15424171\charrsid14361973 further }{\insrsid13575082\charrsid14361973 complained }{\insrsid15424171\charrsid14361973 that }{\insrsid14954285\charrsid14361973 the }{\insrsid13575082\charrsid14361973 defendant}{\insrsid15424171\charrsid14361973 }{\insrsid16348085\charrsid14361973 misappropriated assets }{ \insrsid13575082\charrsid14361973 in }{\insrsid16348085\charrsid14361973 the }{\insrsid15424171\charrsid14361973 estate of the }{\insrsid16348085\charrsid14361973 deceased}{\insrsid13575082\charrsid14361973 . That in addition}{ \insrsid16348085\charrsid14361973 she was not the mother of all the offspring of the deceased and had failed to take care of the}{\insrsid6645542\charrsid14361973 other}{\insrsid16348085\charrsid14361973 dependants. }{\insrsid14954285\charrsid14361973 Further that}{\insrsid16348085\charrsid14361973 he had committed personal funds }{\insrsid13575082\charrsid14361973 to}{\insrsid16348085\charrsid14361973 the care of beneficiaries to the estate. He thus prayed that he be granted the letters of administration instead}{\insrsid13575082\charrsid14361973 of the plaintiff}{\insrsid16348085\charrsid14361973 .}{\insrsid10387418\charrsid14361973 \par }{\insrsid16348085\charrsid14361973 \par In her written statement of defence, the defendant stated that the plaintiff obtained a grant of letters of administration}{\insrsid284240\charrsid14361973 on 10/12/2002}{\insrsid16348085\charrsid14361973 in Administration Cause No. 131 of 2002 at Mukono Chief Magistrate Court}{\insrsid14954285\charrsid14361973 ,}{\insrsid284240\charrsid14361973 before she did}{\insrsid16348085\charrsid14361973 . That it was the said grant that was revoked following a citation issued at her behest}{\insrsid6165979\charrsid14361973 , Citation}{\insrsid16348085\charrsid14361973 No}{\insrsid6165979\charrsid14361973 .}{\insrsid16348085\charrsid14361973 040 of 2003 arising from Administration Cause No. 131 of 2002}{\insrsid6165979\charrsid14361973 . She }{\insrsid6645542\charrsid14361973 therefore }{\insrsid14954285\charrsid14361973 asserted that }{\insrsid6165979\charrsid14361973 it was the plaintiff who had earlier misrepresented facts relating to the deceased\rquote s estate to court. }{\insrsid6645542\charrsid14361973 She further stated that}{\insrsid6165979\charrsid14361973 since her assumption }{ \insrsid6645542\charrsid14361973 to the}{\insrsid6165979\charrsid14361973 office }{\insrsid6645542\charrsid14361973 of}{\insrsid6165979\charrsid14361973 administratrix }{\insrsid6645542\charrsid14361973 she had }{\insrsid6165979\charrsid14361973 filed two inventories outlining the true account of the deceased\rquote s assets. That while he was the administrator the plaintiff sold off substantial assets in the estate of the deceased. She concluded that the plaintiff was not a person fit to }{ \insrsid463700\charrsid14361973 administer}{\insrsid6165979\charrsid14361973 the estate of her husband}{\insrsid463700\charrsid14361973 and that his suit ought to be dismissed}{\insrsid6165979\charrsid14361973 .}{\insrsid16348085\charrsid14361973

\par }{\insrsid1600337\charrsid14361973 \par The defendant raised a counterclaim against the plaintiff and his wife, Aida Ntungura}{\insrsid16523602\charrsid14361973 }{\insrsid14954285\charrsid14361973 in WSD }{\insrsid16523602\charrsid14361973 in which she sought the rectification/}{ \insrsid1600337\charrsid14361973 cancellation of a certificate of title}{\insrsid14954285\charrsid14361973 for land known as Plot 80 Karegyesa Road in Rukungiri. She claimed}{\insrsid1600337\charrsid14361973 that}{\insrsid14954285\charrsid14361973 land }{\insrsid1600337\charrsid14361973 had been transferred into the names of Aida Ntungura}{\insrsid16523602\charrsid14361973 . She also sought for an order directing the defendants to the counterclaim to }{\insrsid1600337\charrsid14361973 account}{ \insrsid16523602\charrsid14361973 for}{\insrsid1600337\charrsid14361973 the proceeds from the said property}{\insrsid14954285\charrsid14361973 .}{\insrsid16523602\charrsid14361973 She also sought }{\insrsid1600337\charrsid14361973 an order restraining the defendants to the counterclaim from further interfering in the management of the estate.}{\insrsid11675270\charrsid14361973 The counterclaim was later amended to include one Kamadi Kagoro because the defendant claimed he was involved in a fraudulent transaction with the 1}{\super\insrsid11675270\charrsid14361973 st}{\insrsid11675270\charrsid14361973 and 2}{ \super\insrsid11675270\charrsid14361973 nd}{\insrsid11675270\charrsid14361973 defendants to the counterclaim in which he bought one of the assets of the deceased, to wit Block 110 Plot 2225 at Seeta in Mukono District.}{\insrsid16255687\charrsid14361973 }{\insrsid15433205\charrsid14361973 It was served upon the }{\insrsid16255687\charrsid14361973 3}{\super\insrsid16255687\charrsid14361973 rd}{\insrsid16255687\charrsid14361973 defendant to the counterclaim on 7/09/2005 according to }{ \insrsid15433205\charrsid14361973 an }{\insrsid16255687\charrsid14361973 affidavit}{\insrsid15433205\charrsid14361973 deposed by}{\insrsid16255687\charrsid14361973 Adam Bunya}{\insrsid15433205\charrsid14361973 on}{\insrsid16255687\charrsid14361973 8/09/2005.}{\insrsid1600337\charrsid14361973 \par }{\insrsid4995630\charrsid14361973 \par Aida Ntungura}{\insrsid6645542\charrsid14361973 whose advocates }{\insrsid15433205\charrsid14361973 complained }{\insrsid11413062\charrsid14361973 was not served with }{\insrsid15433205\charrsid14361973 a copy of }{\insrsid6645542\charrsid14361973 the counterclaim}{\insrsid4995630\charrsid14361973 filed a }{\insrsid15433205\charrsid14361973 reply }{\insrsid4995630\charrsid14361973 to }{\insrsid15433205\charrsid14361973 it}{\insrsid4995630\charrsid14361973 on the 8/05/2005}{ \insrsid6645542\charrsid14361973 .}{\insrsid4995630\charrsid14361973 }{\insrsid6645542\charrsid14361973 An}{\insrsid4995630\charrsid14361973 advance copy was served }{\insrsid15433205\charrsid14361973 up}{\insrsid4995630\charrsid14361973 on the defendant\rquote s advocates on }{\insrsid11413062\charrsid14361973 the same day}{\insrsid4995630\charrsid14361973 .}{\insrsid11102775\charrsid14361973 }{\insrsid4995630\charrsid14361973 The 3}{\super\insrsid4995630\charrsid14361973 rd}{ \insrsid4995630\charrsid14361973 defendant to counterclaim filed }{\insrsid11102775\charrsid14361973 his}{\insrsid4995630\charrsid14361973 defence on 30/05/2005 and served it on Muhanguzi, Muhwezi & Co.}{\insrsid15433205\charrsid14361973 , the}{ \insrsid4995630\charrsid14361973 Advocates}{\insrsid11102775\charrsid14361973 for the defendant}{\insrsid4995630\charrsid14361973 on the same day. It was received in protest for being out of time.}{\insrsid6645542\charrsid14361973 \par \par The suit was called on for hearing on }{\insrsid9922994\charrsid14361973 several occasions between September 2005 and June 2006. On the 14/06/2006, Kasule, J held a scheduling conference which was attended by the advocates}{ \insrsid4995630\charrsid14361973 }{\insrsid9922994\charrsid14361973 for all the parties}{\insrsid1444458\charrsid14361973 after which th}{\insrsid9922994\charrsid14361973 e suit was set down for hearing on 28/06/2006. That day turned out to be the }{ \insrsid1444458\charrsid14361973 day when a}{\insrsid9922994\charrsid14361973 funeral service }{\insrsid1444458\charrsid14361973 was held for }{\insrsid9922994\charrsid14361973 the Hon Justice}{\insrsid1444458\charrsid14361973 }{ \insrsid9922994\charrsid14361973 Oder, JSC (RIP) so the matter was adjourned to 21/08/2006. There is no record for }{\insrsid1444458\charrsid14361973 21/08/2006}{\insrsid9922994\charrsid14361973 but it would appear that after }{ \insrsid15433205\charrsid14361973 he held the scheduling conference, }{\insrsid9922994\charrsid14361973 Justice Kasule was transferred to Gulu}{\insrsid15433205\charrsid14361973 . It seems }{\insrsid9922994\charrsid14361973 the}{ \insrsid12130731\charrsid14361973 }{\insrsid15433205\charrsid14361973 case }{\insrsid12130731\charrsid14361973 file }{\insrsid15433205\charrsid14361973 then }{\insrsid12130731\charrsid14361973 got misplaced and the}{\insrsid9922994\charrsid14361973 matter lost its place }{\insrsid15433205\charrsid14361973 on }{\insrsid9922994\charrsid14361973 the court calendar. }{\insrsid1444458\charrsid14361973 \par \par After almost three years of waiting}{\insrsid12680145\charrsid14361973 in vain}{\insrsid1444458\charrsid14361973 for the plaintiff or his advocates to take some action}{\insrsid12680145\charrsid14361973 ,}{\insrsid1444458\charrsid14361973 o}{ \insrsid12130731\charrsid14361973 n 24/02/2009 M/s Muhanguzi, Muhwezi & Co Advocates wrote to the Registrar}{\insrsid2570770\charrsid14361973 of the High Court at Kampala}{\insrsid12130731\charrsid14361973 requesting that a duplicate file be opened to facilitate hearing of the case. }{\insrsid2570770\charrsid14361973 Fortunately, the case files were found and on }{\insrsid9922994\charrsid14361973 the }{\insrsid12130731\charrsid14361973 19}{ \super\insrsid9922994\charrsid14361973 th}{\insrsid9922994\charrsid14361973 }{\insrsid12130731\charrsid14361973 March}{\insrsid9922994\charrsid14361973 2009, M/s Muhanguzi, Muhwezi & Co}{\insrsid15433205\charrsid14361973 .,}{ \insrsid9922994\charrsid14361973 Advocates }{\insrsid12130731\charrsid14361973 again }{\insrsid9922994\charrsid14361973 wrote to the Registrar requesting that the}{\insrsid2570770\charrsid14361973 }{\insrsid15433205\charrsid14361973 file }{ \insrsid12130731\charrsid14361973 be allocated to another judge to dispose of the matter. }{\insrsid15433205\charrsid14361973 All the }{\insrsid12130731\charrsid14361973 files}{\insrsid15433205\charrsid14361973 relating to }{ \insrsid2897612\charrsid14361973 the matter}{\insrsid12130731\charrsid14361973 were then sent }{\insrsid11413062\charrsid14361973 back }{\insrsid12130731\charrsid14361973 to this court. He filed a reply on 30/05/05 and had it served upon counsel for the counterclaimant on the same day. However, Order 8 rule 11(1) provides that any person named in a defence as a party to a counterclaim thereby made may, unless some other or further order is made by the court, deliver a reply within fifteen days after service upon him or her of the counterclaim. Kamadi Kagolo\rquote s reply to the counterclaim was therefore late by }{ \lang1033\langfe1033\langnp1033\insrsid15433205\charrsid14361973 6 }{\lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 days.}{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 }{ \lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 \par \par }{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 For }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 the reply to be}{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 legally on the }{ \lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 court }{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 record, Mr. Kagolo had to apply for extension of time within which to file }{ \lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 it}{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 as is provided by Order }{\lang1033\langfe1033\langnp1033\insrsid13128289\charrsid14361973 51 rule 6 CPR. He could have also requested the defendant to consent to the late filing of the reply under the provisions of Order 51 rule 7 CPR. In the absence of an extension of time as provided for by the rules }{ \lang1033\langfe1033\langnp1033\insrsid11800684\charrsid14361973 the }{\lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 reply}{\lang1033\langfe1033\langnp1033\insrsid11800684\charrsid14361973 filed by the 3}{ \lang1033\langfe1033\super\langnp1033\insrsid11800684\charrsid14361973 rd}{\lang1033\langfe1033\langnp1033\insrsid11800684\charrsid14361973 defendant to the counterclaim}{\lang1033\langfe1033\langnp1033\insrsid13128289\charrsid14361973 was incompetent and therefore of no consequence.}{\lang1033\langfe1033\langnp1033\insrsid11800684\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 \par }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 \par }{\lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 It is also true that rule 11(2) of Order }{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 8 provides that }{ \lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 the reply}{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 to the counterclaim}{\lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 shall be served upon the defendant within 15 days after its filing. Order 8 rule 18 (3) provides that a defence to the counterclaim shall be subject to the rules applicable to defences.}{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 Order 9 }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 of the }{\lang1033\langfe1033\langnp1033\insrsid10759856\charrsid14361973 CPR then swings into action. }{\insrsid12862056\charrsid14361973 Order 9 rule 10 provides that }{ \lang1033\langfe1033\langnp1033\insrsid6234781\charrsid14361973 in}{\lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 all suits not specifically provided for in }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 Order}{ \lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 9, in case the party does not file a defence on or before the day fixed therein and upon a compliance with rule 5 of this Order, the suit may proceed as if that part y had filed a defence. Order 9 rule 11 (2) goes on to provide that where the time allowed for filing a defence or, in a suit in which there is more than one defendant, the time allowed for filing the last of the defences expires and the defendant or defen dants have failed to file their defence}{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 (}{\lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 s}{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 )}{ \lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 , the plaintiff may set down the suit for hearing }{\i\lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 ex parte}{ \lang1033\langfe1033\langnp1033\insrsid12862056\charrsid14361973 .}{\lang1033\langfe1033\langnp1033\insrsid14578425\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 \par \par }{\lang1033\langfe1033\langnp1033\insrsid14578425\charrsid14361973 Counsel for the plaintiff to the counterclaim in this matter followed the provisions}{\lang1033\langfe1033\langnp1033\insrsid15433205\charrsid14361973 above}{ \lang1033\langfe1033\langnp1033\insrsid14578425\charrsid14361973 when he}{\lang1033\langfe1033\langnp1033\insrsid15433205\charrsid14361973 moved for the suit to be}{\lang1033\langfe1033\langnp1033\insrsid14578425\charrsid14361973 set down for hearing}{ \lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 on 30/}{\lang1033\langfe1033\langnp1033\insrsid15433205\charrsid14361973 08}{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 /10}{ \lang1033\langfe1033\langnp1033\insrsid14578425\charrsid14361973 .}{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 Mr. Kagolo was therefore not properly before court when he applied for an adjournment because he had not filed a reply to the counterclaim within the time required by the rules. He did not apply for extension of time within which to so and his reply w as of no effect. His application could not be entertained in }{\lang1033\langfe1033\langnp1033\insrsid15433205\charrsid14361973 those }{\lang1033\langfe1033\langnp1033\insrsid2578619\charrsid14361973 circumstances. \par }{\lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 \par Having found so, I will now deal with the plaintiff}{\lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 \rquote s failure}{\lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 to}{ \lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 move court to}{\lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 have his suit set down }{ \lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 for hearing. The defendan}{\lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 t filed her last defence on 24/05/2005. The suit was transferred to the High Court }{ \lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 at }{\lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 Jinja on the 22/06/2006. Since then the plaintiff and his advocates made no effort to }{ \lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 have court set down }{\lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 the suit for hearing. It took }{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 over }{ \lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 4 years for }{\lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 that to happen}{\lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 and }{ \lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 it }{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 was finally done }{\lang1033\langfe1033\langnp1033\insrsid15746720\charrsid14361973 at the behest of }{ \lang1033\langfe1033\langnp1033\insrsid6104346\charrsid14361973 the defendant\rquote s advocate}{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 s}{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 . }{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 \par \par }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 It }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 is also clear from the record }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 that it was always the defendant and her advocates that }{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 made every effort to have}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 }{ \lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 the }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 suit move forward towards }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 hearing and }{ \lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 completion. It was }{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 defendant\rquote s}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 advocate that filed Miscellaneous Application No. 92 of 200}{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 5}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 }{ \lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 which resulted in}{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 the }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 case file}{ \lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 being }{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 transferred}{ \lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 from the Magistrates Court at Mukono to}{\lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 this court}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 .}{ \lang1033\langfe1033\langnp1033\insrsid16395463\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 On 9/08/2005 }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 the same advocates}{ \lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 applied for a certificate of urgency to have the matter heard during the court vacation }{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 and that}{ \lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 was granted on the 11/08/2005. This led to the case}{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 file}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 being transferred to Kampala as an urgent matter because the only judge at Jinja was }{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 then }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 engaged in a criminal session at Mukono.}{\lang1033\langfe1033\langnp1033\insrsid10227635\charrsid14361973 Unfortunately the matter was not heard at the time. \par \par }{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 Because the plaintiff had all along shown no interest in having the suit set down for hearing, on 6/6/2006 }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 counsel for the defendant}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 filed Msc. Application No. 59 of 2006 under the provisions of Order 6 rules 28, 29 and 30}{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 ,}{ \lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 as well as Order 7 rule 11}{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 CPR}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 to have the suit dismissed} {\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 . The application was not heard}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 but as a result of it the suit }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 was }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 set down for }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 the }{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 scheduling conference which took place on }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 14}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 /06/2006. }{ \lang1033\langfe1033\langnp1033\insrsid9118928\charrsid14361973 It appears that a}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 fter the conference }{\lang1033\langfe1033\langnp1033\insrsid11813349\charrsid14361973 Justice Kasule}{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 was transferred to Gulu. That may be so}{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 ,}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 but again the plaintiff }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 and his advocates }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 took no steps in the suit till }{ \lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 19/03/2009 when }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 counsel }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 for the defendant }{ \lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 moved th}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 e Family Division at Kampala}{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 to set it down}{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 for hearing}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 . The file was then sent back to Jinja in April 2009}{ \lang1033\langfe1033\langnp1033\insrsid16412136\charrsid14361973 because the Family Division was overwhelmed with work}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 . The defendant\rquote s advocates}{ \lang1033\langfe1033\langnp1033\insrsid14952019\charrsid14361973 again followed up the matter and on the 28/06/10}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 the}{\lang1033\langfe1033\langnp1033\insrsid14952019\charrsid14361973 y}{ \lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 took out hearing notices for}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 30/08/10}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 and served them }{ \lang1033\langfe1033\langnp1033\insrsid14952019\charrsid14361973 up}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 on the plaintiff and defendants to the counterclaim. That was all of }{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 4 years}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 after the 14/06/06 when the scheduling conference took place}{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 .}{\lang1033\langfe1033\langnp1033\insrsid1380683\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 From}{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 his }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 dilatory }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 conduct and that of his advocates}{ \lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 , I came to the conclusion}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 that the plaintiff }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 was }{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 no longer interested in }{\lang1033\langfe1033\langnp1033\insrsid3757651\charrsid14361973 the }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 suit.}{ \lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 \par \par The courts in East Africa have had occasion to discuss the issue of delay}{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 in cases where they ar e called upon to extend time for taking further steps }{\lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 mostly}{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 in applications to }{ \lang1033\langfe1033\langnp1033\insrsid10879411\charrsid14361973 extend time within which to appeal}{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 . I am of the view that }{ \lang1033\langfe1033\langnp1033\insrsid1859726\charrsid14361973 the }{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 principles}{\lang1033\langfe1033\langnp1033\insrsid1859726\charrsid14361973 that have been established in such matters} {\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 can be applied }{\lang1033\langfe1033\langnp1033\insrsid16594227\charrsid14361973 to }{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 the situation before me now.}{ \lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid11879834\charrsid14361973 I thought that the}{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 conduct of }{ \lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 the plaintiff and }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 his advocates was negligent and it resulted}{ \lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 into delay that was inordinate because the situation here is similar to that in the case of }{\b\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 Martin v. Anderson [2006] 1 EA 168}{\lang1033\langfe1033\langnp1033\insrsid11879834\charrsid14361973 . In that case}{\lang1033\langfe1033\langnp1033\insrsid12526914\charrsid14361973 the Court of Appeal of Tanzania held that a period of 4 years without applying for leave to appeal out of time no doubt constituted inordinate delay. }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 }{\lang1033\langfe1033\langnp1033\insrsid9855083\charrsid14361973 \par }{\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 \par }\pard \qj \li0\ri360\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin360\lin0\itap0\pararsid14361973 {\lang1033\langfe1033\langnp1033\insrsid7157570\charrsid14361973 In }{\b\lang1033\langfe1033\langnp1033\insrsid741088\charrsid14361973 Juliet Kalema v. Rhoda & William Kalema}{\b\lang1033\langfe1033\langnp1033\insrsid15677730\charrsid14361973 ;}{\b\lang1033\langfe1033\langnp1033\insrsid741088\charrsid14361973 C/A }{\b\insrsid741088\charrsid14361973 Civil Application No. 24 of 2004}{ \insrsid741088\charrsid14361973 , the court observed as the Supreme Court did in }{\b\insrsid741088\charrsid14361973 Utex Industries Ltd v}{\b\insrsid16594227\charrsid14361973 .}{\b\insrsid741088\charrsid14361973 Attorney General, SCCA No.52 of 1995}{ \insrsid741088\charrsid14361973 , that in order to avoid delays, rules of Court provide a timetable within which certain steps ought to be taken. F}{\insrsid16594227\charrsid14361973 urther that f}{\insrsid741088\charrsid14361973 or any delay to be excused, it must be explained satisfactorily. }{\insrsid12526914\charrsid14361973 Though the plaintiff and his advocates were not before me when the suit was called for hearing, }{\insrsid741088\charrsid14361973 I }{ \insrsid12526914\charrsid14361973 could not}{\insrsid741088\charrsid14361973 deduce any explanation}{\insrsid12526914\charrsid14361973 from the record}{\insrsid741088\charrsid14361973 that would be satisfactory to explain the delay of 4 years within which the plaintiff and his advocates took no action whatsoever to move court to set down this suit for hearing}{\insrsid12526914\charrsid14361973 .}{\insrsid741088\charrsid14361973 That being the case, }{\insrsid12526914\charrsid14361973 I would hold that }{\insrsid741088\charrsid14361973 those 4 years constituted ample time within which the plaintiff}{\insrsid12526914\charrsid14361973 /his advocates}{ \insrsid741088\charrsid14361973 could have fixed the suit for hearing and adduced his evidence.
