Ruling

1. What is before the court for determination is the Notice of Motion application dated 8th November, 2024 in which the Applicant is seeking that the Ruling of the Party and Party Bill of costs be adopted as Judgment and Decree of the court. When the matter came up for mention before court on 7th April, 2025, Counsel for the Respondent sought leave to file response to the application dated 8th November, 2024 which had been filed by the Applicant. The court granted the Respondent leave to file the response as sought for and issued further directions on disposal of the same.

2. The court has gone through the case tracking system and found another application dated 14th March, 2024 (which must be a typographical error meant to read 2025) seeking to set aside the taxation orders and Ruling of 19th September, 2024 but the same has not been paid for.

3. In light of the afore stated status in this matter, the court issues the following directions:-a.The Applicant in Notice of Motion application dated 14th March, 2025 (2024) to regularise the same in terms of payment within seven (7) days from the date hereof otherwise the same will be disregarded and the court shall proceed with the Ruling in respect of the application dated 8th November, 2024. b.The parties are granted leave to file responses to the two applications, if need be, alongside skeleton submissions within seven (7) days from the date hereof.c.Mention on 24th June, 2025 for parties to confirm compliance and take further directions.
