MUKANZA \par }\pard \s15\qc \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid15482725 {\b\ul\insrsid15482725\charrsid3428257 RULIN}{\b\ul\insrsid1798830\charrsid3428257 G}{ \b\insrsid15482725\charrsid3428257 \par }\pard \s15\qj \li0\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid15482725 {\insrsid1798830\charrsid3428257 This is an application by notice of m}{\insrsid15482725\charrsid3428257 otion brought by the applicant/plaintiff under}{\insrsid1798830\charrsid3428257 order }{\insrsid1798830\charrsid3428257 37}{\i\insrsid1798830\charrsid3428257 }{\insrsid1798830\charrsid3428257 rule 1 and order 48 rules I and 2 of the Civil }{ \insrsid7995502\charrsid3428257 Procedure Rules seeking }{\insrsid1798830\charrsid3428257 for}{\i\insrsid1798830\charrsid3428257 }{\insrsid7995502\charrsid3428257 a}{\insrsid1798830\charrsid3428257 n}{\i\insrsid1798830\charrsid3428257 }{ \insrsid1798830\charrsid3428257 order }{\insrsid7995502\charrsid3428257 from this court for a }{\insrsid1798830\charrsid3428257 temporary injunction to restrain the }{\insrsid7995502\charrsid3428257 respondent/defendant from}{ \insrsid1798830\charrsid3428257 taking or in any way disposing of the stock which is in this shop }{\insrsid7995502\charrsid3428257 which }{\insrsid1798830\charrsid3428257 used to belong t}{\insrsid7995502\charrsid3428257 o}{ \insrsid1798830\charrsid3428257 the late David Kiiza, }{\insrsid7995502\charrsid3428257 collecting and receiving }{\insrsid1798830\charrsid3428257 rents from }{\insrsid7995502\charrsid3428257 the}{\insrsid1798830\charrsid3428257 }{ \insrsid7995502\charrsid3428257 tenants}{\insrsid1798830\charrsid3428257 at }{\insrsid7995502\charrsid3428257 Rwengom}{\insrsid1798830\charrsid3428257 a, cutting bunches }{\insrsid7995502\charrsid3428257 o}{\insrsid1798830\charrsid3428257 f Matooke }{ \insrsid7995502\charrsid3428257 from}{\insrsid1798830\charrsid3428257 the }{\insrsid7995502\charrsid3428257 plantation at Rwengoma, c}{\insrsid1798830\charrsid3428257 utting }{\insrsid7995502\charrsid3428257 eucalyptus}{\i\insrsid1798830\charrsid3428257 }{\insrsid1798830\charrsid3428257 trees }{\insrsid1798830\charrsid3428257 from}{\b\i\insrsid1798830\charrsid3428257 }{\insrsid1798830\charrsid3428257 the tree plantation at Rwengoma, using money }{\insrsid7995502\charrsid3428257 accruing}{ \insrsid1798830\charrsid3428257 fr}{\insrsid7995502\charrsid3428257 om the estate of the late David}{\insrsid1798830\charrsid3428257 Kiiza, and finally that the }{\insrsid7995502\charrsid3428257 respondent}{\insrsid1798830\charrsid3428257 /}{ \insrsid7995502\charrsid3428257 defendant be re}{\insrsid1798830\charrsid3428257 trained in any way from interfering with the estate of the late David Kiiza until}{\insrsid678841\charrsid3428257 further orders of this court. \par }{\insrsid1798830\charrsid3428257 In her affidavit in support of the application the applicant/}{\insrsid678841\charrsid3428257 plaintiff deponed as follows:- \par }{\i\insrsid1798830\charrsid3428257 \'93That she is the widow of }{\i\insrsid11211693\charrsid3428257 the late David Kiiza }{\i\insrsid1798830\charrsid3428257 who died int}{\i\insrsid11211693\charrsid3428257 estate on 22nd February, 1991. On 10}{ \i\super\insrsid11211693\charrsid3428257 th}{\i\insrsid11211693\charrsid3428257 }{\i\insrsid1798830\charrsid3428257 April 1991}{\i\insrsid3428257 she applied to the High Court }{\i\insrsid1798830\charrsid3428257 at Fort Portal for letters of administratio}{\i\insrsid11211693\charrsid3428257 n to be granted to her. On 17}{\i\super\insrsid11211693\charrsid3428257 th}{\i\insrsid11211693\charrsid3428257 }{\i\insrsid1798830\charrsid3428257 April 1991 the defendant purportedly laid a caveat against the said application by her. In consequence the estate of the deceased remain}{\i\insrsid11211693\charrsid3428257 s}{\i\insrsid1798830\charrsid3428257 without a le}{ \i\insrsid11211693\charrsid3428257 gally appointed administrator. \par }{\i\insrsid1798830\charrsid3428257 That one Richard Sabiiti and Moses Kandole both brothers of the deceased were interfering with the estate. The said Sabiiti had since the de}{\i\insrsid11211693\charrsid3428257 ath of the deceased run the shop}{ \i\insrsid1798830\charrsid3428257 and s}{\i\insrsid11211693\charrsid3428257 old off most of the stock}{\i\insrsid15673036\charrsid3428257 and that was likely to continue. The defendant was not only }{\i\insrsid1798830\charrsid3428257 supporting the acts of Sabiiti and Kandole}{\i\insrsid15673036\charrsid3428257 but also benefits from them. \par }{\i\insrsid1798830\charrsid3428257 That the Caveat en}{\i\insrsid15673036\charrsid3428257 tered by the defendant/responden}{\i\insrsid1798830\charrsid3428257 t was inten ded to maintain the status quo. As a result of the status quo the stock in the shop has }{\i\insrsid15673036\charrsid3428257 been greatly reduced from Shs. 1}{\i\insrsid1798830\charrsid3428257 ,940,000/= as it was originally at the time of Kiiza\rquote s death to about Shs. 200,000/= or less presently. That since the death of the dece ased about ten eucalyptus trees have been cut down from the plantation at Rwengoma and that now more are likely to be cut by her sister in law with full backing of the respondent/defendant. Since the death of the deceased}{ \i\insrsid15673036\charrsid3428257 }{\i\insrsid1798830\charrsid3428257 she has not been provided wi}{\i\insrsid3428257 th any money to look after the }{\i\insrsid1798830\charrsid3428257 children of the deceased.\'94 }{\i\insrsid15673036\charrsid3428257

\par }{\insrsid1798830\charrsid3428257 In his submissions to this court the learned counsel representing the applicant read the affidavits}{\insrsid7408822\charrsid3428257 in support of the applications.}{\insrsid4610101\charrsid3428257 }{ \insrsid1798830\charrsid3428257 I do not therefore hav}{\insrsid7408822\charrsid3428257 e to reproduce his submission. \par }{\insrsid1798830\charrsid3428257 The learned counsel appea}{\insrsid7408822\charrsid3428257 ring for the respondent/defendant submitted}{\insrsid1798830\charrsid3428257 t}{\insrsid7408822\charrsid3428257 hat the main issue there is}{ \insrsid1798830\charrsid3428257 the mutual }{\insrsid7408822\charrsid3428257 relationship between the }{\insrsid1798830\charrsid3428257 applicant and the respondent. By }{\insrsid7408822\charrsid3428257 issuing a temporary}{ \insrsid1798830\charrsid3428257 applicant the honourable court would be }{\insrsid7408822\charrsid3428257 determining the issue of the }{\insrsid1798830\charrsid3428257 relationship }{\insrsid7408822\charrsid3428257 between}{ \insrsid1798830\charrsid3428257 the applicant and the respondent because that would be indicating that the applicant has beneficiary interest or otherwise in the estate of the late Kiiza and the court would be deciding the main issue}{ \insrsid7408822\charrsid3428257 and thus disposing of the same}{\insrsid1798830\charrsid3428257 . A tempora}{\insrsid7408822\charrsid3428257 ry injunction cannot be granted w}{\insrsid1798830\charrsid3428257 here the effect could be to dispose of the main issue. He referred me to the case of }{\ul\insrsid7408822\charrsid3428257 Muslim Supreme Court . V.}{\ul\insrsid1798830\charrsid3428257 Mulumba and others 1980 HCB P. 11 }{\insrsid7408822\charrsid3428257 A temporary injunction is also }{\insrsid1798830\charrsid3428257 issued where there is a likelihood of irreparable injury caused to the applicant if the grant of such injunction were not made. He referred me to the case of }{ \ul\insrsid1798830\charrsid3428257 Rwenzori Tea Co. Ltd }{\ul\insrsid7408822\charrsid3428257 vs.}{\ul\insrsid1798830\charrsid3428257 Kelsale ULR Vol. }{\ul\insrsid7408822\charrsid3428257 8}{\ul\insrsid1798830\charrsid3428257 Page 204.}{ \ul\insrsid7408822\charrsid3428257 \par }{\insrsid1798830\charrsid3428257 He continued it was the contention of the defendant/respondent that the applicant had no beneficiary interest or otherwise in the estate of the deceased. Therefore she could }{\insrsid4610101\charrsid3428257 not benefit from an order made }{\insrsid1798830\charrsid3428257 by this court in this suit of the est}{\insrsid4610101\charrsid3428257 ate of the late Kiiza. She has }{\insrsid1798830\charrsid3428257 nothing to suffer, if t}{ \insrsid4610101\charrsid3428257 he deceased\rquote s estate was put to waste as she alleges. }{\insrsid1798830\charrsid3428257 The purpose of the provisions of order }{\i\insrsid1798830\charrsid3428257 37 }{\insrsid1798830\charrsid3428257 of the Civil Procedure rules were not meant to benefit persons without any interest in the property allegedly being protected. The mere fact that the applicant had children with the deceased was not enough. That did not e ntitle her to a share in the estate of the deceased,}{\insrsid3428257 I was referred to the case of }{\b\ul\insrsid4610101\charrsid3428257 Christine Male}{\b\ul\insrsid6116509\charrsid3428257 & Another }{\b\ul\insrsid4610101\charrsid3428257 . V. S. M Namanda & another 1982 HCB Page 140}{\b\ul\insrsid1798830\charrsid3428257 .}{\ul\insrsid1798830\charrsid3428257 }{\insrsid4610101\charrsid3428257 \par }{\insrsid1798830\charrsid3428257 The learned counsel further submitted that following the death of the late }{\insrsid4610101\charrsid3428257 K}{\insrsid1798830\charrsid3428257 iiza the family membe}{\insrsid4610101\charrsid3428257 rs a ppointed a committee to care take}{\insrsid1798830\charrsid3428257 the Estate o}{\insrsid4610101\charrsid3428257 f the deceased. What the applicant}{\insrsid1798830\charrsid3428257 i}{\insrsid4610101\charrsid3428257 s alleging in the }{ \insrsid1798830\charrsid3428257 application is meant to maintain the estate and look after the whole family of the }{\insrsid4610101\charrsid3428257 deceased\rquote s children}{\insrsid1798830\charrsid3428257 . In this Case }{ \insrsid1798830\charrsid3428257 what}{\i\insrsid1798830\charrsid3428257 }{\insrsid1798830\charrsid3428257 th}{\insrsid4610101\charrsid3428257 e responden}{\insrsid1798830\charrsid3428257 t and other committee members were trying to do was to pre}{ \insrsid4610101\charrsid3428257 serve the }{\insrsid1798830\charrsid3428257 estate of the deceased until a proper person could apply to administer the estate. That the deceased was surv}{\insrsid4610101\charrsid3428257 ived by 10 children. Therefore }{ \insrsid1798830\charrsid3428257 the said committee is using the estate left by the d}{\insrsid4610101\charrsid3428257 eceased to }{\insrsid3428257\charrsid3428257 maintain the}{\insrsid4610101\charrsid3428257 welfare of the deceased\rquote s}{ \insrsid1798830\charrsid3428257 children. T}{\insrsid3428257 he family could not wait until }{\insrsid1798830\charrsid3428257 the person has been appointed to administer the estate so as to look after the welfare of the children. In }{ \insrsid4610101\charrsid3428257 other words}{\insrsid1798830\charrsid3428257 the learned counsel commended that the family committee has taken effective control and admin}{\insrsid4610101\charrsid3428257 ister the estate of the late Ki}{ \insrsid1798830\charrsid3428257 iza as deponed by the applicant in her }{\insrsid4610101\charrsid3428257 affidavit}{\insrsid1798830\charrsid3428257 . }{\insrsid4610101\charrsid3428257 \par }{\insrsid1798830\charrsid3428257 In reply the learned counsel representing the applicant/plaintiff submitted that his learned friend should have }{\insrsid4610101\charrsid3428257 concentrated}{\insrsid3428257 on the law and }{ \insrsid1798830\charrsid3428257 not on evidence because he should have s}{\insrsid4610101\charrsid3428257 ubmitted an affidavit in reply. }{\insrsid1798830\charrsid3428257 He prayed tha}{\insrsid4610101\charrsid3428257 t the Honourable court does not attach}{\insrsid3428257 any weight to part }{\insrsid1798830\charrsid3428257 of his repl}{\insrsid4610101\charrsid3428257 y to the applicant\rquote s affidavit. \par }{\insrsid1798830\charrsid3428257 About the marital status of the, applicant the learned counsel submitted that both in the application for letters of administration and in the present application the applicant leaves no doubt that she was married to the deceased the owner of the estate. The same fact features in the plaint it was up to the }{ \insrsid4610101\charrsid3428257 respondent}{\insrsid1798830\charrsid3428257 to swear an affidavit showing that the applicant/plaintiff wa}{\insrsid4610101\charrsid3428257 s not married to the deceased. \par }{\insrsid1798830\charrsid3428257 I have had the }{\insrsid4610101\charrsid3428257 occasion}{\insrsid1798830\charrsid3428257 to peruse the affidavit in support of the application and also listened to the lengthy }{\insrsid4610101\charrsid3428257 submission of the learned }{\insrsid1798830\charrsid3428257 counsels representing the parties. The conditions for the grant of interlocutory injunctions was laid down by Spray v P in the case of }{\b\ul\insrsid4610101\charrsid3428257 Giella vs Casman Brown an}{\b\ul\insrsid1798830\charrsid3428257 d Co. The learned counsel representing the re}{ \insrsid6116509\charrsid3428257 spondent submitted that the app}{\insrsid1798830\charrsid3428257 licant is not a }{\insrsid6116509\charrsid3428257 beneficiary}{\insrsid1798830\charrsid3428257 to the estate of the deceased and that the mere fact that she had children with the deceased that alone, did not entitle her to administer the estate of the deceased. What was contained in the affidavit was evidence. The }{ \insrsid6116509\charrsid3428257 respondent never swore an affidav}{\insrsid1798830\charrsid3428257 it in reply to controvert the }{\insrsid6116509\charrsid3428257 applicant\rquote s}{\insrsid1798830\charrsid3428257 affidavit. The lea}{ \insrsid6116509\charrsid3428257 rned counsel submitted that there}{\insrsid1798830\charrsid3428257 was a family committee appointed to }{\insrsid6116509\charrsid3428257 care take}{\insrsid1798830\charrsid3428257 the estate of the deceased. It is }{ \insrsid6116509\charrsid3428257 n}{\insrsid1798830\charrsid3428257 ot known who the members of the committee}{\insrsid6116509\charrsid3428257 are}{\insrsid1798830\charrsid3428257 and their relationship with the deceased. The learned }{ \insrsid6116509\charrsid3428257 counsel}{\insrsid1798830\charrsid3428257 submitted }{\insrsid6116509\charrsid3428257 that the committee looks after }{\insrsid1798830\charrsid3428257 the 10 children of the deceased. It is not clear whether the ten }{ \insrsid6116509\charrsid3428257 children inclu}{\insrsid1798830\charrsid3428257 de the issues of the appli}{\insrsid6116509\charrsid3428257 cant or they are children from other w}{\insrsid1798830\charrsid3428257 omen. The }{ \insrsid6116509\charrsid3428257 respondent should have resolved the}{\insrsid1798830\charrsid3428257 matter}{\insrsid6116509\charrsid3428257 by filing an affidavit in reply}{\insrsid1798830\charrsid3428257 . As }{\insrsid6116509\charrsid3428257 far}{ \insrsid1798830\charrsid3428257 as this court is concerned there is evidence}{\insrsid6116509\charrsid3428257 that the applicant was the widow/w}{\insrsid1798830\charrsid3428257 ife of the deceased and this in my considered opinion presupposes a valid marriage between the applicant and the late David Kiiza. Therefore under S. 201 of the Succession Act Cap 139 as amended by section 1 (p) of the Succession Amendment Decree 22 o f 1972 she is entitled to grant of letters of administration. In the end the applicant had shown a prima facie case }{\insrsid6116509\charrsid3428257 with the probability of success. \par Be that as it may the estate}{\insrsid1798830\charrsid3428257 of the late David Kiiza appear}{\insrsid6116509\charrsid3428257 s}{\insrsid1798830\charrsid3428257 to have substantial assets. There are houses from which the respondent and his agents are collecting a lot}{\insrsid6116509\charrsid3428257 of rent.}{\insrsid1798830\charrsid3428257 There is }{\insrsid6116509\charrsid3428257 a }{\insrsid1798830\charrsid3428257 shop whose stock was worth over a million at the time the deceased passed away. The stock ha}{\insrsid6116509\charrsid3428257 s now depleted to bare Sh.200,000,/=.}{\insrsid1798830\charrsid3428257 Mato}{\insrsid6116509\charrsid3428257 o}{ \insrsid1798830\charrsid3428257 ke in banana plantations are being cut down at random and even eucalyptus trees are being cut from the shamba of trees. If at all the temporary }{\insrsid6116509\charrsid3428257 injunction}{\insrsid1798830\charrsid3428257 is not granted the applicant }{\insrsid6116509\charrsid3428257 might suffer irreparable damage which would not adequately be compensated by }{\insrsid1798830\charrsid3428257 an award of damages. It would be v ery difficult to measure damages that would be granted to the applicant in case the temporary }{\insrsid6116509\charrsid3428257 injunction was not granted. \par }{\insrsid1798830\charrsid3428257 I am of the opinion that the applicant}{\insrsid6116509\charrsid3428257 had put a strong case for the g}{\insrsid1798830\charrsid3428257 rant of a temporary }{\insrsid6116509\charrsid3428257 injunction}{ \insrsid1798830\charrsid3428257 . }{\insrsid6116509\charrsid3428257 I}{\insrsid1798830\charrsid3428257 do not therefore think it is }{\insrsid6116509\charrsid3428257 necessary}{\insrsid1798830\charrsid3428257 to consider the last ingredient upon which the court has to consider when granting the interlocutory injunction. That is when in doubt the court would decide the application on balance of convenience}{\insrsid6116509\charrsid3428257 . \par }{\insrsid1798830\charrsid3428257 I think it is }{\insrsid6116509\charrsid3428257 appropriate}{\insrsid1798830\charrsid3428257 at this stage to}{\insrsid6116509\charrsid3428257 }{\insrsid1798830\charrsid3428257 c omment upon some of authorities cited by the learned counsel representing the respondent in support of h}{\insrsid6116509\charrsid3428257 i}{\insrsid1798830\charrsid3428257 s }{\insrsid6116509\charrsid3428257 submission. In the case of }{ \b\insrsid6116509\charrsid3428257 Christine Male & Anor . V. S. M}{\b\insrsid1798830\charrsid3428257 }{\b\insrsid6116509\charrsid3428257 Na}{\b\insrsid1798830\charrsid3428257 manda & Anor Supra}{\insrsid1798830\charrsid3428257 There the court considered about the grant of letters of Administration where}{\insrsid6116509\charrsid3428257 the deceased left a legal wife,}{\insrsid1798830\charrsid3428257 }{\insrsid6116509\charrsid3428257 concubine and young children}{ \insrsid3428257\charrsid3428257 with different mothers. The}{\insrsid1798830\charrsid3428257 court held that the only person entitled t}{\insrsid3428257\charrsid3428257 o grant of letters of administration}{\insrsid1798830\charrsid3428257 was the legal wife. The fact}{\insrsid3428257\charrsid3428257 s of that Case is distinguishable}{\insrsid1798830\charrsid3428257 fr}{\insrsid3428257\charrsid3428257 om the instant case. In that in the instant case only}{\insrsid1798830\charrsid3428257 a wife is involved whereas in Christine}{\insrsid3428257\charrsid3428257 case there were more than one.}{\insrsid1798830\charrsid3428257 Also in the instant case there is no evidence to show that the applicant was not the legal wife of the late David Kiiza. With regard to the other 2 authorities referred to me i.e. Rwenzori the Estate & Muslims Supreme council. I have not been able to find a copy of HCB 1980 and the ULR Volume 7 and even the counsel failed to provide me with the authorities. Nonetheless I am satisfied that the applica nt made up a strong case which entitles her to grant of a temporary injunction.}{\insrsid3428257 \par }{\insrsid1798830\charrsid3428257 In the premises th}{\insrsid3428257\charrsid3428257 e}{\insrsid1798830\charrsid3428257 applicant }{\insrsid3428257\charrsid3428257 is granted a temporary }{\insrsid3428257 injunction to restrain the }{ \insrsid3428257\charrsid3428257 respondent/defendant}{\insrsid1798830\charrsid3428257 his servants and or agents from selling taking in any way disposing of the stock which is in the }{\insrsid3428257\charrsid3428257 sho}{\insrsid1798830\charrsid3428257 p which used to belong to the late David Kiiza, collecting and or receiving rents from the tenants at}{\insrsid3428257\charrsid3428257 Rwengoma, cutting bunches of m}{\insrsid1798830\charrsid3428257 atooke from the plantation at Rwengoma, cutting eucalyptus trees from the tree }{\insrsid3428257\charrsid3428257 plantation}{\insrsid1798830\charrsid3428257 at Rwengom a, using money accruing from the estate of the late David Kiiza, Also the respondent his servants and or a}{\insrsid3428257\charrsid3428257 gents are restrained}{\insrsid1798830\charrsid3428257 in any way from interfering with the estate of the late David Kiiza until furth}{\insrsid3428257\charrsid3428257 er orde}{\insrsid1798830\charrsid3428257 r by }{\insrsid3428257\charrsid3428257 this court.
