RULING

The applicant through the law firm of Gacheru & Co. Advocates by an originating summons dated 12th March 2012 moved the court that they be authorized to adopt Baby A.K. (minor).  The application was supported by the affidavit of F.M.K. In which he deponed that he applied on 24th May 2010 for adoption of a child to the Children Welfare Society which application was approved on 13th May 2010 by the adoption case committee.

It was deponed that the child had been in their care and possession since 20th July 2010.

In support of the said application Child Welfare Society of Kenya filed a report on 5th November 2012 in which it was restated that the minor was born on 20th October 2006 at Kenyatta National Hospital and the mother subsequently abandoned the child thereat.  There was also a report by the police confirming that the child is available for adoption.

It would therefore be in the best interest of the child that the same be adopted by the applicant since all the legal requirements have been met, the application dated 21st March 2012 is therefore hereby allowed.
