He asked the deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 what he was doing there. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 After}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 some altercation }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 the appellan}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 t }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 sent }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 his}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 wife for a knife removed it from her and stabbed the deceased with}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 it. Both (PW}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 7) }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 and }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 (P.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 W}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 8) }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 ran away. \par P. W2 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 Andrew}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 Kyeyune gave a more detailed account of the conversat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 ion between tae appellant and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 the deceased. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 When}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 the appellant arrived he asked the deceased why he demanded money when his wife had not been cured, but the deceased kept on with his demand. The ap \lquote ellant told the deceased that he would be beaten if he continued with his demand for money.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355 Thea the deceased replied:\emdash \par \'93i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 f you }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7941355\charrsid8010116 beat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 me }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 whereas}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 you }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 have}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 refused to pay m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 e I will p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 lant a bean and you will die\'94. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 Whereupon}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 app}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 ellant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 go}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 t hold of t}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 h}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 e deceased and b}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 ox}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 ed and kicked}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 him. The deceased then said:\emdash \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 You}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 are }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 beating}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 me but I am asking, for money. \par At this juncture the appel}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 lant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 asked }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 his}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 wife}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 to collect}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 a knife. As the wife was coming with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 knife the appellant w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 ent and snatched it from her, came}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 and stabbed the d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 eceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 in the chest and at the back with }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \insrsid14304057 it. }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid14304057 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 The deceased died immediately. Hi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 s body was tied up with a wire }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 by the appellant and thrown in a ditch. The matter was then reported to the Muluka Chief and later to Jinja Road Polic}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 e Station. Briefly that is the p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 rosecution evidence that led to the appellant\rquote s arrest and eventual indict}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 ment and conviction of murder. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 In his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 sw}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 orn }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 statement}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 appellant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 gave a similar account of the conversation that took place between them with a slight difference in that P.7, P8 and the deceased }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 caught him and in self\emdash defence p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 ulled out a knife he was carrying and stabbed him. DW1 Jane Namakula, wife of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 appellant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 , gave evidence for the defence. She heard the deceased demanding money }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 but}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 did not hear th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 e appellant\rquote s reply. As she was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 going}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 }{ \rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 away }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 she turned and saw th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 e appellant stab the deceased. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 It seems to us that the evidence as a whole brings out prominently the question of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 provocation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 . This question was dealt with by the learned trial judge in his judgment. Ye said:\emdash }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 \par }\pard \ltrpar\s15\qj \li720\ri0\sb100\sa240\sbauto1\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\ipgp1\pararsid14304057 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 \'93It could be that he b}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 elieved in witchcraft himself for he pre}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057\charrsid8010116 ferred}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 the deceased to treat his }{ \rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 w}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid14304057 i}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 f}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid14304057 e}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 by means of native }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 medicine rather than take her to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 hospital. She was}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 in fact }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 there and}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 he withdrew }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 her. He said that he took what th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 e deceased sai}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 d seriously for h}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 e knew }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 people}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 from Tanzania }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 were}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 tough. On these facts I am unable to say he }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 would not be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077\charrsid8010116 provoked}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 . His reaction was to be}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 at the deceased and start kicking him. If the deceased died }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077\charrsid8010116 as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 a result of these beatings at this juncture, I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077\charrsid8010116 w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 ou}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077\charrsid8010116 ld}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 have held that the of}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 fence would be reduced to man}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077\charrsid8010116 slaughter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4395439\charrsid8010116 by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14304057 reason of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11747077 provocation.
