The respondent also filed an affidavit in reply deponed to by Mr. Muliisa Peter said to be a Manager }{\insrsid7423916\charrsid14033962 Prosecution}{\insrsid3995\charrsid14033962 employed with Uganda Revenue Authority in which }{ \insrsid5642591\charrsid14033962 h}{\insrsid3995\charrsid14033962 e}{\insrsid5118452\charrsid14033962 contend}{\insrsid5642591\charrsid14033962 s }{\insrsid7423916\charrsid14033962 that}{\insrsid5642591\charrsid14033962 the application for bail is baseless as the so called appeal has no chances of success. He invited me to dismiss the same.}{\insrsid11958740\charrsid14033962 \par }{\insrsid5642591\charrsid14033962 \par Mr. James Okuku, learned counsel for the applicant and Mr. }{\insrsid7423916\charrsid14033962 George}{\insrsid5642591\charrsid14033962 Okello counsel for the respondent made long submissions in }{\insrsid7423916\charrsid14033962 support}{ \insrsid5642591\charrsid14033962 of their respective }{\insrsid7423916\charrsid14033962 positions}{\insrsid5642591\charrsid14033962 in the bail applications. I have carefully studied all the documents filed by them and their submissions. They }{ \insrsid3995\charrsid14033962 both rely on the C}{\insrsid5642591\charrsid14033962 ourt of Appeal decision of }{\b\ul\insrsid5642591\charrsid14033962 Teddy Sseezi Cheeye vs Uganda }{\b\ul\insrsid3995\charrsid14033962 Misc. Criminal A}{ \b\ul\insrsid5642591\charrsid14033962 ppl. No.37/2009 }{\insrsid5642591\charrsid14033962 and the Supreme Court case }{\b\ul\insrsid5642591\charrsid14033962 Arvind Patel vs Uganda, }{\insrsid5642591\charrsid14033962 Criminal }{ \insrsid3995\charrsid14033962 A}{\insrsid5642591\charrsid14033962 pplication }{\insrsid3995\charrsid14033962 No.1 of 2003. In the S}{\insrsid5642591\charrsid14033962 upreme Court case, which was followed }{\insrsid7423916\charrsid14033962 by this}{ \insrsid5642591\charrsid14033962 court in }{\b\ul\insrsid5642591\charrsid14033962 Cheeye }{\insrsid3995\charrsid14033962 case, }{\insrsid5642591\charrsid14033962 the court laid a number o}{\insrsid5118452\charrsid14033962 f considerations that should ap} {\insrsid5642591\charrsid14033962 ply to an application for }{\insrsid7423916\charrsid14033962 bail}{\insrsid5642591\charrsid14033962 pending appeal which are:- \par \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\b\insrsid5642591\charrsid14033962 \'93(i) }{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 the character of the applicant; \par (ii)}{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 whether he or she is a first offender or not; \par }\pard \qj \fi-720\li2160\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin2160\itap0\pararsid14033962 {\b\insrsid5642591\charrsid14033962 (iii) }{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 whether the offence of which the applicant was convicted involved personal violence; \par (iv) }{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 the appeal is not frivolous and has a reasonable possibility of success; \par (v) }{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 the possibility of substantial delay in the determination of the appeal and \par (vi) }{\b\insrsid3995\charrsid14033962 \tab }{\b\insrsid5642591\charrsid14033962 whether the applicant has complied with bail }{\b\insrsid7423916\charrsid14033962 conditions}{\b\insrsid5642591\charrsid14033962 granted before the }{ \b\insrsid7423916\charrsid14033962 applicant\rquote s}{\b\insrsid5642591\charrsid14033962 conviction and during the pendency of the appeal.\'94 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\b\insrsid5642591\charrsid14033962 \par }\pard \qj \li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid14033962 {\insrsid2825543\charrsid14033962 While learned counsel for the applicant strongly submitted that all these }{ \insrsid7423916\charrsid14033962 conditions}{\insrsid2825543\charrsid14033962 were fulfilled in this application, }{\insrsid7423916\charrsid14033962 counsel}{\insrsid2825543\charrsid14033962 for the respondent argued that n}{ \insrsid5118452\charrsid14033962 one of them existed. I will now}{\insrsid2825543\charrsid14033962 proceed to assess the merit of these submissions.}{\insrsid5642591\charrsid14033962 \par }{\insrsid2825543\charrsid14033962 \par {\listtext\pard\plain\insrsid2825543\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (i)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin1440\itap0\pararsid14033962 { \ul\insrsid2825543\charrsid14033962 Character of Applicant: \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14033962 {\ul\insrsid2825543\charrsid14033962 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\insrsid2825543\charrsid14033962 The applicant did not seek to rebut the }{\insrsid5118452\charrsid14033962 assert}{ \insrsid7423916\charrsid14033962 i}{\insrsid5118452\charrsid14033962 o}{\insrsid7423916\charrsid14033962 n}{\insrsid2825543\charrsid14033962 of the respondent that he was, in 2004, arrested for }{\insrsid7423916\charrsid14033962 smuggling}{ \insrsid2825543\charrsid14033962 goods and was fined Ug.shs.10,000,000/= [Ten million only] by URA. However his counsel }{\insrsid7423916\charrsid14033962 argues}{\insrsid2825543\charrsid14033962 that }{\insrsid7423916\charrsid14033962 URA is}{ \insrsid2825543\charrsid14033962 not a court of law and that this is one of the grounds of appeal to be decided in this court that the matter should not have been }{\insrsid7423916\charrsid14033962 taken}{\insrsid2825543\charrsid14033962 into account when sentencing him. This will}{\insrsid15232980\charrsid14033962 ,}{\insrsid2825543\charrsid14033962 however, arise if the }{\insrsid7423916\charrsid14033962 substantive}{\insrsid2825543\charrsid14033962 appeal against the }{ \insrsid7423916\charrsid14033962 decision}{\insrsid2825543\charrsid14033962 of }{\insrsid15232980\charrsid14033962 the}{\insrsid7423916\charrsid14033962 Chief}{\insrsid2825543\charrsid14033962 M}{\insrsid15232980\charrsid14033962 agistrate is heard by the High C}{\insrsid2825543\charrsid14033962 ourt. The appeal in this court is only against summary dismissal. However, to avoid prejudicing the issue, I will not decide this consideration in favour or against anyone. \par \par {\listtext\pard\plain\insrsid2825543\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (ii)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin1440\itap0\pararsid14033962 { \ul\insrsid2825543\charrsid14033962 Whether applicant is first offender or not: \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14033962 {\ul\insrsid2825543\charrsid14033962 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\insrsid2825543\charrsid14033962 Because of the reasons I have given in (i) above, I propose not to pronounce myself on this consideration. \par \par {\listtext\pard\plain\insrsid2825543\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (iii)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin1440\itap0\pararsid14033962 { \ul\insrsid2825543\charrsid14033962 The appeal is not }{\ul\insrsid7423916\charrsid14033962 frivolous}{\ul\insrsid2825543\charrsid14033962 and has a reasonable possibility of success. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14033962 {\ul\insrsid7144313\charrsid14033962 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\insrsid7144313\charrsid14033962 The appeal [Cr. Appeal No.21 of 2009] }{\insrsid15232980\charrsid14033962 was dismissed }{ \insrsid7144313\charrsid14033962 on the grounds that no grounds of appeal were disclosed and that it did not }{\insrsid7423916\charrsid14033962 follow the}{\insrsid7144313\charrsid14033962 law. I do not have the benefit o}{ \insrsid15232980\charrsid14033962 f seeing the documents which were}{\insrsid7144313\charrsid14033962 filed in that }{\insrsid7423916\charrsid14033962 appeal,}{\insrsid7144313\charrsid14033962 as they are not on this record. This was dismissal on technical grounds. Subsequently}{\insrsid15232980\charrsid14033962 ,}{\insrsid7144313\charrsid14033962 the parties agreed to late filing of the appeal be}{\insrsid15232980\charrsid14033962 fore the Registrar of the High C}{\insrsid7144313\charrsid14033962 ourt as a result of which }{\b\ul\insrsid7144313\charrsid14033962 Cr. Appeal No.24 of 2009}{\insrsid7144313\charrsid14033962 was filed. The High Court judge again dismissed it because he had already dismissed a similar appeal in }{\b\ul\insrsid7144313\charrsid14033962 Cr. Appeal No.21 of 2009.}{\insrsid7144313\charrsid14033962 He did not comment on the correctness or otherwise of the fact that the appeal was filed by consent of the parties and following the order of the Registrar of the Court. Yet the applicant seemed to have genuine }{\insrsid7423916\charrsid14033962 grievances}{\insrsid7144313\charrsid14033962 namely:- \par \par {\listtext\pard\plain\insrsid7144313\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \qj \fi-360\li1800\ri0\sl360\slmult1\widctlpar\jclisttab\tx1800\aspalpha\aspnum\faauto\ls2\ilvl1\adjustright\rin0\lin1800\itap0\pararsid14033962 { \insrsid7144313\charrsid14033962 The }{\insrsid7423916\charrsid14033962 omnibus}{\insrsid7144313\charrsid14033962 way the magistrate treated the plea. \par {\listtext\pard\plain\insrsid7144313\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (b)\tab}The passing of an }{\insrsid7423916\charrsid14033962 omnibus}{\insrsid7144313\charrsid14033962 sentence. \par {\listtext\pard\plain\insrsid7144313\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (c)\tab}The forfeiture of the lorry without giving the applicant opportunity to be heard. \par {\listtext\pard\plain\insrsid7144313\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (d)\tab}Taking into account a previous }{\b\insrsid7144313\charrsid14033962 \'93conviction\'94 }{\insrsid7144313\charrsid14033962 by URA. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14033962 {\insrsid7144313\charrsid14033962 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\insrsid7144313\charrsid14033962 These, and possibly more, are the matters that the High Court will have to consider at an }{ \insrsid7423916\charrsid14033962 appropriate}{\insrsid7144313\charrsid14033962 time. This court will have to consider whether it }{\insrsid15232980\charrsid14033962 w}{\insrsid7144313\charrsid14033962 as proper to }{\insrsid7423916\charrsid14033962 dismiss}{\insrsid7144313\charrsid14033962 such an intended appeal on a technical ground or in such a summary manner. The right to appeal is so important that everything possible should be done n}{\insrsid15232980\charrsid14033962 ot to frustrate it lightly. In}{\insrsid7144313\charrsid14033962 my view, the appeal No.24 of 2009 is not frivolous and its chances of success cannot be just dismissed. In my view, this consideration is present. \par }{\ul\insrsid7144313\charrsid14033962 \par {\listtext\pard\plain\insrsid7144313\charrsid14033962 \hich\af0\dbch\af0\loch\f0 (iv)\tab}}\pard \qj \fi-720\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls2\adjustright\rin0\lin1440\itap0\pararsid14033962 { \ul\insrsid7144313\charrsid14033962 The possibility of substantial delay in determination of the appeal. \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid14033962 {\ul\insrsid7144313\charrsid14033962 \par }\pard \qj \li1440\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin1440\itap0\pararsid14033962 {\insrsid7144313\charrsid14033962 The Court of Appeal of Uganda/}{\insrsid7423916\charrsid14033962 Constitutional}{ \insrsid15232980\charrsid14033962 C}{\insrsid7144313\charrsid14033962 ourt of Uganda is a very busy court. It is loaded with backlogs in thousands of appeal both criminal and civil. At the same time there are many }{\insrsid7423916\charrsid14033962 constitutional}{\insrsid7144313\charrsid14033962 matters waiting urgent attention by the court. The applicant was sentenced to 12 months imprisonment. He still has 7 months to go.
