I notified the parties of this view, and they decided to address me on the subject befor\hich\af0\dbch\af36\loch\f0 e I reached a final decision on the matter. }{\f0\fs24\insrsid15423842\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid10238474\charrsid2977727 \hich\af0\dbch\af36\loch\f0 4.\tab}}{\f0\fs24\insrsid10238474\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Mr. Masembe, learned counsel for the Respondent, }{ \f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 opposed the proposed direction }{\f0\fs24\insrsid11298111\charrsid2977727 \hich\af0\dbch\af36\loch\f0 to transfer this case}{\f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 for trial }{\f0\fs24\insrsid8920042\charrsid2977727 \hich\af0\dbch\af36\loch\f0 to}{\f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 the Chief Magistrates}{\f0\fs24\insrsid8920042\charrsid2977727 \loch\af0\dbch\af36\hich\f0 \rquote }{\f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Court of Mengo, while Mr. Byaruhanga, learned counsel for the Petitioner \hich\af0\dbch\af36\loch\f0 had no objection to the transfer of the case.}{ \f0\fs24\insrsid10238474\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 5.\tab}}{\f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Mr. Masembe submitted }{ \f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 that Section}{\f0\fs24\insrsid11364084\charrsid2977727 \hich\af0\dbch\af36\loch\f0 3 of }{\f0\fs24\insrsid5836885\charrsid2977727 \hich\af0\dbch\af36\loch\f0 the }{ \f0\fs24\insrsid11364084\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Divorce Act which provided for divorce petitions by Africans to be filed in Magistrates}{\f0\fs24\insrsid71814\charrsid2977727 \loch\af0\dbch\af36\hich\f0 \rquote }{ \f0\fs24\insrsid11364084\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Courts and petitions of Non Africans to be filed in the High Court was discri\hich\af0\dbch\af36\loch\f0 minatory and therefore offended Article }{ \f0\fs24\insrsid983498\charrsid2977727 \hich\af0\dbch\af36\loch\f0 21 of the Constitution. He submitted that }{\f0\fs24\insrsid13328741\charrsid2977727 \hich\af0\dbch\af36\loch\f0 the different treatment given to different parties was only on the basis of race, and thus denied African }{\f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 petitioners}{\f0\fs24\insrsid13328741\charrsid2977727 \hich\af0\dbch\af36\loch\f0 to commence their }{\f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 petitions}{\f0\fs24\insrsid13328741\charrsid2977727 \hich\af0\dbch\af36\loch\f0 in the High Court, a court t\hich\af0\dbch\af36\loch\f0 hat had more expertise than Magistrates Courts.}{\f0\fs24\insrsid5836885\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid13849960\charrsid2977727 \hich\af0\dbch\af36\loch\f0 6.\tab}}{\f0\fs24\insrsid13849960\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Secondly Mr. Masembe submitted that this court and the }{ \f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 magistrates\hich\f0 \rquote }{\f0\fs24\insrsid13849960\charrsid2977727 \hich\af0\dbch\af36\loch\f0 court}{\f0\fs24\insrsid71814\charrsid2977727 \hich\af0\dbch\af36\loch\f0 s}{ \f0\fs24\insrsid13849960\charrsid2977727 \hich\af0\dbch\af36\loch\f0 have concurrent jurisdiction with regard to divorce matters. If this court was minded to transfer this matter to the lower court, th}{\f0\fs24\insrsid15535259\charrsid2977727 \hich\af0\dbch\af36\loch\f0 a\hich\af0\dbch\af36\loch\f0 t}{\f0\fs24\insrsid13849960\charrsid2977727 \hich\af0\dbch\af36\loch\f0 decision was }{\f0\fs24\insrsid15535259\charrsid2977727 \hich\af0\dbch\af36\loch\f0 discretionary.}{ \f0\fs24\insrsid6359008\charrsid2977727 \hich\af0\dbch\af36\loch\f0 A decision was discretionary only in the sense that there was no binding rule of law but the decision maker had to be}{\f0\fs24\insrsid4329891\charrsid2977727 \hich\af0\dbch\af36\loch\f0 just,}{\f0\fs24\insrsid6359008\charrsid2977727 \hich\af0\dbch\af36\loch\f0 fair,}{\f0\fs24\insrsid4329891\charrsid2977727 \hich\af0\dbch\af36\loch\f0 right, equitable and reasonable. He feared that if sent below this case would}{\f0\fs24\insrsid1528500\charrsid2977727 \hich\af0\dbch\af36\loch\f0 suff \hich\af0\dbch\af36\loch\f0 er further}{\f0\fs24\insrsid15021372\charrsid2977727 \hich\af0\dbch\af36\loch\f0 delay given the backlog of cases in Magistrates}{\f0\fs24\insrsid71814\charrsid2977727 \loch\af0\dbch\af36\hich\f0 \rquote }{ \f0\fs24\insrsid15021372\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Courts}{\f0\fs24\insrsid1528500\charrsid2977727 \hich\af0\dbch\af36\loch\f0 . \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid1528500\charrsid2977727 \hich\af0\dbch\af36\loch\f0 8.\tab}\hich\af0\dbch\af36\loch\f0 Mr. }{\f0\fs24\insrsid11631662\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Byaruhanga learned counsel for the petitioner had no objection to this matter being transferred to a magistrates\hich\f0 \rquote \loch\f0 court for determination. He was confident that it would not suffer any\hich\af0\dbch\af36\loch\f0 unusual delay in that court.}{\f0\fs24\insrsid9574041\charrsid2977727 \hich\af0\dbch\af36\loch\f0 He challenged the respondent\hich\f0 \rquote \loch\f0 s assertion that Divorce Act was discriminatory, given that there was }{ \f0\fs24\insrsid15937138\charrsid2977727 \hich\af0\dbch\af36\loch\f0 no }{\f0\fs24\insrsid9574041\charrsid2977727 \hich\af0\dbch\af36\loch\f0 decision of the Constitutional Court on the matter.}{\f0\fs24\insrsid6576130\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid11737063\charrsid2977727 \hich\af0\dbch\af36\loch\f0 9.\tab}}{\f0\fs24\insrsid11737063\charrsid2977727 \hich\af0\dbch\af36\loch\f0 I start discussion of the matters in issue by setting out the relevant s\hich\af0\dbch\af36\loch\f0 tatutory provisions. I am not sure what was the mot}{\f0\fs24\insrsid9852456\charrsid2977727 \hich\af0\dbch\af36\loch\f0 ivation or rationale for the different treatment of Africans from Non-}{\f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Africans a\hich\af0\dbch\af36\loch\f0 t}{\f0\fs24\insrsid9852456\charrsid2977727 \hich\af0\dbch\af36\loch\f0 the time at the beginning of the last century. }{\f0\fs24\insrsid12472582\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Was it discrimination per se? Or was it some form of affirmative action intended to ensure that Africans}{ \f0\fs24\insrsid12536086\charrsid2977727 \hich\af0\dbch\af36\loch\f0 , the single largest segment of the population of the country at the time and now,}{\f0\fs24\insrsid12472582\charrsid2977727 \hich\af0\dbch\af36\loch\f0 had access to the co \hich\af0\dbch\af36\loch\f0 urts that were nearest to them, that is the magistrates courts, rather than the High Court which was only located at Entebbe at the time?}{\f0\fs24\insrsid11229411\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid10683209\charrsid2977727 \hich\af0\dbch\af36\loch\f0 12.\tab}}{\f0\fs24\insrsid10683209\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Whichever it may be that debate may be unnecessary given the clear words of the }{\f0\fs24\insrsid8022350\charrsid2977727 \hich\af0\dbch\af36\loch\f0 C}{\f0\fs24\insrsid10683209\charrsid2977727 \hich\af0\dbch\af36\loch\f0 onstitution which intend that all par\hich\af0\dbch\af36\loch\f0 ties shall be treated equally irrespective of race}{\f0\fs24\insrsid2903084\charrsid2977727 \hich\af0\dbch\af36\loch\f0 save where for policy reasons intended to address social, economic, educational or other imbalances}{\f0\fs24\insrsid4930133\charrsid2977727 \hich\af0\dbch\af36\loch\f0 in society. It is difficult to justify the different treatment based on race by using clause 3}{\f0\fs24\insrsid6045183\charrsid2977727 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid263257\charrsid2977727 \hich\af0\dbch\af36\loch\f0 of Article \hich\af0\dbch\af36\loch\f0 21 of the Constitution }{\f0\fs24\insrsid6045183\charrsid2977727 \hich\af0\dbch\af36\loch\f0 given that discrimination was only outlawed in this country in 1962 with our first independence constitution.}{ \f0\fs24\insrsid8022350\charrsid2977727 \hich\af0\dbch\af36\loch\f0 To that extent Section 3 of the Divorce Act may be in conflict with the Constitution.}{\f0\fs24\insrsid10683209\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid11162045\charrsid2977727 \hich\af0\dbch\af36\loch\f0 13.\tab}}{\f0\fs24\insrsid11162045\charrsid2977727 \hich\af0\dbch\af36\loch\f0 In light of Article 2 of the Constit \hich\af0\dbch\af36\loch\f0 ution the Constitution is the supreme law of the land, and}{\f0\fs24\insrsid263257\charrsid2977727 \hich\af0\dbch\af36\loch\f0 any }{\f0\fs24\insrsid11162045\charrsid2977727 \hich\af0\dbch\af36\loch\f0 law inconsistent with the Constitution is void to the extent of the inconsistency. }{\f0\fs24\insrsid10884473\charrsid2977727 \hich\af0\dbch\af36\loch\f0 The power to declare an Act of Parliament or provision thereof is a power that is reserved to the Constitution\hich\af0\dbch\af36\loch\f0 al Court. }{\f0\fs24\insrsid10356957\charrsid2977727 \hich\af0\dbch\af36\loch\f0 If the question of interpretation is substantial the question must be referred to the Constitutional Court. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid10884473\charrsid2977727 \hich\af0\dbch\af36\loch\f0 14.\tab}}{\f0\fs24\insrsid10884473\charrsid2977727 \hich\af0\dbch\af36\loch\f0 However}{\f0\fs24\insrsid10356957\charrsid2977727 \hich\af0\dbch\af36\loch\f0 ,}{\f0\fs24\insrsid10884473\charrsid2977727 \hich\af0\dbch\af36\loch\f0 where such a question arises not before the Constitutional Court}{\f0\fs24\insrsid15799631\charrsid2977727 \hich\af0\dbch\af36\loch\f0 but before another }{\f0\fs24\insrsid7025686\charrsid2977727 \hich\af0\dbch\af36\loch\f0 court and}{\f0\fs24\insrsid2784995\charrsid2977727 \hich\af0\dbch\af36\loch\f0 that question is not substantial, }{\f0\fs24\insrsid15799631\charrsid2977727 \hich\af0\dbch\af36\loch\f0 t\hich\af0\dbch\af36\loch\f0 hat court is obliged to interpret the law in question in accordance with Article 292 with such modifications, adapt}{\f0\fs24\insrsid8417105\charrsid2977727 \hich\af0\dbch\af36\loch\f0 at}{ \f0\fs24\insrsid15799631\charrsid2977727 \hich\af0\dbch\af36\loch\f0 ions and qualifications as are necessary to bring such law in conformity with the Constitution.}{\f0\fs24\insrsid1274104\charrsid2977727 \hich\af0\dbch\af36\loch\f0 See Ostraco Limited v Attorney General}{\f0\fs24\insrsid1384405\charrsid2977727 \hich\af0\dbch\af36\loch\f0 , HCT\hich\af0\dbch\af36\loch\f0 -00-CV-CS-1380-1986}{\f0\fs24\insrsid1274104\charrsid2977727 \hich\af0\dbch\af36\loch\f0 .}{ \f0\fs24\insrsid2510448\charrsid2977727 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid2784995\charrsid2977727 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid1274104\charrsid2977727 \hich\af0\dbch\af36\loch\f0 15.\tab}}{\f0\fs24\insrsid1274104\charrsid2977727 \hich\af0\dbch\af36\loch\f0 Taking that course in this instance }{ \f0\fs24\insrsid8271810\charrsid2977727 \hich\af0\dbch\af36\loch\f0 and having found}{\f0\fs24\insrsid1274104\charrsid2977727 \hich\af0\dbch\af36\loch\f0 that Section 3 of the Divorce Act }{\f0\fs24\insrsid8271810\charrsid2977727 \hich\af0\dbch\af36\loch\f0 is inconsistent with the Constitution I am obliged to interpret it in such a manner as would not permit its discriminatory aspects to persist so as\hich\af0\dbch\af36\loch\f0 to bring it in conformity with the Constitution.}{ \f0\fs24\insrsid8355399\charrsid2977727 \hich\af0\dbch\af36\loch\f0 There are several choices I have. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langnp2057\insrsid8355399\charrsid2977727 \hich\af0\dbch\af36\loch\f0 16.\tab}\hich\af0\dbch\af36\loch\f0 Firstly I can take the route proposed by the respondent and accept the proposition that now all divorce cases may be filed in the High Court}{\f0\fs24\insrsid11881287\charrsid2977727 \hich\af0\dbch\af36\loch\f0 .
