Unfortunately, the parties failed to reach a settlement. Hence the trial of this application proceeded as scheduled. \par Counsel for the applicant, Mr. Siraji Ali, by way of submissions argued the application on the basis of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11737690\charrsid12987031 grounds of the application. He prayed that this application be allowed and the amended petition be disallowed with costs.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7145467\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11737690\charrsid12987031 \par Dr. James Akampumuza, counsel for the respondent did not agree with the submission by counsel for the applicant. He applied for this application\rquote s dismissal with costs. That the amended p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 etition was done within the law}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10229231\charrsid12987031 .}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11737690\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10229231\charrsid12987031 \par Counsel for the respondent\rquote s arguments on his contention that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031\charrsid12987031 this application is incompetent and incurably defective is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10229231\charrsid12987031 that the application is not supported by any evidence. That the affidavit of the applicant in support of this }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8597640\charrsid12987031 application }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16272845\charrsid12987031 is incurably de}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 f}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16272845\charrsid12987031 ective. He referred the court to page 2 of the said affidavit and submitted that the applicant\rquote s affidavit does not conform to the law in that in its jurat the non-appearance of the word \'93deponent\'94 affects its format. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2965304\charrsid12987031 That the applicant\rquote s affidavit does not conform with ord er 19 rule 3 of the Civil Procedure Rules in that the said affidavit is not confined to such facts within the knowledge of the applicant in this regard, counsel referred court to paragraph 4 of the applicant\rquote s affidavit that the applicant does not state in his affidavit the basis of his belief of his lawyers\rquote advice. That the applicant\rquote s affidavit is argumentative and as such it should be struck out. That the applicant\rquote s failure to attach a copy of the amended petition leads the applicant into alleging unsubstantiated statement/allegations. He reiterated his first submission on the matters and maintained that the application is proper. \par \par On the issue of the applicant\rquote s affidavit being incurably defective, I have looked at and considered the said affidavit in its }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031\charrsid12987031 entirety}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13317196\charrsid12987031 in light of the submissions by both counsel for the parties and I find the said affidavit pr}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 oper. The said affidavit does }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13317196\charrsid12987031 comply with the law. My finding is supported by the case of MBAYO JACOB ROBERT \endash VS- ELECTORAL COMMISSION & TALONSYA SINAH, Election Petition Appeal no.007 0f 2006 where by the court of Appeal read with approval the Supreme Court decision in Dr. Kiiza Besigye \endash Vs- Electoral Commission and Museveni Kaguta. Election Petition no. 0001 of 2001; where it was held by the court that Election Petitions are very important and that therefore courts should take a liberal view of affidavits so that petitions are not defeated on technicalities. In specific reference to the Jurat, the Hon. Chief Justice J. B. In that paragraph 4 the applicant stated that: \par \'93That I have been advised by my lawyers M/s Muwema & Mugerwa & Co. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 Advocates}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11555065\charrsid12987031 whose advice I verily }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 believe}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11555065\charrsid12987031 to be true\'85\'85\'85.\'94 It is very clear to everyone th at the basis of his belief was indicated or well spelt out in that paragraph. Thus, the respondent\rquote s counsel contention in that regard does not hold water. \par Consequently, on the submissions by counsel for the respondent on the averments by }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031 the applicant on matters of law,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11555065\charrsid12987031 I have perused the applicant\rquote s said affidavit and found that in the matters of law deponed on by the applicant are based on the advice of his lawyers. And where they were not the matters of law must have been in the applicant\rquote }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 s knowledge and that he c}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11555065\charrsid12987031 ould lawfully }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 depone on them. In regard to this contention by counsel for the respondent, I perused the respondent\rquote s affidavit in reply and found no evidence therein to challenge the applicant\rquote s knowledge of the law. May be the respond ent and his lawyer very well knew that the applicant is a lawyer, himself and if there was any doubt about the applicant\rquote s knowledge of the law, counsel for the respondent would have the applicant cross-examined on these points. Short of that, such contention raised by counsel for the respondent ought to be answered in the negative.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid11555065\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 \par Furthermore, on the issue of none attachment of the amended petition on the applicant\rquote s affidavit in support of the application, hence re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031 ndering that affidavit }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 incurably}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 defective. The application and the affidavit of applicant in support of the petition all refer in absolute words that the respondent\rquote s amended petition filed in court on 8/4/2011 is defective. The applicant\rquote s affidavit goes ahead to state evidence why the applicant thinks that, that amended petition should be disallowed. In the affidavit in reply to this application, the respondent in his statements very well understands what amended petition the applicant is referring to. Therefore, it is my finding that since this application arises out of the main petition no. 0001 of 2011 where the amended }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13832065\charrsid12987031 petition }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 was filed and }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13832065\charrsid12987031 placed it was not mandatory for the applicant to have attached the same on his affidavit in support of this application. Hence counsel for }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 respondent\rquote s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13832065\charrsid12987031 submissions on that point are answered in the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 negative.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7417326\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 \par Counsel for the respondent further submitted that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 there is no evidence to show that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 the applicant shall be prejudiced because of the amended petition. That the proposed amendment only affects the Electoral Commission which is in charge of the conduct of elections. That the Electoral Commission has not objected and that it beautifully filed an answer to the amended }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 petition. That the applicant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4858610 too}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 on 15/4/2011 filed in this court an answer to the amend}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 ed petition. That }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 therefore, this application is a waste of time. I have looked at both answers to the amended petition filed by t he applicant and the Electoral Commission and noted that the aforesaid parties in their ground do object to the amended petition. I further note from their answers to the petition that the said respective parties filed their answers to the petition with out prejudice. Hence, it is not true that the applicant conceded to the amended petition. Thus, the applicant was entitled to file this application. The application, therefore, cannot be said to be a waste of time of the court. \par \par It is the submission of counsel }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 for}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13204147\charrsid12987031 the respondent that the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360\charrsid12987031 amendment of the petition with or without leave is}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13204147\charrsid12987031 allowed in election petitions, like in any other pleadings. That Rule 17 of the Parliamentary Elections (Elections Petitions) Rules does not at }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2490592\charrsid12987031 all prohibit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13204147\charrsid12987031 amendments.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5850804\charrsid12987031 He submitted that the grounds argued by the counsel for the applicant are in effect the same. That the cases cited by the applicant\rquote s counsel do not support the applicant\rquote s position of the law. He too relie}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 d on the cases of }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid6626324\charrsid12987031 SITENDA SEBALU}{ \rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid5850804\charrsid12987031 \endash VS- SAM . K. NJUBA & THE ELECTORAL COMMISSION, SUPREME COURT ELECTION PETITION APPEAL NO. 026 OF 2007;}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5850804\charrsid12987031 that the case dealt with the situation whereby the Supreme Court overturned the decision of the High Court and Court of appeal that failure to serve th e notice of presentation of petition within seven (7) days as prescribed under the Parliamentary Elections Act was a matter fixed by statute and no application could be made to enlarge time within which to file and serve the notice of representation. Th at the parties in that case had relied on the case of }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid5850804\charrsid12987031 Makula International Ltd \endash Vs- His }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12987031\charrsid12987031 Eminence}{ \rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid6626324\charrsid12987031 Cardinal Emmanuel Nsu}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid5850804\charrsid12987031 buga & Another [1982] HCB 11}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9784360 ,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5850804\charrsid12987031 and that the Supreme Court allowed service of Notice of Presentation of the petition after two (2) years. That all the cases cited by counsel for the applicant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 were cited out of contest.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2958396\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 \par Counsel for the respondent also relied on the case }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 Mbayo Jacob Robert \endash Vs- Electoral Commission & Another (Supra) in support of his submissions that the court of Appeal was clear that an amendment of pleadings is aimed at allowing a litigant to plead the whole claim he was entitled to make in respect of his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 or her cause of action. That }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 therefore, the amen}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 ded petition fal}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 ls within the law. In reply, counsel for the applicant do not agree with the submission by counsel for the respondent. \par \par From the submissions by both counsel, they all touch on the principle laid down in the case of Makula International L}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 td \endash Vs- His Eminence Nsu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 buga & Another (Supra). It is important t o note that the principle in that case is that court shall not exercise its residual or inherent jurisdiction to extend or enlarge time which is fixed by an Act of Parliament. That principle is cited with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 approval in the case of Besweri Lubuye}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 Kibuka \endash Vs- Electoral Commission & Another, constitutional Petition no. 08 of 1998 whereby it was held that:-
\par }\pard \ltrpar\qj \li720\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16000384 {\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid8259304\charrsid12987031 \'93 In our view, the correct ratio decidendi of Makula International }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid16737452\charrsid12987031 Ltd is that if there is no statutory provision or rule which gives the court discretion to extend or a bridge the time set by statute or rule, then the court has no residual or inherent jurisdiction to enlarge a period of time laid down by the statute or rule. This interpretation is in consonant with the decisions in the two cases of the Sup reme Court relied upon.\'94 \par }\pard \ltrpar\qj \li0\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16000384 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16737452\charrsid12987031 \par I }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 have read the case of Sitenda Sebalu}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16737452\charrsid12987031 (Supra) the Supreme Court confirmed or emphasized that principle that where time is fixed by statute, court cannot exercise its discretion to extend it. However, in the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10123178\charrsid12987031 facts of that partic ular case the Supreme Court held that since the time fixed by section 62 of the Parliamentary Elections Act for service of Notice of presentation of Petition was also fixed in the Parliamentary Elections (Election Petition) Rules, Rule 6 (1) the court had powers to exercise its inherent powers to extend that time since that power is enshrined in Rule 19 of the said Rules. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 The Court held further that since Parliament under section 93 had empowered the Chief Justice in consultation with the Attorney General to make Rules relating inter}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 alia to service of Notice of Presentation of Petition it was the intention of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 Parliament that the terms of se}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 ction 62 of PEA which use}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 the word shall would not be mandatory but rather directory.}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8259304\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 \par In the instant application, the principle in Makula International LTD (Supra) applies in that section 60 (3) of the PEA provides for the filing of petition within 30 (thirty) days. There is no rule in the Parliamentary Elections (Election Petition) Rules that repeats such provision
such as to fall squarely in the decision of Sitenda Sebalu case as submitted by counsel for the respondent. It is my considered view that an amendment that carries with it new grounds of the petition as set out under section 61 (1) of PEA would be barre d by limitation as set out in section 60 (3) of the PEA. \par \par On the 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid14617021\charrsid12987031 st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 ground that the amended petition is misconceived and incurably defective. It is an agreed fact that the respondent amended the petition without first seeking leave o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 f court to do so. According}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 to rule 17 of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 Parliamentary}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 Elections (Election Petition) Rules, the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031 court has }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 discretion to determine what modification of the application of the Civil Procedure Act and Civil Procedure Rules in relation to Election Petitions so that the interests of Justice the expeditio}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 u}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 s trial of the petition can be met. Therefore if a party wishes to amend its pleadings, an application seeking for leave to amend has }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 be filed in court and heard interparties. In the case }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 Mbayo Jacob Robert (Supra) the court held that application for an amendment can }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid2429960\charrsid12987031 made orally or informally by chamber summons. Also see section 100 of the Civil Procedure Act. The power to sanction any amendment of any pleadings lies with the court.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid14617021\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid346407\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 The aforesaid}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid346407\charrsid12987031 , therefore clears the contention by counsel for the respondent that an amendment of pleadings can be made }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5708359\charrsid12987031 as of right }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16000384\charrsid12987031 ithout}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5708359\charrsid12987031 leave of court even after the closure of pleadings by a party. Therefore, an amendment filed in court after the subs cribed time allowed by law and without the leave of the court is definitely incurably defective. And such pleadings ought to be illegal and a nullity at law. And therefore, under the principle in the Makula Intern}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 ational LTD case (Supra) such}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5708359\charrsid12987031 amended pleadings must be rejected by court.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5708359 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid5708359\charrsid12987031 It is also my considered view that order 6 rule 20 of the Civil Procedure Rules under which the respondent\rquote s counsel based themselves to effect the amendment without seeking leave of court is not applicable to matters concerning election petitions. The rationale for the discretion give to court in this regard under Rule 17 (Supra) is due to the great public interest and importance attached to the conduct and determination of election petitions. The PEA and its Rule s provide very strict time limits for the conduct of the election petitions. For instance under S.60 (3) of the PEA a petitioner is given 30 (thirty) days from the date of the results were gazetted to fil}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9594909\charrsid12987031 e a petition. Under Rule 6 of the Rules governing election petitions the petitioner has only 7 (seven) days within which to serve the Notice of presentation of a petition }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3425735\charrsid12987031 and }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9594909\charrsid12987031 the petition on the respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3425735\charrsid12987031 . The respondent}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9594909\charrsid12987031 has only 10 (ten) days from the date of service to file an answer to the petition an d only 5 (five) days within which to serve the petitioner with the answer (See Rule 8 (1) of the said Rules). The court itself is required to handle the election petitio}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3425735\charrsid12987031 n expeditiously on } {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9594909\charrsid12987031 day to day and to set aside all other matters (see section 63 (2) of the PEA). }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3425735 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9594909\charrsid12987031 The court is also required to conclude the election petitions within the period of 30 (thirty) days after commencement of the hearing (see Rule 13 (1) and (2) of the said Rules). All the aforesaid }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 instances clearly show that time is of essence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6626324\charrsid12987031 . O}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 n the contrary, order 6 rule 20 of the civil procedure Rules }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid415912\charrsid12987031 create}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 completely different time frames which contradict the law governing the trial and hearing of election petitions}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 . O}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 rder 6 rule 20 thereof allows the plaintiff to amend his pla int at any time within 21 days or where the written statement of defence is filed, then within 14 days from the time of filing the defence. Then order 6 rule 24 of the defendant has a right to reply to the amended plaint within 14 days. Therefore, the modifications of applying the Civil Procedure in election petitions talked of in Rule 17 of the Rules governing election petitions can not allow o}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 rder 6 rule 20 of CPR to override the election petition}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 laws and their rules made there under. That\rquote s why th erefore it was necessary for the respondent to have sought leave of the court first, before, he could amend his petition. All in all, considering my analysis of the law and the submissions of both parties on this point, I answer the 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid15473984\charrsid12987031 st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid15473984\charrsid12987031 ground of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3156479\charrsid12987031 this application in the affirmative.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid346407\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3156479\charrsid12987031 \par On the second ground of the application of whether the amended petition introduces a new cause of action after the expi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 r}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 y of the statutory limited period of 30(thirty) days within which to file the election petition. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 \par \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 It}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360 i}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 s trite law that an amendment that introduces a new cause of action cannot be allowed.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3156479\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 This principle is well set in the following cases: }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9116161\charrsid9784360 Epaineto \endash Vs- Uganda Commercial Bank (1971) EA 185 where it was held that: \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 \'93A proposed amendment which introduces a new cause of action after the expiry of a period of limitation must be rejected.\'94 \par See also the case of }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9116161\charrsid9784360 A}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12987031\charrsid9784360 u}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9784360 to Ga}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12987031\charrsid9784360 r}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9784360 a}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid12987031\charrsid9784360 ge & others \endash Vs- Motorkov}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid9116161\charrsid9784360 }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid7159543\charrsid9784360 (no. 3) [1971] EA 514}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 whereby it (Mustafa, JA dissenting) was held that:}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9116161\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 \'93The amendment introduced a new cause of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 action should not be allowed so }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 as to defeat a defence of limitation.\'94 \par \par I have read the amended petition and the original petition together with its affidavit in support and I am in agreement with counsel for the applica nt that the amended petition introduces a new cause of action, that of non-compliance with the provisions of the PEA in section 61 (1) (a). }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9131021\charrsid12987031 The}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 original petition had only the ground of wrong declaration of results whereby, the applicant was declared a wi nner whereas not. All the amended paragraphs of the amended petition clearly show that the non-compliance of the provisions of the PEA is a new cause of action which was not obtaining in the original petition. It is also important to note that each gr ound set out in section 61 of the PEA is a separate cause of action.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 Therefore the amendment in question filed on 8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid7159543\charrsid12987031 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 /4/2011 was well after the expiry of 30 (thirty) days. The results of these elections were gazetted on 4}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid7159543\charrsid12987031 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 March, 2011. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid415912\charrsid12987031 Hence}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 to permit the respondent/petitioner to a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 mend his petition and introduce}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 a new cause }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9131021\charrsid12987031 of action after the expiry of the statutory period of 30 (thirty) days would deprive the applicant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 of his right to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 raise}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 the preliminary objections he set out in his answer to the original petition. I wish also to observe that the amended petition was prompted by the preliminary objections raised by the applicant in his answer to the petition. This is also a conduct of counsel for the respondent to render }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031\charrsid12987031 nugatory}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 the said objections by curing the defects in the original petition }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 by bringing }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 the amended petition. Thus, these have the effect of depriving the applicant from exercing his right to a defence of limitation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 , and res}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12987031 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 judicata he raised as}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 preliminary objections in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3939152\charrsid12987031 answer}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 to the original petition. I therefore answer the second ground of the applicant in the affirmative.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid7159543\charrsid12987031 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 \par Lastly, having resolved the 1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid6756399\charrsid12987031 st}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 and 2}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid6756399\charrsid12987031 nd}{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 grounds in favour of the applicant, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid8477991\charrsid12987031 it }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 i s my finding that the amended petition is prejudicial to the rights of the applicant that existed at the date of the amendments, namely;- \par }\pard \ltrpar\qj \li720\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid16000384 {\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid6756399\charrsid12987031 \'93}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid3939152\charrsid12987031 The}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid6756399\charrsid12987031 right to raise preliminary objections as set out in the }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid3939152\charrsid12987031 answer}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid6756399\charrsid12987031 to the original petition.\'94 \par }\pard \ltrpar\qj \li0\ri0\sl360\slmult1\widctlpar\wrapdefault\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid16000384 {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399\charrsid12987031 It is trite law that no amendment }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3939152\charrsid12987031 would be allowed to the prejudice of the opposite party\rquote s rights that existed at the date of the proposed amendments. In the case of }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3939152\charrsid9784360 Lubowa Gyaviira & others \endash Vs- Makerere University, High Court Miscellaneous application no. 071 of 2009, Hon. Mr. Justice Yorokamu Bamwine(as he then was held}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3939152\charrsid12987031 that:-}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid6756399 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid9784360\charrsid12987031 \par }{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid3939152\charrsid9784360 \'93No amendment would be allowed which would prejudice the rights of the opposite party existing at the date of the proposed amendment.\'94 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3939152\charrsid12987031 \par I, therefore, answer this 3}{\rtlch\fcs1 \af0 \ltrch\fcs0 \super\insrsid3939152\charrsid12987031 rd}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3939152\charrsid12987031 ground of the application in the affirmative. \par In the result and for the reasons given herein above in this ruling, the applicant\rquote s application has merit.
