(Being an Application seeking review of sentence, arising from conviction and sentence on 49/2020 in Ukwala PM Magistrates’ Court Criminal Case No. 631 of 2019)

Ruling

1. The convict is George Onyango aged 22 years old. He is serving a prison term for the offence of Burglary and Stealing upon conviction by Ukwala Principal Magistrate’s court on 4/9/2020. He has now served one (1) year and 10 months. The victim of the offence is said to have forgiven him and that he is remorseful and that he is willing to serve community service.

2. I hereby order that in the spirit of prison decongestion, George Onyango shall be released from prison forthwith to serve unpaid community service at Ugunja Probation Office for a period of 9 months from the date of his release and to abide by conditions of CSO and not to commit any offence in the next 12 months.
