Second}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ly the plaintiffs claim is time barred in so far as the subject matter is land based on the agreement m}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 ade in 1977 which was never com}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 plied with by the plaintiff. To this he referred me to section 6 of the limitation Act which specifically states \'93 No action shall be brought to recover land after the expiration of 12 years The plaintiff had brought the suit in 1992 after 15 years had expire d from the date upon which the agreement to enter the land was made. The legal principles of the limitation Act are binding and mandatory and prayed th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 t the suit be dismissed with costs. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 On the other hand Mr. Zaabwe the learned counsel representing the p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 laintiff clarified that plot No.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 13 was}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid13325902\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 not mentioned in the plaint but the same was referred to in }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 Annexture}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 D and G. The plaintiff did not comply with what }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 he }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 was required to do. In annexture B the defendant invited the late Mujooba to pay money for this plot and the late Mujoobe Complied with that when he paid money under Annexture G and that was acknowledged}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid3676689\charrsid4926927 by the defendant in annexture \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 G \'94. He }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 therefore submitted that the suit was not time burred, }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 before}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 1977}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the late Mujoobe was in possession of the l and in dispute by customary tenures. On 17th June 1977 the defenda}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 nt invited the late Mujoobe to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 co}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 nvert his customary tenure to leasehold}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 at was clearly stated in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 his le}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 tter Annexture G. There the defendant was asking the late }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 Mujoobe to pay }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 money for the purchase of the land and covert it }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 lease hold}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 . }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 The late Mujoobe paid for the plot and a }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 receipt}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 Annexture }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 D was issued to him by one Waswa stating that the money he paid was a premium of plot 13 and that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 a formal receipt would be }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 prepared}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 by the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 defendant}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 . The defendant acknowledged the receipt }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 of shs.6000/= paid}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 by Mujoobe for plot 13 and went a head to stipulate the terms of}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid13325902\charrsid4926927 }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the lease. T}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 he defendant there after infor}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 med the late Mujoobe that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 y}{\rtlch\fcs1 \ab\af0 \ltrch\fcs0 \b\insrsid13325902\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 would la}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ter go }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 to a lawyer and execute a lease. He}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 submitted that the late Mujoobe complied with the conditions the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 defendant set}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 and it remained for the defendant to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 execute}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the lease. The plaintiff was seeking for specific performance of the document, the agreement entered into with the late }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 Mujoobe on the 24th August 1977. The lat}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 e Mujoobe had interest in the land in the customary tenure. He was in possession of the land and still his successor is in possession of that land the present plaintiff could only lose right if the defendant took back the land from him or }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 from the late Mujoobe.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 The defendant had never done so a part from his failure to execute the lease. If any right of execution accrued that would be in 1990 when the defendant refused to execute the lease in favour of the plaintiff. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 U}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 nd}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 er S.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 4 (6) of the }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 Limitation A}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ct the suit is not time burred. In }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 case}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 it is found that section 6 of the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 Limitation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 Act applied to this case then the period of 12 years started running from 24/8}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 /1977. The period was affected }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 by the death of the late Mujoobe who died on }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 5th Feb 1987 and by that }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ti}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 me the period of 12 years had not}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 yet expired. That in the interest of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid16538240\charrsid4926927 justice the suit be determined on its merits.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 If however the court found that the suit was time burred still the pl}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 aintiff }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 would be entitled to occupation of the suit land under customary tenure. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 In reply Mr. Mukama submit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 ted that it was clear from his }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 learned friends submission that the plaintiffs claim is based on what transpired in 1977 and it was the basis upon which the plaintiff brought the pre}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 sent claim seeking various and }{ \rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 numerous }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 relief}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 jointly and or severally. That under paragraph 4 of the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 plaint the plaintiff seeks for }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 General damages that perse does not allow him }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 to}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 call this }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 an equitable relief.}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 It is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 a }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 special relief }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 which exonerates it from fall}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ing in the ambit of Section 4 and }{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid13325902\charrsid4926927 5 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 of the L}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 imitation Act. His learned friend}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 \rquote s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 departure from the pleadings supported hi}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 claim that the suit w}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 as time barred. The revelation }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 that the late Mujoobe died in }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 1987}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ten years after the contractual }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 arrangements}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 was binding on the }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 Plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 s}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the administrator since even the deceased had not taken the required legal action within the six years limit to c}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 onclude and comply to complete }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the co}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 nditions upon which the lease wa}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 s to be executed}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 . And the fact that the deceased}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 time barred the plainti}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 ff was more time barred. To date the plaintiff has n}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ot complied with what was agreed upon in 1977}{\rtlch\fcs1 \ai\af0 \ltrch\fcs0 \i\insrsid13325902\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 by th}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 e deceased to the defendant among which would have included paying the agreed amount upon a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 nnual normal rent. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 I was opportuned to peruse the p}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 leadings and at the same time }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 I listened carefully to the able submissions by the learned counsels appearing for the parties. The law as I un}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid4926927 derstand it is that under }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 the L} {\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 imitation Act }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 Cap 70,}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 Section }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 4 (1) a as already pointed out by the learned }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 counsels above is that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 \'93}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 An action}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 founded on a contract or tort }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 shal}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 l not be brought after the expiration}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 of }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 six}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 years and under subsection (6) there is }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 however an exception to section 4 (1}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ) }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 (}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 a}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 )}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 in that the action shall not apply to any}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 claim of contract for specific }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 performan}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 ce of a contract or for an injunc}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 tion or for other equitable }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 relief in}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 so far as any provision thereof may be applied by the court by an analogy in like manner as the period of limit}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 at}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 ion in force before the commencement of the act have here to been applied. }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 . \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 Where as }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 under}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 section 6 of the referred to Act no action shall be brought for }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 recovery of land after the expiration }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 of 12 years from the date on which the right of action accrued to him or if it first accrued to person through }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid10429019\charrsid4926927 whom he claims to that person. \par }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 In the instant case the plaintiff as administrator to the estate of the late Mujoobe is seeking for specific performance of the contract of the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 lease agreement entered into between the said Mujoobe and the defendant on 24/}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 8/1977. He is therefore not time}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 barred this being an exception to the provision of section 4(1) (a) of the Act. There was }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 a provision in the sale }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 agrement that}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 ; \par \'93We shall go to the lawyer and execute a formal lease\'94 \par Neither the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 late Mujoobe nor the defendant took steps with }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 a view}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 to }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 have the formal lease executed. M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 eanwhile the said Mujoobe passed a way in 1987 as per information }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 from}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the bar without the defendant }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 executing the}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 lease. For the plaintiff}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 , he }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 contacte}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 d}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 the defendant on 6/12/1990 urging him to carry out his obligation}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 to execute such lease in favour }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 of the late M}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid12271794\charrsid4926927 uj}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13316591\charrsid4926927 oobe }{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13325902\charrsid4926927 but the defendant re}{\rtlch\fcs1 \af0 \ltrch\fcs0 \insrsid13316591\charrsid4926927 fused and or neglected to do so.
