Though Hon. Justice C. K. It is for that reason that she did not sign the}{\fs28\insrsid6687237\charrsid1471862 ruling of the court. She also did not wish to par}{\fs28\insrsid1073465 ticipate in the proceedings where}{ \fs28\insrsid6687237\charrsid1471862 we ordered the advocates for the respondent to appear before us to show cause why they should not be ordered to pay the costs.}{\fs28\insrsid604223\charrsid1471862 \par }{\fs28\insrsid6687237\charrsid1471862 \par At the hearing, Mr. Komakech, counsel for the respondent presented a written submission on behalf of his firm. In that document, Mr. Komakech who had signed the written submission on behalf of the firm, Victoria Advocates and Legal Consultants, challenges the finding of the court as to who was responsible for the dismissal of the respondents appeal. Mr. Komakech alleged that his client was at fault b ecause she was the one who had assembled all the documents upon which the advocates relied in filing both the appeal and the reply to this application. In his view, she should be the one to pay the costs. \par \par We gave the respondent }{\fs28\insrsid4527012\charrsid1471862 opportunity}{\fs28\insrsid6687237\charrsid1471862 to respond to her }{\fs28\insrsid4527012\charrsid1471862 advocate\rquote s}{\fs28\insrsid6687237\charrsid1471862 submission. She stated that shortly after judgment was delivered in }{\fs28\insrsid4527012\charrsid1471862 Soroti}{\fs28\insrsid6687237\charrsid1471862 High Court, her lawyer}{\fs28\insrsid1073465 s}{\fs28\insrsid6687237\charrsid1471862 convinced her that there would be merit in filing an appeal. She then instructed them to file }{\fs28\insrsid4527012\charrsid1471862 the}{\fs28\insrsid6687237\charrsid1471862 appeal. From then, she left the lawyers }{ \fs28\insrsid4527012\charrsid1471862 to handle the}{\fs28\insrsid6687237\charrsid1471862 procedure professionally. According to her, when she appeared in court on 7th February 2008, she believed that her appeal was }{ \fs28\insrsid4527012\charrsid1471862 going}{\fs28\insrsid6687237\charrsid1471862 to be heard only to be confronted with this application which her advocates had not informed her about. She heard }{\fs28\insrsid1073465 the}{ \fs28\insrsid6687237\charrsid1471862 court asking her advocate why he had not applied for }{\fs28\insrsid4527012\charrsid1471862 extension}{\fs28\insrsid6687237\charrsid1471862 of time and was surprised to hear her advocate reject an }{ \fs28\insrsid4527012\charrsid1471862 opportunity}{\fs28\insrsid6687237\charrsid1471862 to do so which the court indicated }{\fs28\insrsid1073465 it }{\fs28\insrsid6687237\charrsid1471862 would be prepared to grant. She was neither aware that false affidavits had been }{\fs28\insrsid4527012\charrsid1471862 filed}{\fs28\insrsid6687237\charrsid1471862 nor was she conversant with the procedure to be followed in filing the appeal or rebutting an application challenging the validity of her appeal. The advocate did everything without consulting her and she assumed they were doing the right thing . She stated }{\fs28\insrsid4527012\charrsid1471862 that}{\fs28\insrsid6687237\charrsid1471862 she had come to court to seek justice but justice was denied to her due to the negligence of her lawyers. She prayed that the mistakes of her lawyers should not be visited on her and asked that they should pay the costs of the }{ \fs28\insrsid4527012\charrsid1471862 petition}{\fs28\insrsid6687237\charrsid1471862 and the appeal. \par \par Mr. M}{\fs28\insrsid1073465 u}{\fs28\insrsid6687237\charrsid1471862 wanga, who appeared for the 1st applicant submitted }{\fs28\insrsid4527012\charrsid1471862 that}{\fs28\insrsid6687237\charrsid1471862 it was not open for }{ \fs28\insrsid4527012\charrsid1471862 counsel}{\fs28\insrsid6687237\charrsid1471862 or the }{\fs28\insrsid1073465 respondent }{\fs28\insrsid6687237\charrsid1471862 to attack the ruling of the }{\fs28\insrsid4527012\charrsid1471862 court as}{ \fs28\insrsid6687237\charrsid1471862 he had done, because this hearing was not an appeal against the ruling of the court. He reit erated that the advocates of the respondent had been grossly negligent and should be ordered to pay the costs resulting from their negligence. \par \par }{\fs28\insrsid2297090\charrsid1471862 Mr. Komakech in reply submitted }{\fs28\insrsid4527012\charrsid1471862 that}{\fs28\insrsid2297090\charrsid1471862 it was the respondent who was all along at }{\fs28\insrsid4527012\charrsid1471862 fault}{ \fs28\insrsid2297090\charrsid1471862 and who should pay the costs. He gave three reasons:-}{\fs28\insrsid6687237\charrsid1471862 \par {\listtext\pard\plain\fs28\insrsid4527012\charrsid1471862 \hich\af0\dbch\af0\loch\f0 (a)\tab}}\pard \qj \fi-360\li720\ri0\sl360\slmult1\widctlpar\jclisttab\tx720\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin720\itap0\pararsid1471862 { \fs28\insrsid4527012\charrsid1471862 It}{\fs28\insrsid2297090\charrsid1471862 was her who prepared all }{\fs28\insrsid4527012\charrsid1471862 documents}{\fs28\insrsid2297090\charrsid1471862 relied upon in the reply to the application and must be held responsible for any errors and lies therein. \par {\listtext\pard\plain\fs28\insrsid2297090\charrsid1471862 \hich\af0\dbch\af0\loch\f0 (b)\tab}}\pard \qj \fi-360\li720\ri0\sl360\slmult1\widctlpar\jclisttab\tx720\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin720\itap0\pararsid4527012 { \fs28\insrsid2297090\charrsid1471862 She was telling lies to the court when she said that she was not aware of this application because \par {\listtext\pard\plain\fs28\insrsid2297090\charrsid1471862 \hich\af0\dbch\af0\loch\f0 -\tab}}\pard \qj \fi-360\li1440\ri0\sl360\slmult1\widctlpar\jclisttab\tx1440\aspalpha\aspnum\faauto\ls3\ilvl1\adjustright\rin0\lin1440\itap0\pararsid1471862 { \fs28\insrsid2297090\charrsid1471862 She deponed and signed documents in support thereof. \par {\listtext\pard\plain\fs28\insrsid2297090\charrsid1471862 \hich\af0\dbch\af0\loch\f0 -\tab}She was the one who called Mr. Amuria, th}{\fs28\insrsid1471862\charrsid1471862 e Deputy Registrar Soroti High C}{\fs28\insrsid2297090\charrsid1471862 ourt, to come to }{\fs28\insrsid4527012\charrsid1471862 Kampala}{\fs28\insrsid2297090\charrsid1471862 to swear the }{\fs28\insrsid4527012\charrsid1471862 false}{\fs28\insrsid2297090\charrsid1471862 affidavit in support of the application. \par {\listtext\pard\plain\fs28\insrsid2297090\charrsid1471862 \hich\af0\dbch\af0\loch\f0 -\tab}She appeared in this court in December 2007 when this application was first called for hearing. \par {\listtext\pard\plain\fs28\insrsid2297090\charrsid1471862 \hich\af0\dbch\af0\loch\f0 (c)\tab}}\pard \qj \fi-360\li720\ri0\sl360\slmult1\widctlpar\jclisttab\tx720\aspalpha\aspnum\faauto\ls3\adjustright\rin0\lin720\itap0\pararsid4527012 { \fs28\insrsid2297090\charrsid1471862 She had not paid the fees of the advocates for the application and the appeal. \par }\pard \qj \li360\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin360\itap0\pararsid1471862 {\fs28\insrsid1471862\charrsid1471862 \par }\pard \qj \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid4527012 {\fs28\insrsid4527012\charrsid1471862 Mr. Komakech also tried to put the blame on Mr. Amuria, the Deputy Registrar, High C}{ \fs28\insrsid1471862\charrsid1471862 o}{\fs28\insrsid4527012\charrsid1471862 urt Soroti, whose conduct, he claimed, should first be investigated. }{\fs28\insrsid1073465 \par \par We were surprise}{\fs28\insrsid2297090\charrsid1471862 that }{\fs28\insrsid4527012\charrsid1471862 Mr}{\fs28\insrsid2297090\charrsid1471862 . Komakech was prepared to tell the court a few more lies to cover the failings and negligence of his firm. It is not true that the respondent is the one who deponed and signed docum ents in support of the application. We have carefully inspected the record of this application and we are unable to find any document deponed or signed by her in support of }{\fs28\insrsid1073465 or in opposition to }{ \fs28\insrsid2297090\charrsid1471862 the application. It is}{\fs28\insrsid1073465 only Amuria Charles and Harriet}{\fs28\insrsid2297090\charrsid1471862 Nanyonjo, a process server of M/s Victoria}{\fs28\insrsid1471862\charrsid1471862 A}{ \fs28\insrsid2297090\charrsid1471862 dvocates and }{\fs28\insrsid1471862\charrsid1471862 C}{\fs28\insrsid4527012\charrsid1471862 onsultants}{\fs28\insrsid2297090\charrsid1471862 , who signed the documents in support of }{\fs28\insrsid1073465 the answer to }{\fs28\insrsid2297090\charrsid1471862 this application.}{\fs28\insrsid2297090 \par }{\fs28\insrsid1471862\charrsid1471862 \par }{\fs28\insrsid2297090\charrsid1471862 Secondly, we see no evidence on record to show that it was the }{\fs28\insrsid5077990\charrsid1471862 respondent who called Mr. }{\fs28\insrsid4527012\charrsid1471862 Amuria}{\fs28\insrsid5077990\charrsid1471862 }{ \fs28\insrsid4527012\charrsid1471862 Charles}{\fs28\insrsid5077990\charrsid1471862 to }{\fs28\insrsid4527012\charrsid1471862 Kampala}{\fs28\insrsid5077990\charrsid1471862 to swear the false affidavit. }{\fs28\insrsid4527012\charrsid1471862 Incidentally }{\fs28\insrsid5077990\charrsid1471862 , we were not even aware that he was purposely called to }{\fs28\insrsid4527012\charrsid1471862 Kampala}{\fs28\insrsid5077990\charrsid1471862 to swear the affidavit. His affidavit shows that it was deponed }{ \fs28\insrsid4527012\charrsid1471862 before}{\fs28\insrsid1471862\charrsid1471862 a Magistrate in the Chief M}{\fs28\insrsid5077990\charrsid1471862 agistrates Court of Soroti on 21st January}{\fs28\insrsid1073465 2008 in Soroti.}{ \fs28\insrsid2297090\charrsid1471862 \par }{\fs28\insrsid5077990\charrsid1471862 \par Thirdly, it is not true that the respondent appeared in this court}{\fs28\insrsid1073465 in December 2007 in response to}{\fs28\insrsid5077990\charrsid1471862 summons to hear this application. The court record does not bear out the claim that the application was called for hearing in December 2007. In fact the }{\fs28\insrsid4527012\charrsid1471862 respondent\rquote s}{\fs28\insrsid5077990\charrsid1471862 conferencing notes were not filed until}{\fs28\insrsid1471862\charrsid1471862 15}{\fs28\super\insrsid1471862\charrsid1471862 th}{\fs28\insrsid1471862\charrsid1471862 }{\fs28\insrsid5077990\charrsid1471862 January 2008. It could not have been fixed for hearing before then. \par }{\fs28\insrsid1471862\charrsid1471862 \par }{\fs28\insrsid4527012\charrsid1471862 Lastly}{\fs28\insrsid5077990\charrsid1471862 , it is of no relevance, and it is not a defence that M/s Victoria Advocates and }{\fs28\insrsid4527012\charrsid1471862 Consultants}{\fs28\insrsid5077990\charrsid1471862 behaved the way they did because they were allegedly not paid their fees. They accepted to represent the respondent, which they are still doing up to this moment. They are duty bound to perform the task }{\fs28\insrsid4527012\charrsid1471862 diligently }{\fs28\insrsid5077990\charrsid1471862 .}{\fs28\insrsid5077990 \par }{\fs28\insrsid1471862\charrsid1471862 \par }{\fs28\insrsid5077990\charrsid1471862 In our judgment, Mr. Komakech Godfrey and his law firm of M/s Victoria }{\fs28\insrsid1471862\charrsid1471862 Advocates and C}{\fs28\insrsid5077990\charrsid1471862 onsultants failed to show cause why they should not be condemned to pay costs of the applicants due to their gross negligence in handling the respondents appeal and the application to strike out the appeal.
