The three brothers }{\f35\fs28\insrsid9322566 were}{ \f35\fs28\insrsid9186983 I}{\f35\fs28\insrsid1706291 smail Muguta,}{\f35\fs28\insrsid10819933 }{\f35\fs28\insrsid7501332 husband of the respondent, Joab}{\f35\fs28\insrsid1597568 }{\f35\fs28\insrsid4999646 Majungu}{\f35\fs28\insrsid1706291 and Yesse Itetura.}{\f35\fs28\insrsid1706291\charrsid1706291 }{\f35\fs28\insrsid1706291 The last was the }{\f35\fs28\insrsid8922957 husband of the applicant. }{\f35\fs28\insrsid3238749 As a result}{\f35\fs28\insrsid8922957 of a dispute }{ \f35\fs28\insrsid150042 among}{\f35\fs28\insrsid8922957 the three, the}{\f35\fs28\insrsid3238749 first two brothers filed a suit in the High Court}{\f35\fs28\insrsid1597568 , at Mbarara,}{\f35\fs28\insrsid3238749 against the last brother}{ \f35\fs28\insrsid10687053 . }{\f35\fs28\insrsid8276915 Before the suit was decided, Joab }{\f35\fs28\insrsid4999646 Majungu}{\f35\fs28\insrsid8276915 died. }{\f35\fs28\insrsid10687053 The }{\f35\fs28\insrsid1597568 suit was}{\f35\fs28\insrsid10687053 heard and decided by Musoke Kibuka}{\f35\fs28\insrsid6691097 ,J.}{\f35\fs28\insrsid4945007 ,}{\f35\fs28\insrsid1597568 in 2001. }{\f35\fs28\insrsid6691097 The suit was eventually de}{\f35\fs28\insrsid1597568 cided in favour of Ismail Muguta}{ \f35\fs28\insrsid6691097 . Yesse Itetura appealed to the Court of Appeal (Civil Appeal No.22 of 2002), which in 2005 upheld the decision}{\f35\fs28\insrsid16344712 of the High Court. Meantime I}{\f35\fs28\insrsid6691097 smail Muguta, a respondent in the appeal }{\f35\fs28\insrsid6191690 also }{\f35\fs28\insrsid6691097 died in 2004 and his widow, the present respondent in this application }{\f35\fs28\insrsid6645073 obtained letters of administration}{ \f35\fs28\insrsid6691097 on 24}{\f35\fs28\super\insrsid6691097\charrsid6691097 th}{\f35\fs28\insrsid6691097 March, 2004 before the Court of Appeal decided the appeal in 2005 in favour o}{\f35\fs28\insrsid16005345 f her late husband. As fate would have it}{\f35\fs28\insrsid7870247 ,}{\f35\fs28\insrsid16005345 in the mean}{\f35\fs28\insrsid6691097 time the husband of the applicant}{\f35\fs28\insrsid16344712 who had }{\f35\fs28\insrsid16005345 himself }{ \f35\fs28\insrsid16344712 filed in this Court Civil Appeal No.5 of 2002 }{\f35\fs28\insrsid10233108 also }{\f35\fs28\insrsid16344712 died. The present applicant}{\f35\fs28\insrsid6191690 obtained letter}{\f35\fs28\insrsid16005345 s}{ \f35\fs28\insrsid6191690 of administration}{\f35\fs28\insrsid16344712 to his estate and so she is }{\f35\fs28\insrsid10233108 now }{\f35\fs28\insrsid16344712 his legal representative in the present proceedings. }{\f35\fs28\insrsid12005272 \par }{\f35\fs28\insrsid16005345 T}{\f35\fs28\insrsid16344712 he present respondent moved High Court in Mbarara }{\f35\fs28\insrsid16005345 for orders of}{\f35\fs28\insrsid16344712 execution to proceed against the applicant to recover costs in High Court and }{\f35\fs28\insrsid7870247 of the }{\f35\fs28\insrsid16344712 Court of Appeal and }{\f35\fs28\insrsid13312271 finally }{\f35\fs28\insrsid16344712 to get vacant possession of land.}{\f35\fs28\insrsid4999646 T}{\f35\fs28\insrsid622512 he applicant instituted the}{\f35\fs28\insrsid16207138 se}{\f35\fs28\insrsid622512 proceedings seeking for orders of stay of the said execution }{\f35\fs28\insrsid16207138 pending disposal of the appeal i}{\f35\fs28\insrsid622512 n this Court.}{ \f35\fs28\insrsid4999646 }{\f35\fs28\insrsid13194793 }{\f35\fs28\insrsid1648216 }{\f35\fs28\insrsid6362541 In a rejoinder affidavit the applicant states that the High Co urt erred when it granted orders for execution first because the respondent had not by then got letters of administration and second because Tujunga is not a party to the proceedings as the suit against him abated when he died.}{\f35\fs28\insrsid6691097

The appeal to this Court was instituted on 20/7/2006 without certificate from the Registrar of}{\f35\fs28\insrsid464773 the}{\f35\fs28\insrsid12339206 Court of Appeal indicating w}{\f35\fs28\insrsid2701504 hen proceedings were ready for collection. We cannot make our}{\f35\fs28\insrsid5713839 decision on }{\f35\fs28\insrsid7026616 the }{\f35\fs28\insrsid5713839 basis of Mr. }{ \f35\fs28\insrsid15293938 Katembeko\rquote s statements from}{\f35\fs28\insrsid11745892 the bar}{\f35\fs28\insrsid7026616 .}{\f35\fs28\insrsid11745892 }{\f35\fs28\insrsid4876726 \par }{\f35\fs28\insrsid12005272 \par }{\f35\fs28\insrsid11745892 With regard to the two }{\f35\fs28\insrsid7026616 remaining }{\f35\fs28\insrsid11745892 contention}{\f35\fs28\insrsid7026616 s,}{\f35\fs28\insrsid11745892 Mr. Muhwezi replied first that S.134 of RTA requires a legal representa }{\f35\fs28\insrsid16278907 tive to be put on certificate. }{\f35\fs28\insrsid11745892 As regards Mr. Katembeko\rquote s contention on }{\f35\fs28\insrsid7026616 the }{\f35\fs28\insrsid11745892 competence of the appeal}{\f35\fs28\insrsid7026616 ,}{ \f35\fs28\insrsid11745892 Mr. Muhwezi argued that a separate notice of motion should have been filed }{\f35\fs28\insrsid11821973 under Rule}{\f35\fs28\insrsid16407965 78 of the Rules of this Court.
