\hich\af0\dbch\af36\loch\f0 The applicant is a British citizen but of Uganda origin. \par }{\f0\fs24\insrsid2432242\charrsid5332282 \hich\af0\dbch\af36\loch\f0 Under\hich\af0\dbch\af36\loch\f0 section 45(1) }{\f0\fs24\insrsid9529582\charrsid5332282 \hich\af0\dbch\af36\loch\f0 of the Children Act, interalia, }{ \f0\fs24\insrsid2432242\charrsid5332282 \hich\af0\dbch\af36\loch\f0 an adoption order child}{\f0\fs24\insrsid662577\charrsid5332282 \hich\af0\dbch\af36\loch\f0 or sole female applicant }{\f0\fs24\insrsid14299811\charrsid5332282 \hich\af0\dbch\af36\loch\f0 in respect of a male child is }{\f0\fs24\insrsid14299811\charrsid5332282 \hich\af0\dbch\af36\loch\f0 female. }{\f0\fs24\insrsid6557982\charrsid5332282 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid14299811\charrsid5332282 \hich\af0\dbch\af36\loch\f0 S}{\f0\fs24\insrsid6557982\charrsid5332282 \hich\af0\dbch\af36\loch\f0 he therefore }{\f0\fs24\insrsid1796254\charrsid5332282 \hich\af0\dbch\af36\loch\f0 qualifies \hich\af0\dbch\af36\loch\f0 an application for adoption shall not be considered unless the applicant has fostered the child for not less than thirty six months under the supervision of a He recommended that the }{\f0\fs24\insrsid7999632\charrsid5332282 \hich\af0\dbch\af36\loch\f0 children}{\f0\fs24\insrsid1722562\charrsid5332282 \hich\af0\dbch\af36\loch\f0 be reunited with the aunt so that he can provide for their welfare, medical, p\hich\af0\dbch\af36\loch\f0 hysical}{\f0\fs24\insrsid269379\charrsid5332282 \hich\af0\dbch\af36\loch\f0 and e}{\f0\fs24\insrsid1722562\charrsid5332282 \hich\af0\dbch\af36\loch\f0 motional needs and that it is in the best interests of the children that }{\f0\fs24\insrsid9578826\charrsid5332282 \hich\af0\dbch\af36\loch\f0 they}{\f0\fs24\insrsid1722562\charrsid5332282 \hich\af0\dbch\af36\loch\f0 be reunited with the applicant who will be able to cater for }{\f0\fs24\insrsid15342325\charrsid5332282 \hich\af0\dbch\af36\loch\f0 them}{\f0\fs24\insrsid9578826\charrsid5332282 \hich\af0\dbch\af36\loch\f0 in a secure environment}{ \f0\fs24\insrsid11622077\charrsid5332282 \hich\af0\dbch\af36\loch\f0 where they can be treated as children. \par \hich\af0\dbch\af36\loch\f0 In view of the above, court is of th\hich\af0\dbch\af36\loch\f0 e view that even if the }{\f0\fs24\insrsid15342325\charrsid5332282 \hich\af0\dbch\af36\loch\f0 petitioner}{\f0\fs24\insrsid11622077\charrsid5332282 \hich\af0\dbch\af36\loch\f0 had not fostered the children}{\f0\fs24\insrsid15217117\charrsid5332282 \hich\af0\dbch\af36\loch\f0 physically,}{\f0\fs24\insrsid11622077\charrsid5332282 \hich\af0\dbch\af36\loch\f0 she has fostered }{ \f0\fs24\insrsid11734831\charrsid5332282 \hich\af0\dbch\af36\loch\f0 them }{\f0\fs24\insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 informally}{\f0\fs24\insrsid15217117\charrsid5332282 \hich\af0\dbch\af36\loch\f0 }{ \f0\fs24\insrsid11622077\charrsid5332282 \hich\af0\dbch\af36\loch\f0 and their present condition demands that they be with someone who can}{\f0\fs24\insrsid9578826\charrsid5332282 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid6843491\charrsid5332282 \hich\af0\dbch\af36\loch\f0 provide them}{\f0\fs24\insrsid15217117\charrsid5332282 \hich\af0\dbch\af36\loch\f0 with }{\f0\fs24\insrsid6843491\charrsid5332282 \hich\af0\dbch\af36\loch\f0 a home, physical and emotional support and the applicant, \hich\af0\dbch\af36\loch\f0 their maternal aunt is in the best}{\f0\fs24\insrsid7602767\charrsid5332282 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid15217117\charrsid5332282 \hich\af0\dbch\af36\loch\f0 position}{\f0\fs24\insrsid7602767\charrsid5332282 \hich\af0\dbch\af36\loch\f0 to provide it in compliance with section 3 and Paragraph 1(b) of the First Schedule to the Children Act, as they are \hich\af0\dbch\af36\loch\f0 The applicant is a British citizen according to her pa\hich\af0\dbch\af36\loch\f0 ssport on the court file. \par \hich\af0\dbch\af36\loch\f0 We shall therefore examine whether she fulfills the conditions for }{\f0\fs24\insrsid15217117\charrsid5332282 \hich\af0\dbch\af36\loch\f0 I}{\f0\fs24\insrsid2379739\charrsid5332282 \hich\af0\dbch\af36\loch\f0 nter-country adoption under section 46 of the Children Act. \par \hich\af0\dbch\af36\loch\f0 Under section 46, a person who is not a citizen of Uganda, may in exceptional circumstances adopt a h}{\f0\fs24\insrsid2379739\charrsid5332282 \hich\af0\dbch\af36\loch\f0 as a recommendation concerning his or her suitability to adopt from his or her country\hich\f0 \rquote \loch\f0 s Probat\hich\af0\dbch\af36\loch\f0 ion and Social Welfare Officer, or other competent authority and; \par {\listtext\pard\plain\s15 \insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 e)\tab}}{\f0\fs24\insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 h}{\f0\fs24\insrsid2379739\charrsid5332282 \hich\af0\dbch\af36\loch\f0 as satisfied court that his or her country of \hich\af0\dbch\af36\loch\f0 48}{\f0\fs24\insrsid13524097\charrsid5332282 \hich\af0\dbch\af36\loch\f0 left Uganda}{\f0\fs24\insrsid11734831\charrsid5332282 \hich\af0\dbch\af36\loch\f0 in}{\f0\fs24\insrsid13524097\charrsid5332282 \hich\af0\dbch\af36\loch\f0 2001, when she was\hich\af0\dbch\af36\loch\f0 53 years old. She ha} {\f0\fs24\insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 d}{\f0\fs24\insrsid13524097\charrsid5332282 \hich\af0\dbch\af36\loch\f0 lived in Uganda for 53 years and therefore fulfill}{\f0\fs24\insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 s}{\f0\fs24\insrsid13524097\charrsid5332282 \hich\af0\dbch\af36\loch\f0 the conditions in section 46(1) of the Children Act. \par \hich\af0\dbch\af36\loch\f0 The applicant who is the maternal aunt of the children has fostered them informally for over five years}{\f0\fs24\insrsid1574801\charrsid5332282 \hich\af0\dbch\af36\loch\f0 , by providing them }{ \f0\fs24\insrsid2644102\charrsid5332282 \hich\af0\dbch\af36\loch\f0 with\hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid1574801\charrsid5332282 \hich\af0\dbch\af36\loch\f0 a home, education, health care}{\f0\fs24\insrsid12139140\charrsid5332282 \hich\af0\dbch\af36\loch\f0 and }{\f0\fs24\insrsid1574801\charrsid5332282 \hich\af0\dbch\af36\loch\f0 maintenance, although }{\f0\fs24\insrsid2644102\charrsid5332282 \hich\af0\dbch\af36\loch\f0 not}{\f0\fs24\insrsid1574801\charrsid5332282 \hich\af0\dbch\af36\loch\f0 living with them. }{\f0\fs24\insrsid2644102\charrsid5332282 \hich\af0\dbch\af36\loch\f0 She has thus fulfilled the condition as to fostering. \par }{\f0\fs24\insrsid1574801\charrsid5332282 \hich\af0\dbch\af36\loch\f0 The applicant has no criminal record}{\f0\fs24\insrsid2644102\charrsid5332282 \hich\af0\dbch\af36\loch\f0 .
