IN THE HIGH COURT OF KENYA AT MOMBASA PROBATE AND ADMINISTRATION CAUSE NO.114 OF 1996 IN THE MATTER OF THE ESTATE OF: AHMED MOHAMED NASIB – DECEASED R U L I N G

I agree with Mr. Abubakar that this is a serious matter that affects the proper administration of justice and affects the liberty of an individual. While the individial may have private recourse in damages, this court must ensure that such actions by court clerks or any other person do not interfere with the proper Administrtion of Justice.

Accordingly I require the clerk, oneJULIUS NGUMBAO to file an Affidavit within the next seven days to explain himself and show cause why he should not be punished by this court.

The matter will be placed before me and the clerk together with both counsel will appear on 9. 7.01 for hearing and further orders.
