I must now turn t\hich\af0\dbch\af39\loch\f0 o the law. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 7.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid12220473 {\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 The applicants apply for legal guardianship under Article 139(1) of the Constitution, Sections 14 of the Judicature Act, Sections}{\f0\fs24\insrsid1405372 \hich\af0\dbch\af39\loch\f0 2, 3, 4 and 5 of the Children }{ \f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 Act, Section 98 of the Civil Procedure Act and Order 52 Rules 1 and 3 of the Civil Pr\hich\af0\dbch\af39\loch\f0 ocedure Rules. It is clear that the applicants\hich\f0 \rquote \loch\f0 intention is to adopt the infant in question and intend to do so in the USA in case this application succeeds. Given that scenario I would have been inclined to find that the applicable law should be Section\hich\af0\dbch\af39\loch\f0 \hich\af0\dbch\af39\loch\f0 46 of the Children Act which deals with inter-country adoption, in which case, this application would have failed given the fact that the applicants would not have complied with the residency requirement and the 36 months foster period. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 8.\tab}\hich\af0\dbch\af39\loch\f0 However, the Court \hich\af0\dbch\af39\loch\f0 of Appeal, in the case of In the Matter of Francis Palmer an Infant, Civil Appeal No. 32 of 2006, and in the case of In the matter of Howard Amani Little, an infant, Civil Appeal No.33 of 2006 held that this court has jurisdiction to grant orders of legal \hich\af0\dbch\af39\loch\f0 \hich\af0\dbch\af39\loch\f0 guardianship by a 2 to 1 decision. What that decision does not make clear are in what circumstances should a court issue that kind of order, especially in cases that are akin to inter country adoptions. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 9.\tab}\hich\af0\dbch\af39\loch\f0 In that the decision the Court of Appeal was divided \hich\af0\dbch\af39\loch\f0 as to when and how the High Court may grant orders of legal guardianship in the circumstances where the applicants were foreign applicants resident outside this country and whose intention of applying for legal guardianship was to take the children outsid \hich\af0\dbch\af39\loch\f0 e\hich\af0\dbch\af39\loch\f0 this jurisdiction. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 10.\tab}\hich\af0\dbch\af39\loch\f0 The Presiding Justice was of the view that legal guardianship was to be resorted to where the applicants could not fulfil the conditions under Section 46 of the Children\hich\f0 \rquote \loch\f0 s Act. The second Justice of Appeal disagreed. Though in agreement\hich\af0\dbch\af39\loch\f0 with the presiding justice that this court had jurisdiction to grant orders of legal guardianship, the justice of appeal stated that it should not be applicable where the applicants were foreign applicants who did not qualify under Section 46 of the Chil \hich\af0\dbch\af39\loch\f0 d\hich\af0\dbch\af39\loch\f0 ren\hich\f0 \rquote \loch\f0 s Act. To allow such applicants to obtain orders of legal guardianship, while they did not qualify to adopt the children under the Act, would be an infringement of the Act. The third Justice of Appeal did not agree that the High Court had the power to \hich\af0\dbch\af39\loch\f0 \hich\af0\dbch\af39\loch\f0 grant orders of legal guardianship, such power being only available to Family and Children\hich\f0 \rquote \loch\f0 s Court, by the issue of care orders and appointment of Foster Parents. Nevertheless he concurred in the granting of the order of guardianship proposed by the Presi\hich\af0\dbch\af39\loch\f0 d\hich\af0\dbch\af39\loch\f0 ing Justice. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 11.\tab}\hich\af0\dbch\af39\loch\f0 The Court of Appeal decision, given the conflicting legal positions taken by each justice, provides no authoritative guidance as to how this court should exercise its power in granting orders of legal guardianship. In the result}{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 ,}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 perhaps}{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 ,}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 I mu \hich\af0\dbch\af39\loch\f0 st turn to simply one question. Is the grant of such an order in the best interest of the infant? \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 12.\tab}\hich\af0\dbch\af39\loch\f0 What is needed for this infant and many other infants in h}{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 er}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 position is a home with lov}{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 ing parents and a family. This child}{ \f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 is being provided an opportunity \hich\af0\dbch\af39\loch\f0 to grow up in a loving family environment to be provided by the applicants. }{\f0\fs24\insrsid612873 \hich\af0\dbch\af39\loch\f0 The child\hich\f0 \rquote \loch\f0 s family circumstances are from being conducive }{\f0\fs24\insrsid14622818 \hich\af0\dbch\af39\loch\f0 for this}{\f0\fs24\insrsid2301657 \hich\af0\dbch\af39\loch\f0 child\hich\f0 \rquote \loch\f0 s normal development.}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 No governmental support, be it local or central, is available for the care and upkeep\hich\af0\dbch\af39\loch\f0 of }{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 vulnerable children suffering want of care}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 generally or specifically in the case of this child. I find therefore that exceptional circumstances exist for an order to be made in favour of non }{\f0\fs24\insrsid10960497 \hich\af0\dbch\af39\loch\f0 citizens}{\f0\fs24\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 who are the only viable alternative. \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid10960497\charrsid2182181 \hich\af0\dbch\af39\loch\f0 13.\tab}\hich\af0\dbch\af39\loch\f0 I am satisfied\hich\af0\dbch\af39\loch\f0 that it is in the infant\hich\f0 \rquote \loch\f0 s best interests to grant rather than refuse this application.
