Samuel, Keziah, Karis and even Micah are looking forward to having a baby}{\f0\fs24\insrsid5470506\charrsid149246 \hich\af0\dbch\af36\loch\f0 adopted into their }{\f0\fs24\insrsid11751037\charrsid149246 \hich\af0\dbch\af36\loch\f0 hom\hich\af0\dbch\af36\loch\f0 e}{\f0\fs24\insrsid5470506\charrsid149246 \hich\af0\dbch\af36\loch\f0 . Jason and Shawnda are more than adequate to provide for a \hich\af0\dbch\af36\loch\f0 nd love another child and they have proved their parenting abilities through the four children they are raising. }{\f0\fs24\insrsid15090932\charrsid149246 \par }{\f0\fs24\insrsid5470506\charrsid149246 \hich\af0\dbch\af36\loch\f0 This family has met the guidelines for North Carolina regarding inter-country adoption. I must now turn to the law and determine whether it is possible for this court to make the order sought. \par }\pard\plain \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid9702164\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 6.\tab}}\pard\plain \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 It is clear on the papers before me that the applicant\hich\af0\dbch\af36\loch\f0 s\hich\f0 \rquote \loch\f0 intention is to adopt the infant in question. However they have not applied for adoption. They have applied for legal guardianship.}{ \f0\fs24\insrsid9702164\charrsid149246 \par }\pard\plain \ql \li360\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin360\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid9702164\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 7.\tab}}\pard\plain \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 Clearly the applicants under Section 46 of the Children Act would not qualify on at least 2 out of the 5 conditions that\hich\af0\dbch\af36\loch\f0 have to be fulfilled. The applicants have not been residents in this country for 3 years and have not fostered the infant in question at all let alone the required period of 36 months. The applicants may fulfil the rest of the conditions. I shall set out \hich\af0\dbch\af36\loch\f0 \hich\af0\dbch\af36\loch\f0 Section 46 of the Children Act below. \par }\pard \s15\ql \li1440\ri1109\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin1109\lin1440\itap0\pararsid149246 {\f0\fs24\insrsid4406225\charrsid149246 \loch\af0\dbch\af36\hich\f0 \lquote \loch\f0 46 }{ \b\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 Intercountry Adoption }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 (1) A person who is not a citizen of Uganda may in exceptional circumstances adopt a Ugandan child, if he or\hich\af0\dbch\af36\loch\f0 she-- (a) has stayed in Uganda for at least three years; (b) has fostered the child for at least thirty six months under the supervision of a probat \hich\af0\dbch\af36\loch\f0 i\hich\af0\dbch\af36\loch\f0 on and social welfare officer; (c) does not have a criminal record; (d) has a recommendation concerning his or her suitability to adopt a child fro \hich\af0\dbch\af36\loch\f0 m\hich\af0\dbch\af36\loch\f0 his or her country\hich\f0 \rquote \loch\f0 s probation and welfare office or other competent authority; and (e) has satisfied the court that his or her country of origin will respect and recognise the ado \hich\af0\dbch\af36\loch\f0 p\hich\af0\dbch\af36\loch\f0 tion order.\hich\f0 \rquote \par }{\f0\fs24\insrsid9977735\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 8.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 { \f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 As the clear route of adoption is closed\hich\af0\dbch\af36\loch\f0 the applicants have resorted to\hich\af0\dbch\af36\loch\f0 another route, legal guardianship. }{ \f0\fs24\insrsid16529371\charrsid149246 \hich\af0\dbch\af36\loch\f0 This application is stated to be made under Article 139 (1) of the Constitution, Sections 14, 33 and 39 of the Judicature Act and Sec\hich\af0\dbch\af36\loch\f0 tion 3 of the Children Act. }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 The cited provisions do not authorise this court \hich\af0\dbch\af36\loch\f0 to grant an order of legal guardianship in the circumstances of this case. Firstly because clearly the law that would govern the circumstances of this case\hich\af0\dbch\af36\loch\f0 is the law related to i\hich\af0\dbch\af36\loch\f0 nter}{ \f0\fs24\insrsid9977735\charrsid149246 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 country adoption,\hich\af0\dbch\af36\loch\f0 which is evaded by the p}{\f0\fs24\insrsid9977735\charrsid149246 \hich\af0\dbch\af36\loch\f0 resent application}{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid9977735\charrsid149246 \hich\af0\dbch\af36\loch\f0 unless those conditions raise constitutional issues that may lead to their successful ouster by a competent court. }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 Secondly the provisions cited as the basis for this application do not prov\hich\af0\dbch\af36\loch\f0 ide expressly that this court is seized with the jurisdiction to grant orders of the kind now sought. }{\f0\fs24\insrsid6362871\charrsid149246 \par }\pard \s15\ql \li360\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin360\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 9.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 { \f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 However, the Court of Appeal, in the case of }{\f0\fs24\ul\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 In the Matter of Francis Palmer an Infant, Civil Appeal No. 32 of 2006} {\f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 , and in the case of }{\f0\fs24\ul\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 In the matter of\hich\af0\dbch\af36\loch\f0 Howard Amani Little, an infant, Civil Appeal No.33 of 2006}{\f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 held that this court has jurisdiction to grant orders of legal guardianship by a 2 to 1 decision. What that decision does not make clear are in what circumstances should a court issue that kind of\hich\af0\dbch\af36\loch\f0 order, especially in cases that are akin to inter country adoptions. \par }\pard \s15\ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 10.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 In that decision the Court of Appeal was divided as to when and how the High Court may grant orders of legal guardianship in the circumstances where the applicants were foreign applican \hich\af0\dbch\af36\loch\f0 ts resident outside this country and whose intention of applying for legal guardianship was to take the children outside this jurisdiction. \par }\pard \s15\ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 11.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 L M Kikonyogo, DCJ., was of the view that legal guardianship was to be resorted to where the applicants could not f\hich\af0\dbch\af36\loch\f0 ulfil the conditions under Section 46 of the Children Act. C Kitumba, JA., disagreed. Though in agreement with the learned Deputy Chief Justice that this court had jurisdiction to grant orders of legal guardianship, the learned justice of appeal stated th \hich\af0\dbch\af36\loch\f0 a\hich\af0\dbch\af36\loch\f0 t it should not be applicable where the applicants were foreign applicants who did not qualify under Section 46 of the Children Act. To allow such applicants to obtain orders of legal guardianship, while they did not qualify to adopt the children under th \hich\af0\dbch\af36\loch\f0 e\hich\af0\dbch\af36\loch\f0 Act, would be an infringement of the Act. A Twinomujuni, JA., did not agree that the High Court had the power to grant orders of legal guardianship, such power being only available to Family and Children\hich\f0 \rquote \loch\f0 s Court, by the issue of care orders and appointme\hich\af0\dbch\af36\loch\f0 n\hich\af0\dbch\af36\loch\f0 t of Foster Parents. Nevertheless he concurred in the granting of the order of guardianship proposed by the Deputy Chief Justice. \par }\pard \s15\ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 12.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 {\f0\fs24\insrsid6362871\charrsid149246 \hich\af0\dbch\af36\loch\f0 The Court of Appeal decision, given the conflicting legal positions taken by each justice, provides no authoritative guidance\hich\af0\dbch\af36\loch\f0 as to how this court should exercise its power in granting orders of legal guardianship. In the result, perhaps, I must turn to simply one question. Is the grant of such an order in the best interest of the children? \par }\pard\plain \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid9702164\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 13.\tab}}\pard\plain \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 The infant in this case is }{\f0\fs24\insrsid15606117\charrsid149246 \hich\af0\dbch\af36\loch\f0 about one \hich\af0\dbch\af36\loch\f0 year}{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 old. It is not possible to seek his views on the matter. }{\f0\fs24\insrsid13007583\charrsid149246 \hich\af0\dbch\af36\loch\f0 The child\hich\f0 \rquote \loch\f0 s parents whereabouts and details are unknown. }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 }{\f0\fs24\insrsid13007583\charrsid149246 \hich\af0\dbch\af36\loch\f0 Sanyu Babies Home who have legal custody of the child support this application. So does the Probation and Welfare Officer for Lubaga Div \hich\af0\dbch\af36\loch\f0 ision. }{\f0\fs24\insrsid12334926\charrsid149246 \hich\af0\dbch\af36\loch\f0 Care in an institution is only intended to be temporary. }{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 The applicants are willing to provide a loving and caring home within which to raise this infant. In fact they are the only ones who have made such an offer. The applicants come well recommend\hich\af0\dbch\af36\loch\f0 ed. \par }\pard \s15\ql \li720\ri0\sa200\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin720\itap0\pararsid149246 {\f0\fs24\insrsid7946301\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid7946301\charrsid149246 \hich\af0\dbch\af36\loch\f0 14.\tab}}\pard \s15\ql \fi-360\li720\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 {\f0\fs24\insrsid7946301\charrsid149246 \hich\af0\dbch\af36\loch\f0 No governmental support, be it local or central, is available for the care and upkeep of children in distress generally or specifically in the case of this infant. Right now the infant is under the care of a local non-governmental organisation. There \hich\af0\dbch\af36\loch\f0 is no offer from Ugandans or non-Ugandans resident in Uganda to adopt this child. It is imperative that his stay in an institution be terminated as soon as possible. I find therefore that exceptional circumstances exist for an order to be made in favour o \hich\af0\dbch\af36\loch\f0 f\hich\af0\dbch\af36\loch\f0 non citizens who are the only viable alternative. \par }\pard\plain \ql \li0\ri0\sl360\slmult1\widctlpar\aspalpha\aspnum\faauto\adjustright\rin0\lin0\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid9702164\charrsid149246 \par {\listtext\pard\plain\s15 \lang2057\langfe1033\langfenp1033\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 15.\tab}}\pard\plain \s15\ql \fi-360\li720\ri0\sl360\slmult1 \widctlpar\aspalpha\aspnum\faauto\ls1\adjustright\rin0\lin720\itap0\pararsid149246 \fs22\lang2057\langfe1033\loch\af36\hich\af36\dbch\af36\cgrid\langnp2057\langfenp1033 {\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 I am satisfied, on the informatio}{\f0\fs24\insrsid1716033\charrsid149246 \hich\af0\dbch\af36\loch\f0 n available to me at this stage}{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 that it is in the best interests of B}{ \f0\fs24\insrsid12334926\charrsid149246 \hich\af0\dbch\af36\loch\f0 enjamin}{\f0\fs24\insrsid4406225\charrsid149246 \hich\af0\dbch\af36\loch\f0 to allow this application rather than refuse it.
