Ruling

1. The deceased Gabriel Otiende Okelo, according to the death certificate attached was a resident of Lower Kadongo.Although there is no letter from the area local administration introducing the beneficiaries and which should be filed accordingly with duly signed documents in support of the petition before a grant can issue to the administrator with evidence of consents filed, the, estate property is Kisumu/Kadongo/1130, which is within the jurisdiction of Maseno SPM’s court.

2. I hereby transfer Kisumu Chief Magistrate Succession Cause No. E209 of 2024 to Maseno SPM’s Court for hearing and final determination.

3. The original Kisumu CM Succession No. E209 of 2024 to be transmitted to Maseno SPM’s court together with this ruling and order.

4. Upon receipt of the file and order, SPM Maseno Law Courts to notify the parties using the addresses given and or through the area Chief to move the court and prosecute the succession cause.

5. This file is closed.
