Ruling

1. The Petitioner Samson Okello Ondijo sought vide Kisumu CM Succession Cause No. E340 of 2024 for grant of letters of administration intestate, to administer the estate of the late Gumba Bodo who hailed from Olwenya location, Maseno as per the Chief’s letter dated 31st August 2024.

2. The Chief’s letter introduces the nephew to the deceased as the only surviving beneficiary.

3. This matter was brought to this court from the Chief Magistrate’s court for directions on transfer of the cause to Maseno SPM’s court. In view of the above, I hereby transfer Kisumu CM Succession Cause No. E340 of 2024 to Maseno Senior Principal Magistrate’s court for hearing and determination.

4. The e-file to be transmitted to Maseno SPM’s court electronically with this Order/Ruling.

5. Maseno SPM’s court to notify the Petitioner forthwith upon receipt of the e-file.

6. This file is closed.
