Directions

1. The court has perused the application dated 15th July 2024 as well as the various supporting affidavits by the Applicants and the annexures thereto.

2. The court has equally perused the replying affidavit by the executrix and how far she had complied with the orders of Muchelule J (as he then was) and in particular the inventory dated 6th October 2023.

3. That inventory is what the Applicants in their further affidavits have raised issues with namely that some of the properties had not been transmitted to them and so on.

4. At this juncture it becomes difficult to make a comprehensive decision on whether the Respondent has acted on the court’s directive or not.

5. I therefore direct the parties to appear before the Deputy Registrar of this court so that she can take stock of what the Respondent had done in compliance with the orders of 26th September 2022. The parties shall be at liberty to present their position including any documentary evidence.

6. The Deputy Registrar shall thereafter present her report to this court for further directions including the fate of this application.

7. The exercise be undertaken within 21 days from the date herein.
