Judgment

1. This matter coming up for hearing of Summons for confirmation of grant dated 6th day of October 2023, on 23rd day of April, 2024, and upon hearing all the parties and beneficiaries as well as their legal counsel, Ms. Chepkemoi, this court makes the following determination and orders: -i.That the parties and beneficiaries have agreed on the mode of distribution of the estate of the deceased. The court explained to the widow what the distribution meant who confirmed that she will be living with her daughter who takes the property where the matrimonial property stands, and that she will live therein in all her life.ii.That the mode of distribution, subject to what the widow has stated is not inconsistent with the law.iii.That those who are indicated to jointly own property shall own “in common in equal shares.” The schedule is accordingly amended.iv.Subject to (iii) above, the grant is confirmed. Distribution shall be as per the schedule annexed to the Affidavit in support of the Summons for confirmation of grant dated 6th day of October, 2023. Certificate for confirmation to be issued accordingly.Orders accordingly.
